Glover 822 Nimitz Street College Station, TX 77840 VIA HAND DELIVERY February 17, 2003 TO: Leslie Hill Chairman, Zoning Board of Adjustments City of College Station 1101 Texas Ave., South College Station, TX 77840 RE: Request for Rehearing Regarding 822 Nimitz Setback Variance Request Dear Chairman Hill, I respectfully request a rehearing before the ZBA regarding my home located at 822 Nimitz Street (case #03 -17). On February 4, 2003, the ZBA considered a request for a rear setback to allow my dilapidated home to be replaced by a new home. At that meeting, my request failed by a vote of three to grant the variance and one to deny. My understanding is that, had the full board of five members been in attendance, having only one dissenting vote would have resulted in approval of my request. Because similar variances have been approved for neighboring properties (810, 812, 814, 820, and 824 Nimitz as well as 806, 811 and 821 Avenue A), and because Nimitz Street encroaches approximately fifteen feet onto my property, and since one board member was absent on February 4, 2003, I respectfully request that my ZBA application be reheard. I understand that if the board grants a rehearing, the actual hearing will take place at the April meeting. Thank you very much for your consideration of my request. Ciit / 7 03 Ruthie L. Smith Subdivision Dear Gregg, I have received and reviewed the survey of the above referenced property, and have determined that the proposed single family home may exceed the rear setback by 17.5 feet. This makes the new rear setback requirement 7.5 feet from the property line. The home may not encroach into any other setback. This decision was made based on the precedence of approved setback variances in the area with the same or similar conditions. I feel that it is not desirable for the home to be located any closer to the front property line than the required 25 foot building setback because of the unique condition that exists with Nimitz Street built on the property within this setback area. Due to the fact that the home will be constructed under the Optional Relocation Program provisions, the rear setback requirement will be waived with no further action required. If you have any questions regarding this matter, please do not hesitate to give me a call. Thank you.
