Good Morning Mike,
I have clarifications on the two main issues we discussed on Monday with
Steve, and in our follow up phone conversation.
We believe that we can handle the park dedication as a minor plat with Staff
approval. Because the agreement to delay the dedication to this point, and the
allowance that the park was not included in any of the 4 approved plats to date
was a non-standard agreement, we anticipate a lengthy process of gaining the
separate instrument approval through our Legal Department. The choice of
methods is yours, however we feel the plat would be most time and cost
effective. The dedication (by either means) will have to be filed prior to the filing
of the plats for the remaining phases.
I discussed the emergency access issue for full building permits with several
stakeholders here, and have come to understand that what I advised you
Monday was not correct. Based on a recent revision to the Fire Code, the
roadways required to be provided for residential access by the Subdivision
Ordinance must be "completed, accepted and in service" prior to a permit
allowing combustibles. Therefore the roads included in the infrastructure plans
will have to be constructed and accepted, not just bonded.
I have attached a summary of the access issue that I was provided while I was
researching this issue.
After you have had a chance to review this information and assess the impacts
on your clients projects, please let me know if you have additional comments,
concerns or questions.

Ok, this is a plat that does not require P&Z approval. Instead,we'll make the tax info. part of the staff
approval. 1t will also help to have it listed in the letter of acceptance itself.
Steve &Ric, could you please provide us with a letter of acceptance for the park, with the tax conditions
along with an effective date? It would really help us if you could leave the effective date blank that we
could fill in the day we record the plat at the court house. We'll work with Steve Arden on the effective
date to make sure we get the taxes paid prior to acceptance&filing.
I'm not sure how this could get anymore complicated; but, I'm confident we'll find a way!

Natalie-This is how this issue can be handled: If you know the date of transfer, your department can
estimate the pro rata taxes that will need to be paid by Mr. Arden. He can then do as he suggests and
pay that amount to the tax assessor to be held in escrow. He will need to get a tax certificate from the
assessor certifying that the taxes are paid through the date of transfer. However,when the property is
valued by the tax appraiser in July,there is a possibility that the tax rate may change or that the property
valuation will change,thus changing the amount of taxes due. Therefore, I suggest that the city's
acceptance of the dedication be conditioned upon all actual taxes finally assessed on the property be
remitted by December 31, 2003, by Arden. When the plat with the dedication goes to P&Z, the staff
report can include this condition in the staff comments. P&Z then can approve the plat with the staff
comments. Following approval, a letter of acceptance should be prepared for Mr.Arden's signature
expressly setting out the conditional acceptance of the dedication. Let me know if you have any

Natalie,
Jimmy Kurten at the appraisal office has provided the 2003 estimated taxes
for the 7.534 acre park of$2,020.85. This amount includes City, school, and
County taxes.
If you know the date of transfer and can pro-rate the taxes for the year, I
will bring a check payable to the County Tax Office. The have a provision to
escrow taxes paid early.
