(DCE) performed a Phase I Environmental Site Assessment (ESA) for a 75 -foot by 75 -foot tract of land located at 1351 Earl Rudder Freeway South (Highway 6) in College Station, Brazos County, Texas. Our scope of services was performed in accordance with a verbal proposal. The attached report has been prepared using American Society of Testing and Materials (ASTM) E 1527 -00; Environmental Site Assessments: Phase I Environmental Site Assessment Process as a guide. This work is based on a review of specified and reasonably obtainable listings and on a site visit to identify "recognized environmental conditions ". We observed the standard of care generally exercised by the profession under similar circumstances and conditions to complete this Phase I ESA. This Phase I ESA did not include any inquiry with respect to asbestos, radon, methane, lead - based paint, lead in drinking water, formaldehyde, subsurface investigation activities, or other • services, potential conditions, or features not specifically identified and discussed herein. The 75 -foot by 75 -foot tract of land, herein referred to as the "site ", is located at 1351 Earl Rudder Freeway South in College Station, Brazos County, Texas. The scope of work performed, objectives, extent and limitations of the services are described in more detail in the text of the report. In summary, our findings are: • On the basis of our review of historical information, the site has never been developed. • DCE reviewed selected federal and state environmental regulatory lists. We did not identify facilities with environmental concerns that would likely adversely impact the site • No potential environmental conditions were noted based on the site reconnaissance conducted September 6, 2002. Based on the available data, this assessment revealed no evidence of recognized environmental conditions associated with the property. No further assessment is recommended. Project N° 202H1377 J /� Drash 7 Consulting ` �� Engineers, Inc, INTRODUCTION AND SCOPE OF SERVICE In general accordance with Professional Services Agreement with T- Mobile (VoiceStream), Houston, Inc dated July 9, 2002, DCE performed a Phase I Environmental Site Assessment (ESA) at 1351 Earl Rudder Freeway South in College Station, Brazos County, Texas, herein referred to as "site ", for T- Mobile. A Vicinity Map (Figure 1), Site Layout (Figure 2), Topographic Map (Figure 3), and Historical Topographic Map (Figure 4) are provided at the end of this report. A Site Report submitted to DCE is included in the appendices of this report. SITE DESCRIPTION Physical Setting Information • Site Description: The site is located at 1351 Earl Rudder Freeway in College Station, Brazos County, Texas. The site is located in a commercial area behind Hollywood Cinema and is currently undeveloped land. The proposed tower site will contain a 115 - foot monopole tower and associated prefabricated equipment building. • Topography: The site is located approximately 255 feet above mean sea level according to the Bryan East, Texas 7.5 minute USGS Topographic Quadrangle Map, 1962, photorevised 1982. The general direction of area runoff drainage appears to be to the northwest towards Carters Creek. • Soil Conditions: According to the Natural Resources Conservation Service, Soil Survey Division, the Brazos County Soil Survey Book is currently out of print. • Site Geology: The site is located on the Yegua Formation according to the Geologic Atlas of Texas, Austin Sheet, 1974, published by the University of Texas at Austin, Bureau of Economic Geology. This Tertiary -aged formation consists mostly of c sandstone, clay, and lignite. Lentils of lignite, flat ironstone concretions, and spherical calcareous concretions are common. • Regional Groundwater Conditions: The site is not located over a sole source aquifer according to the EPA Region VI, Sole Source Aquifer Office, Dallas, Texas. • Floodplain Information: The site is designated Zone X according to the FEMA National Flood Insurance Program Flood Insurance Rate Map, Panel 142 of 250, for Brazos County, Texas and Incorporated Areas, Community Panel Number 48041C0142 C, effective July 2, 1992. Zone X is determined to be an area of outside the 500 -year floodplain. According to Mr. Phil Kirk, the Secretary Treasurer for Varsity Ford Lincoln Mercury, the site was previously a floodplain area. Based on the current floodplain information, the site is not located in a floodplain. Project N 202111377 7 P brash age Consulting 1 of 12 Engineers, Inc. SITE RECONNAISSANCE The objective of the site reconnaissance is to obtain information indicating the likelihood of identifying American Society of Testing and Materials (ASTM) recognized environmental conditions in connection with the site to the extent not obstructed by bodies of water, adjacent buildings, or other obstacles. The site and adjoining properties were visually observed on September 6, 2002. The purpose of the reconnaissance was to note visual or olfactory evidence of recognized environmental conditions. Additionally, reconnaissance of the adjoining properties was performed to identify land use and the associated potential for producing recognized environmental conditions. Selected photographs taken during the site reconnaissance and a Field Inspection Report are provided in the appendices. Site Observations: The site is located at 1351 Earl Rudder Freeway in College Station, Brazos County, Texas. The