RE: A-1 Storage and Office Warehouse
Dear Mr. Elkins:
Thank you for your letter regarding your storage and office warehouse project. You did
not mention an address for the project. We are assuming it is located at the Southwest
corner of the intersection of Cain Road and Old Wellborn Road, but do need clarification
as to a specific location.
When the City annexed your property, a service plan was adopted as part of the
annexation ordinance. The service plan was prepared in accordance with State Law.
The plan states that "Construction activities underway prior to annexation may continue
provided that all construction after annexation must comply with City codes and
ordinances. All permits required by City codes and ordinances must be obtained for
construction underway. Permit fees shall be waived for construction underway prior to
annexation."
The effective date of the annexation was November 1, 2002. You indicate in your letter
that you had received some approval from the County for this development. It is
necessary that the City of College Station receive written documentation of these
approvals. There is no problem with the continuation of your project, however, it will be
necessary to receive City permits where required for any construction not yet begun. This
will include permits for site development as well as building construction.
On November 20, 2002, we confirmed the presence of eight(8) structures that appeared
to be associated with your development. Since there have been no plans submitted, it is
difficult to determine which phase(s) are complete with these eight buildings. You will be
allowed to construct any future phases for which you have prior approvals from the
County, but you will need to submit plans and comply with City of College Station codes
and ordinances or receive variances where appropriate.

The zoning on the property is now A-O (Agricultural Open). Therefore, the use of the
property as a storage and office warehouse facility is considered non-conforming. Once
your project is complete as per any prior approvals and applicable City permits, any
expansions or modifications may require a rezoning to an appropriate district or perhaps
consideration by the Zoning Board of Adjustment or the Construction Board of
Adjustments and Appeals. Please call in the future if you desire to develop plans for
expansion or modification.
In the meantime, you must submit plans for the next phases that will be constructed as
well as plans and prior approvals for the existing eight buildings. The City will review
these plans and help you proceed with the completion of your project.
