MEMORANDUM April 9, 2003 TO: Planning and Zoning Commission FROM: Spencer Thompson, Development Services Engineering Email: sthompson@ci.college-station.tx.us SUBJECT: PRELIMINARY PLAT for GATEWAY SUBDIVISION PHASE 2-4 Item: Discussion and possible action on a Preliminary Plat for Gateway Subdivision Phase 2-4. (03-00500069) This item was tabled at the 4/03/03 Planning and Zoning meeting. Further information to be presented by staff and applicant. Attachments: 1. Area map 2. Staff Report from previous meeting STAFF REPORT Project Manager: Spencer Thompson Date: March 25, 2003 Email: sthompson@ci.college-station.tx.us Item: Consideration, discussion, and possible action on a Preliminary Plat for the Gateway Subdivision Phase 2-4 located at 1401 University Drive East (03-00500069) Applicant: DWS Development Inc., Owner Staff Recommendations: Staff recommends approval of the Preliminary Plat with the condition that the attached Staff Review Comments #2 be addressed. Item Summary: This item is for the consideration of a Preliminary Plat for Gateway Phase 2-4 consists of 3 lots. Phase 3 along University Drive is currently zoned C-B/OV and Phases 2 and 4 are zoned R-5. Phase 2 is proposed to be a condominium development at this time. This property is adjacent to the Home Depot under construction at this time. A 60-ft, private access easement is shown on Phase 3 to extend access to Phases 2 and 4. The Applicant wishes to reduce the easement to 40-ft. According to the traffic study generated for the Gateway Subdivision as required by TxDOT for the signalization of the intersection at Forest and University Drive, the subject property requires a major collector section to the accessway into Gateway Phase 1. A major collector requires a 54-ft pavement section. The traffic report shows that the pavement section can be reduced to a minor collector thereafter to serve the multi-family area to the rear. A minor collector is a 38-ft pavement section. These pavement sections do not include sidewalk access to the residential property. A signal is in the process of being designed for this intersection. Staff is working with the Applicant and all parties concerned to obtain a functional intersection design for this site. A driveway "curb-cut" was provided to the subject property by TxDOT during the recent University Drive project in order to provide access to an existing oil well. According to the rezoning ordinance, when the property develops only one drive will allowed. However, it is Staff's understanding that the oil well entrance can remain and continue to serve the well but must close once to ceases to function as such. In other words, it can not be used for anything other than an oil well service access. The subject property is traversed by a tributary of Burton Creek. A LOMR is being reviewed by FEMA at this time to establish the boundaries of the floodplain and floodway. This information is shown on the plat. A CLOMR was approved by FEMA to allow for a bridge structure crossing the creek to Phase 4. This structure is shown on the plat. Required minimum finished floor elevations are shown on the plat. Several conditions were applied to the subject property at the time of rezoning(s). The following is a list of the zoning ordinances and requirements: Ordinance No. 2239 Date: 3/27/97 Tract: Phase 3 • Limited access to University drive to one drive • Provide cross access to the R-5 tract and adjacent tract; University Park II Tract "Y" • Provide sewer impact study • Install 100-ft landscape buffer between the C-B and adjacent R-5 tract. Ordinance No. 2119 Date: 4/13/95 Tract: Phase 2,3,4 (and a portion of 1) • One access to University Drive • Cross access within development • Provide sewer impact study • Conduct a tree survey to preserve native trees Comprehensive Plan Considerations: Land Use Plan: LUP shows this area as Greenways and Mixed-use. Thoroughfare Plan: University Drive is a Major Arterial. Parkland Dedication: The recommendation from Parks, due to the size of the development. is for a fee in lieu of land dedication. Open Space Dedication: None at this time Special Area Plans: A portion of the subject property is located in the University Drive Overlay District as shown on the Area Map. Sidewalks: Staff is requiring sidewalks from University Drive to the R-5 tracts. Compliance with rezoning conditions: Most of these requirements are to be implemented at the Site Plan stage. Greenways: Greenway shown on plat. Some fill of floodplain is planned. Access/Cross Access/Driveway Compliance: One proposed drive shown on plat. Cross access to Phase 1 and R-5 area. Note 7 addresses access from Phase 3 to Tract "Y". The actual location may be determined with a site plan. Platted: A Final Plat for Phase 3 was previously approved for Extended Stay. The plat was never filed. Budgetary & Financial Summary: None at this time. Commission Action Options: The Commission has final authority over the plat. Copy of Preliminary Plat 5. Staff Review Comments #2 INFRASTRUCTURE AND FACILITIES Water required for plat: A water main is being constructed for Gateway Phase 1 that would serve Phase 2. If, at the time of Final Plat this water line is in place, extension of the water to Phase 2 would not be required. Extension of water is required to Phase 4. Water shown on Preliminary Plat differs from approved construction documents. Construction plans showing the changes will be required. Water Service: Service to be provided to individual structures from water mains as needed. Sewer required for plat: Sewer is available to all tracts. Sewer Service: Service to be provided to individual structures from sewer mains as needed. Street(s) required for plat: A street is required from University Drive to Phases 2 and 4. The street is proposed to be private. See ordinance reference below. Streets/Access: Access to University to be allowed 1 curb-cut per zoning ordinance. Off-site Easements required for plat: Access easement to Phase 2 appears to cross Gateway Phase 1. This easement needs to accommodate Phase 4, as well. Drainage: The Burton Creek drainage area is a "mandatory detention" area per the Drainage Policy and Design Standards. The Preliminary Plat proposes joint detention with Gateway Phase 1. The Applicant will need to address permission and capacity issues. Flood Plain: This tributary of Burton Creek is in the process of a LOMR with FEMA. The Applicant has depicted the floodplain as shown in the LOMR application. Parkland Dedication Fees: Park Staff has recommended a fee in lieu of land dedication. The development will owe $452 per dwelling unit at the time of building permit. CITY ZONING ORDINANCE § 8.6 STRUCTURES TO HAVE ACCESS Every building hereafter erected or moved shall be on a lot or building plot with direct access on a public street, or with access to an approved private street. All structures shall be so located on lots or building plots as to provide safe and convenient access for servicing, fire protection, and the required on-site parking.