site is located in a commercial area and is owned by Varsity Ford Lincoln Mercury. Site Vicinity: Reconnaissance of adjacent and nearby properties was performed by observing land use from legal boundaries or by walking upon the properties that were legally accessible. Development adjacent to and near the site is as follows: • To the north are Carters Creek and undeveloped land. • To the east are Carters Creek and undeveloped land. • To the south are Associates Road, Hollywood Cinema, and Sams Club. Further south is a closed lumberyard, Harvey Road/Hi wa 30, and a Chevron filling rY � Y � Y g station. The Chevron is a new facility and is not listed on the regulatory review. • To the west are Varsity Ford Lincoln Mercury and Highway 6. To the northwest is Douglass Nissan. Varsity Ford is listed as a RCRA facility and has no violations. Douglass Nissan is a PST facility and is not listed as an LPST site. Other observations noted while at the site include the following: • No evidence of sewage disposal or septic systems was observed on the site. • No hazardous substances or petroleum products were observed on the site. • No evidence of underground storage tanks and associated equipment (e.g. fill caps or pipes) was observed on the site. Project N 202111377 J/• Drash Page 2 of 12 7 Consulting ` �� Engineers, Inc. • No odors suggesting a release of hazardous substances were observed on the site. • No surficial staining, corrosion, or stressed vegetation were observed on the site. • No electrical transformers were observed on the site. • No heating, ventilation, or air conditioning systems were observed on the site. • No drains or sumps were observed on the site. • No pits, ponds, or lagoons were observed on the site. • No utility easements were observed on the site. • No evidence of wastewater discharges was observed on the site. The Field Inspection Report is included in the appendices of this report. n RECORDS REVIEW Historical information regarding prior use of the site and adjoining properties was obtained from reviewing reasonably obtainable historical records such as a chain -of- title, city directories, Sanborn Fire Insurance Maps, historical topographic maps, aerial photographs, and additional sources listed below. Historic Interviews: Mr. Phil Kirk, the Secretary Treasurer for Varsity Ford Lincoln Mercury, was interviewed in regards to potential environmental concerns associated with the site Mr. Kirk stated that he has been associated with the site for approximately two years and with the surrounding property for approximately nine years. Mr. Kirk stated that the site has always been undeveloped land and was previously a floodplain area He was not aware of any landfills at the site or surrounding property. The site is located on property owned by Varsity Ford Lincoln Mercury. Mr. Kirk stated that approximately three ASTs are located on the west side of the Varsity Ford Lincoln Mercury dealership. He also stated that the ASTs contain used motor oil. He was not aware of any leaks or spills associated with the ASTs. Mr. Kirk was not aware of any environmental concerns associated with the site. A copy of the. interview can be found in the appendices of this report. Chain - Title: T- Mobile did not request a chain -of title for the site. Project •° 202111377 J /`i Drash Page 3 of 12 Consulting ` �� Engineers, Inc City Directories: City directories are published for urban areas and provide listings of residents, businesses, and professional concerns. They are indexed alphabetically by property owner /occupant and by street name by address. When reviewed, the listings may identify names of facilities that can suggest use, generation, storage, treatment or disposal of potentially hazardous materials or petroleum products. • The area surrounding the site was recently developed therefore, city directories were not reviewed. Sanborn Fire Insurance Maps: Sanborn Fire Insurance Maps are typically published for pre -1960 central business districts. In the late nineteenth century, the Sanborn Company began preparing maps for use by fire insurance companies. These maps were updated periodically and expanded geographically through the twentieth century. They indicate materials used in construction of specific structures in urban areas. With the advent of retail gasoline service stations, the approximate locations of tanks were noted, but often without AST or UST designations. The Sanborn review consisted of the following: • Sanborn Fire Insurance Maps are not published for the site area. Historical Topographic Map Review: A reasonably available historical topographic map depicting development of the site and surrounding areas were reviewed and summarized below. A copy of the historical topographic map is provided in the appendices. North of the site is Carters Creek, a pipeline, and undeveloped land. South of the site is Highway 30. To the southeast are College Station, a pipeline, and undeveloped land. To the west is a sewage disposal facility. Topographic Map Review: A topographic map depicting development of the site and surrounding areas was reviewed and summarized below. Highway 6 is present to the south. A large manmade pond is present to the north. College Station has expanded to the north and east. The pipeline remains present to the southeast. No environmental concerns were observed from review of the topographic maps. No leaks are known to have occurred with the pipeline. Aerial