The following specific adjustment (up to 10%) from the ordinance requirements is requested:
We request a 2% adjustment to the number of parking spaces required which will result in the reduction of one
parking space out of the required 58 spaces.
2. This adjustment will not be contrary to the public interest by virtue of the following facts:
The adjustment is not contrary to public interest by virtue of the fact that it is being requested out of concern for the
public's safety. We feel that the adjustment is consistent with avoiding public safety hazards.
3. The granting of the adjustment will not materially or adversely affect adjacent land uses or the physical
character of the uses in the immediate vicinity because of the following:

the uses in the immediate vicinity because there is sufficient parking in the overall shopping center although we
cannot find evidence of a shared parking agreement.
4. The granting of the adjustment will be consistent with the purpose and intent of the Unified Development Ordinance
because of the following:
The granting of the adjustment will be consistent with the purpose and intent of the UDO because the adjustment is
being requested for public safety reasons. The building is being renovated with elevators so handicap parking can
be provided under the building. The space being requested to be deleted is currently the handicap space for the
building but it is constructed on the slope of the drive into the shopping center. It is difficult to pull into and out of
this space because of incoming and outgoing traffic. The parking spot is only 19 1/2 feet from University Drive and
does not allow the drive to meet throat depth. The shortage of one parking space on this site is a much safer
situation than keeping this one parking spot.
