Commission with all pertinent facts of a development case, but that staff is not acting as an
advocate for the applicants. Therefore, it is in the applicant's best interest to send a
representative to the Planning & Zoning Commission meeting to speak on behalf of the

SUBJECT: Variance Request and Preliminary Plat for Peach Crossing
Item: Public hearing, discussion, and possible action on a Variance Request;
and consideration, discussion, and possible action on a Preliminary Plat for
Peach Crossing Subdivision consisting of 48 residential lots and a reserve tract
on 89.99 acres located at the intersection of Peach Creek Road and Peach
Creek Cut-Off in the City's ETJ. (03-00500088)
Applicant: Mark Homeyer, owner
Staff Recommendations: Staff recommends approval of the Preliminary Plat
contingent on approval of the Variance Request and with attached Staff Review
Comments.
Item Summary: This item is for the consideration of a Preliminary Plat for 89.99
acres in the City's ETJ. The front 60.41 acres is being platted as 48 residential
lots with the remaining 28.58 acres left as a reserve tract. The property is
located east of the Speedway on Peach Creek Road, at its intersection with
Peach Creek Cut-Off. Approval of this Preliminary Plat requires prior approval of
a variance to the lot width requirement.
The City's Subdivision Regulations, 13-C, require a minimum 100-ft width for lots
in the ETJ. Lots 8 and 9 of Block 5, Lots 6 and 7 of Block 1, and Lots 4 and 6 of
Block 3, all of which are located at the end of culdesacs, are less than 100 feet in
width. These lots do; however, meet the County minimum lot width of 70 feet.
The following is excerpted from the Subdivision Regulations regarding Variance
Requests:
SECTION 5: VARIANCES
5-A The Commission may authorize a variance from the regulation when, in their
opinion, undue hardship will result from requiring strict compliance. In granting a
variance, the Commission shall prescribe only conditions that it deems not prej-
udicial to the public interest. In making the findings hereinbefore required, the
Commission shall take into account the nature of the proposed use of the land
involved, the existing use of land in the vicinity, the number of persons who will
reside or work in the proposed subdivision, the possibility that a nuisance will be
created, and the probable effect of such variance upon traffic conditions and
upon public health, convenience, and welfare of the vicinity. No variance shall
be granted unless the Commission finds:
5-A.1 That there are special circumstances or conditions affecting the land
involved such that strict application of the provisions of this chapter will
deprive the applicant of the reasonable use of his land;
5-A.2 That the variance is necessary for the presentation and enjoyment of a
substantial property right of the applicant;
5-A.3 That theranting of the variance will not be detrimental to the public
health, safety, or welfare, or injurious to other property in the area, or to
the City in administering this chapter; and
5-A.4 That the granting of the variance will not have the effect of preventing the
orderly subdivision of other land in the area in accordance with the provi-
sions of this chapter.