Photograph Review: Reasonably available aerial photographs depicting development of the site and vicinity at periodic intervals were reviewed, as summarized below. The information obtained from the evaluation of aerial photographs depends upon their scale and quality. Copies of noteworthy aerials are provided in the appendices. North of the site is Carters Creek and undeveloped land. To the east are a small pond, undeveloped land, and Highway 30. West of the site is a residential area. 1974 Texas Department of Transportation Scale: 1 inch = 700 feet The site remains undeveloped land. To the north is a pond. Highway 6 is now present to the southeast. Apartment complexes are located just northwest of the Highway 6 and Harvey Road intersection. Residential growth has occurred to the east. 1984 Texas Department of Transportation Scale: 1 inch = 700 feet The site remains unchanged from the 1974 photo. To the south are a lumberyard and a new residential development. To the southwest is Post Oak Mall. 1996 United Geological Survey Scale: 1 inch = 700 feet The site remains undeveloped land. To the south is Associates Road and Hollywood Cinema. South of Hollywood Cinema is Sams Club and a lumberyard. Land clearing appears to have occurred north of Carters Creek. REGULATORY REVIEW The purpose of the record review is to obtain and examine reasonably obtainable records to help identify recognized environmental conditions in connection with the site. For this review, records were obtained from GeoSearch, Inc. As noted under ASTM, information requested and not received within 20 days will not be incorporated into this report. The approximate maximum search distance (MSD) radius for the site vicinity review is noted under each database listed below. The distance from the site to the listed facility represents the approximate distances from the center of the site to the identified facility addresses and may not represent the actual distance from the boundary of the site to the boundary of the listed facility. Regulatory data for facilities with recognized environmental conditions are provided in the appendices of this report. The Definitions and Acronyms section of this report defines the abbreviations used, as well as provides additional details concerning the review. A summary of the federal and state databases searched is provided below. • Federal NPL (MSD = 1.0 mile): The National Priorities List (NPL) was reviewed to identify facilities that the United States Environmental Protection Agency (EPA) considers to present the greatest risk to human health and the environment. No NPL facilities were identified within the search radius. • Federal RCRA COR (MSD = 1.0 mile): The EPA maintains a database of Resource Conservation and Recovery Act (RCRA) facilities that are undergoing "corrective action ". A Corrective Action Order (CORRACTS) is issued when there has been a release of hazardous waste or constituents into the environment from a RCRA facility. No RCRA COR facilities were identified within the search radius. • State Site (MSD = 1.0 mile): The State Priority List (SPL) and State Cleanup List (SCL) provide information regarding facilities within the state that are identified as hazardous and potentially requiring cleanup. The SPL also identifies State Voluntary Cleanup Program (VCP) facilities. By allowing any facility in Texas to enter the program, the VCP encourages remediation of contaminated property. No State Site facilities were identified within the search radius. • Federal CERCLIS/NFRAP (MSD = 0.5 mile): The Comprehensive Environmental Response, Compensation, and Liability Information System (CERCLIS) and the No Further Remedial Action Planned ( NFRAP) databases are maintained by the EPA. CERCLIS contains facilities that are either proposed to be placed, or are currently on the NPL and facilities that are in the screening and assessment phase for possible inclusion on the NPL. NFRAP includes facilities where, following an initial investigation, no contamination was found, contamination was quickly removed, or the contamination does not require further NPL consideration as determined by the EPA. No CERCLIS/NFRAP sites were identified within the search radius. RCRA -TSD facilities treat, store, and/or dispose of (TSD) hazardous waste. No RCRA -TSD facility was identified within the search radius. No RCRA -TSD facilities were identified within the search radius. • State LPST (MSD = 0.5 mile): The Texas Commission on Environmental Quality (TCEQ) Petroleum Storage Tank Division maintains a database of Leaking Petroleum Storage Tank (LPST) facilities. No LPST facilities were identified within the search radius. • State SWL (MSD = 0.5 mile): The TCEQ Municipal Solid Waste Division maintains a database of permitted Solid Waste Landfills (SWL), incinerators, or transfer stations. No SWL facilities were identified within the search radius. `'° • Federal TRIS ( MSD = 0.25 mile): The EPA established the Toxic Release Inventory System (TRIS) which includes annual reporting of facilities that manufacture, process, ii or import toxic chemicals in quantities exceeding 25,000 pounds annually as required by the Superfund Amendments Reauthorization Act (SARA) Title III. No TRIS facilities were identified within the search radius. • State UST /AST (M SD = 0.25 mile): The TCEQ provides the Petroleum Storage Tank tank Database and the Aboveground Storage Tank Database for underground storage (UST) and aboveground the storage tank (AST) facilities. Two UST /AST facilities were identified within search radius. He also stated that the ASTs contain used motor oil. He was not aware of any leaks or spills associated with the ASTs. The ASTs were not listed on the regulatory report. Inclusion on the UST /AST registry does not necessarily imply that an environmental release /problem exists at the facility. By statute, owners of UST /AST systems must register the system with the TCEQ. These facilities are not listed as LPST sites and therefore, these facilities are not considered a recognized environmental concern to the site at this time. • Federal ERNS (MSD = 0.125 mile): The Emergency Response Notification System (ERNS) is an EPA database used to collect information on reported releases of oil and hazardous substances. No ERNS facilities were reported within the search radius. • Federal RCRA GEN (MSD = 0.125 mile): This EPA, database identifies RCRA facilities that are generators of hazardous waste. Inclusion on the RCRA GEN registry does not necessarily imply that an environmental release /problem exists at the facility. One RCRA GEN facility was located within the search radius. This facility was identified as Varsity Ford Lincoln Mercury located at 1351 East Bypass in College Station, Texas. Varsity Ford Lincoln Mercury is a small quantity generator. This facility has encountered no violations and therefore is not a concern to the site at this time. A copy of the Site Regulatory Assessment Report is included in the appendices of this report. Interviews With Regulatory Agencies. Mr. Ron Bird with the TCEQ, Region 9 in Waco, was interviewed in regards to potential environmental concerns associated with the site and surrounding area Mr. Bird stated that he was not familiar with the College Station area He recommended that we obtain a file review from the Austin location. He stated that the file room in Austin has all non - working files. The South Brazos Fire Department was contacted in regards to possible hazardous material spills or other environmental concerns associated with the site. The firefighter stated that the only person that would have information regarding hazardous material responses would be the dispatcher. He also stated that the dispatcher only takes emergency calls. The approximate maximum search distance used for each database is noted. The distance from the site to the listed facility represents the distance from the center of the site to the facility's address and may not represent the actual distance from property boundary to property boundary. OBJECTIVES AND LIMITATIONS OF ASSESSMENT DCE has endeavored to meet what it believes is the standard of care for the services performed and, in doing so, is obliged to advise T- Mobile of ESA limitations. DCE believes that providing information about limitations is essential to help T- Mobile identify and thereby manage risks. These risks can be mitigated, but not eliminated, through additional research. DCE will, upon request, advise T- Mobile of the additional research opportunities available and the associated costs. ' This report is an instrument of service of DCE and includes limited research, a review of specified and reasonably ascertainable listings and a site reconnaissance to identify "recognized environmental conditions" using the ASTME 1527 Environmental Site Assessments: Phase I Environmental Site Assessment Process as a guide. "Recognized environmental conditions" are defined by the ASTM as "the presence or likely presence of any hazardous substances or petroleum products on a site under conditions that indicate an existing release, a past release, or a material threat of release of any hazardous substances or petroleum products into structures on the property or into the ground, groundwater or surface water of the property." The ESA was performed in accordance with generally accepted practices of the profession undertaken in similar studies at the same time and in the same geographical area. DCE has observed a standard of care generally exercised by the profession under similar circumstances and conditions. The study and report have been prepared on behalf of and for the exclusive use of T- Mobile solely for its use and reliance in the environmental assessment of this site. T- Mobile is the only -' ' party to which DCE has explained the risks involved and which has been involved in the shaping of the scope of services needed to satisfactorily manage those risks, if any, from T- Mobile point of view. Accordingly, reliance on this report by any other party may involve assumptions whose extent and nature lead to a distorted meaning and impact of the findings and opinions related herein. DCE's findings and opinions related in this report may not be relied upon by any party except T- Mobile. With the consent of T- Mobile and DCE, we may be available to contract with other parties to develop findings and opinions that relate specifically to such other parties' unique risk management concerns related to the site. This ESA did not include any inquiry with respect to asbestos, radon, methane, lead based paint, lead in drinking water, formaldehyde, endangered species, wetlands, subsurface investigation activities or other services or potential conditions or features not specifically identified and discussed herein. In those instances where additional services or service enhancements are included