Box 13087 TPDES Permit No.13850 -001 issued Austin, Texas 78711 -3087 December 13, 1999. PERMIT TO DISCHARGE WASTES under provisions of Section 402 of the Clean Water Act and Chapter 26 of the Texas Water Code Wellborn Resources LLC whose mailing address is P.O.Box6733 Bryan, Texas 77805 is authorized to treat and discharge wastes from the Wellborn Resources LLC Wastewater Treatment Plant, SIC Code 4952 located 4,500 feet southwest of Farm -to- Market Road 2154 on Koppe Bridge Road and approxiamately 1 mile south of Wellborn in Brazos County, Texas to an unnamed tributary; thence to Peach Creek; thence to the Navasota River Below Lake Limestone in Segment No. 1209 of the Brazos River Basin only according with effluent limitations, monitoring requirements and other conditions set forth in this permit, as well as the rules of the Texas Commission on Environmental Quality (TCEQ), the laws of the State of Texas, and other orders of the TCEQ. The issuance of this permit does not grant to the permittee the right to use private or public property for conveyance of wastewater along the discharge route described in this permit. This includes, but is not limited to, property belonging to any individual, partnership, corporation or other entity. Neither does this permit authorize any invasion of personal rights nor any violation of federal, state, or local laws or regulations. It is the responsibility of the permittee to acquire property rights as may be necessary to use the discharge route. This permit shall expire at midnight, May 1, 2009. Any deviations from Chapter 317 shall be disclosed in the summary transmittal letter and the technical justifications for those deviations shall be provided in the engineering report. Any deviations from Chapter 317 shall be based on the best professional judgement of the licensed professional engineer sealing the materials and the engineer's judgement that the design would not result in a threat to public health or the environment. 3. Any variance from a Chapter 317 requirement disclosed in your summary transmittal letter is approved. If in the future, additional variances from the Chapter 317 requirements are desired for the project, each variance must be requested in writing by the design engineer. Then, the TCEQ will consider granting a written approval to the variance from the rules for the specific project and the specific circumstances. 4. Within 60 days of the completion of construction, an appointed engineer shall notify both the Wastewater Permits Section of the TCEQ and the appropriate Region Office of the date of completion. The engineer shall also provide written certification that all construction, materials, and equipment were substantially in accordance with the approved project, the rules of the TCEQ, and any change orders filed with the TCEQ. All notifications, certifications, and change orders must include the signed and dated seal of a Professional Engineer licensed in the State of Texas. This approval does not mean that future projects will be approved without a complete plans and specifications review. The TCEQ will provide a notification of intent to review whenever a project is to undergo a complete plans and specifications review. Please be reminded of §317.1(a)(2) of the rules which states, "Approval given by the executive director...shall not relieve the sewerage system owner or the design engineer of any liabilities or responsibilities with respect to the proper design, construction, or authorized operation of the project in accordance with applicable commission rules." The project will include the construction of approximately 2,836 feet of sanitary sewer line, which will tie into an existing sewer line. The new line will service the proposed phase of the subdivision. The proposed sewer line is to he constructed of Mr. Louis C. Herrin, III, P.E. 3/10/2005 Page 2 6 ", 8" and 10" diameter SDR -26, PVC pipe which meets the requirements of ASTM- D3034. The proposed manholes are 4' diameter manholes with sewer line slopes ranging from 0.60% to 2.04 %. The maximum distance between manholes is less than 500 feet, as required by the TCEQ.
