You can only change the thoroughfare plan by ordinance amendment. 2. If Mr. Seaback has filed an application for a plat then he has vested his right to the thoroughfare plan as it exists. if he has never filed any application for plat and just sold this property by metes and bounds then he has no vested right to any alignment. No, the city is not tied to this final alignment because the property was not platted. You are correct. >>> Ken Fogle 01/17/03 11:28AM >>> Roxanne, We are preparing to change the alignment of Victoria Drive on the thoroughfare plan between Barron Road and SH 40. The parcel of land that Victoria bisects was originally owned by Gary Seaback. When Mr. Seaback sold College Station ISD part of this parcel for the new proposed high school, they tied the eastern boundary line of the school's property to the centerline of the proposed Victoria right-of-way in the warranty deed. They call out bearings and distances for this alignment. This property is unplatted. Furthermore, they tie down an easement to east right-of-way line of the proposed Victoria right-of-way with bearings and distances. Once again this property is unplatted. Mr. Seaback believes that the Victoria alignment is tied down as described in this warranty deed, even though the property was never final platted. I don't believe that this city is tied to a proposed alignment. What do you think? Ken P.S. If you'd like to take a look at the warranty deed, I'll deliver it to you.