in the report as requested or authorized by the T- Mobile, specific limitations attendant to those services are presented in the text of the report. The findings and opinions presented in this Phase I ESA report are based upon information obtained on a particular date from a variety of sources enumerated herein, and which our firm believes are reliable. Certain indicators of the presence of hazardous materials may have been latent or not present at the time of the most recent site reconnaissance and may have subsequently become observable. The purpose of this section is to establish clear regulations pertaining to wireless telecommunications facilities that are consistent with federal and state law. The City Council of the City of College Station finds that: It is in the public interest to promote' competition in high quality teleconunuriications conunu services nityl and and the ava , promote orde off broadband u transaussion d eve servi ces rnent to and all preserve residenc es histo an ric d bus . It i in the ppuublic interest for the City to protect the public safety and welfare, safeguard nnin sites, stru areas. Wireless telecommunications facilities should not be allowed to detract aesthe from the visual quality of surrounding properties or the City. The proliferation of wireless telecommunications facilities negatively mpacts the appearance and character of the community. Therefore the City should endeavor to minimize the size, number and obtrusiveness of antennas and towers. Collocation and stealth technologies are strongly encouraged to mitigate negative visual im.pacts and reduce the total number of towers within the City, ''' B. WTF USE CATEGORIES: In order to expedite the siting and review process, WTF's have been divided into use categories. The review process is more thorough as the intensity of the use increases. 1. UNREGULATED FACILITIES: The WTF's Listed below are not regulated by this ordinance and do not require review or approval. This does not exempt these facilities from other applicable city codes, ordinances, and permits. a. Direct-to-home service antenna, citizen's radio band antenna, amateur radio • antennas. b. Parabolic antenna less than 2 meters in diameter. c. Omni - directional antenna (whip antenna) 6" or less in diameter and not extending more than 12' above support structure. d. Directional antenna 1 meter or less measured across the longest dimension and not extending over 12' above support structure. e. public safety tower or antenna. 2. ThrIERMEDIATE FACILITIES: a. New transmission tower Less than 35 feet (10.5 meters) hi height. • b. Parabolic antenna over 2 meters in diameter. c. PROXIMITY TO MAJOR THOROUGHFARES: To ppreserve and protect the City's a m or thoroughfares and entrances to the City, additional setbacks are placed on ; WTF s, proposed to be placed near these areas. The setback for these areas is ri detcrnnned by measunng from the centerline of the right -of -way of the thoroughfare. Applicable, thoroughfares include freeways and expressways, major arterials and minor arterials, as shown on the Thoroughfare Plan. ;, a. Intermediate WTF's must be 150' from applicable thoroughfares. . b. Major WTF's must setback from applicable thoroughfares by the height of the tower x3. 4. SEPARATION BETWEEN TOWERS: Tri order to prevent tower prroliferation and protect the City's natural beauty and skyline, the number of transmission towers per square mile has been limited. new transmission towers must be placed a minimum ,,: distance from existing towers as described here: a. New transmission towers 100 feet or more in height shall be separated from existing towers by a minimum distance of 3500 ft. 5. FIGHT (IMITATIONS: All WTF's arc subject to the normal height restrictions for each zoning district where permitted by, right, In any zoning district where a tower is a conditional use, the allowable height is determined through the review of the visual impact analysis. In no case shall a proposed transmission tower exceed 150' within the city limits, except where a he variance is granted by the Zoning Board of Adjustments to allow a tower or antenna that demonstrates a hardship that can only be remedied by locating on a proposed site within the city.limits. 6. LANDSCAPING SCREENING AND AESTHETIC STANDARDS: The following requirements shall govern any transmission tower or any parabolic antenna larger than 2 meters. a. SPECIAL DISTRICTS AND OVERLAY DISTRICTS: Special districts have been established in ,tlye City for the purpose of nrotecting their h>storic.al significance and aesthetic quahttes. n some cases, WTP' s • are allowed in these areas with the following restrictions. STEALTH TECHNOLOGY DRSION: Any, WTF with appropriate stealth technology design approved by the Planning & Zoning Commission may be located in any zoning district, Approved WTF s do not have to meet the additional setbacks for tower separation (section C.4) or thoroughfares (section C.3). 9. ATTACID WTF'S: WTF's may attach to the exterior of any non - residential and non- histonc building within any, zoning district provided the antenna and antenna support structure or equipment is mounted flush with the vertical exterior of the braiding or projects no more,thae 24 inches from the surface of the building to which it is attached and does not raise the height of the building more than 10 feet and does not violate the maximum height restriction of that zoning district.
