Applicant: Michael Baty for T- Mobile
Staff Recommendation: Staff recommends approval of the cell tower and site
plan with the conditions that the facility be limited to 100 feet in height and
landscaping be provided.
Item Summary: The applicant is requesting a conditional use permit and site
plan approval for a new 120 -ft. cell tower to be located behind Varsity Ford, at
the end of Associates Drive. The lease space is in a tract of land zoned C -2
Commercial - Industrial. Undeveloped R -1 Single Family Residential abuts the
property to the north and developed C -1 General Commercial abuts the property
to the west and south. To the east is platted C -1.
The tower meets the separation requirements from an R -1 district and from other
towers. As Associates is not a minor arterial or greater, the tower is not required
to meet the separation distance from a thoroughfare. The City Council has
made its intentions clear to staff by asking for a new ordinance that will limit
tower heights in the city to 100 feet. This ordinance has not yet been adopted,
but staff has considered the direction City Council has given in making the
recommendation that the tower be limited to 100 feet. The tower would meet all
separation requirements if it were 120 or 100 feet tall.
The proposed tower would be 120 feet from the end of Associates, which is a
public right -of -way. Ken Fogle, Transportation Planner, has estimated that 35%
of Sams and Hollywood 16 traffic use Associates for access, so approximately
2,900 trips are generated on Associates each weekday and 5,500 trips per day
are made on the weekend. Staff recommends that landscaping be required with
the fencing to mitigate negative visual impacts from the right -of -way.
Comprehensive Plan Considerations: The Land Use Plan designates the area
as Retail Regional. Associates Drive is a local street with no plans for extension.

not platted, but will have to complete the platting process before development
may occur.

Staff Recommendations: Staff recommends approval of the 120 -ft. cell tower
and site plan with the condition that landscaping be provided.
Item Summary: This item was tabled at the February 20, 2003 Planning and
Zoning Commission meeting so consultant recommendations on allowable tower
height and a new Wireless Telecommunication Facility ordinance could be
considered by the City Council. The consultants have recommended that the
maximum tower height remain at 150 feet. The City Council will consider the
new WTF ordinance at their May 8 meeting, and the outcome of that action will
be discussed with the P &Z at the May 15 meeting.

below), the Commission shall consider the following additional factors when
determining whether to recommend a CUP for a telecommunication facility:
1. Height of the proposed tower, surrounding topography and tree coverage and
foliage as they relate to:
a. Skyline impact, examining whether the proportions of the structure
appears to dominate or blend in with the surrounding environment and
b. Shadow impact, whether or not the proposed tower will cast shadows that
would prevent the reasonable use of enjoyment or surrounding properties.
2. Design of the tower, with particular reference to design characteristics that
have the effect of reducing or eliminating visual obtrusiveness.
3. Proximity of the tower to residential structures and residential district
boundaries.
4. Economic impact on adjacent and nearby properties.
5. Proposed ingress and egress.
6. Availability of suitable alternatives and /or existing support structures.
Staff Analysis: Section 14 of the Zoning Ordinance authorizes the existence of
conditional uses. The Commission may recommend approval of a conditional use
subject to appropriate conditions and safeguards, when after public notice and
hearing the Commission finds that: (Staff comments are in italics)
1. "The proposed use meets all the minimum standards established in the
ordinance for the type of use proposed." Staff conducted a technical review
and found general compliance with development regulations with the
exception of the items listed above in the staff recommendation.
2. "That the proposed use meets the purposed and intent of the ordinance and
is in harmony with the development policies and goals and objectives as
embodied in the Comprehensive Plan for Development of the City. The
request is in compliance with the Comprehensive Plan.
3. "That the proposed use will not be detrimental to the health, welfare, and
safety of the surrounding neighborhood or its occupants, nor be substantially
or permanently injurious to neighboring property." The public hearing is an
opportunity for the Commission to measure the potential impact on
surrounding land uses.
The Commission may impose additional reasonable restrictions or conditions to
carry out the spirit and intent of the ordinance and to mitigate adverse effects of
the proposed use. These requirements may include, but are not limited to,
increased open space, loading and parking requirements, additional landscaping,
and additional improvements such as curbing, sidewalks and screening."
