C. Boyett Estate Subdivision. Item Summary: Approval of the ordinance will release approximately 4.55 square feet of an existing Landscape, Sidewalk and Public Access Easement. The existing Traditions Dormitory building encroaches into this portion of the easement. Item Background: The drawing on Exhibit A indicates that a corner portion of the existing building was constructed such that it encroaches into the existing easement by approximately 4.55 square feet. This encroachment does not interfere with the existing walkway and associated landscaping. The area in question, ties into the Second Street Promenade which provides adequate pedestrian access. The applicant is currently refinancing the project. Through this process, the building encroachment was identified as an issue, and the lender has asked that it be resolved. Budgetary and Financial Summary: N/A Staff Recommendation: Staff recommends approval of the ordinance abandoning the easement.
