(02 -268) Applicant: JOE COURTNEY, Property Owner Staff Recommendations: Staff recommends approval of the rezoning. Item Summary: The applicant is requesting a rezoning from C -1 General Commercial to C -2 Commercial Industrial in order to develop the property as an office / warehouse complex which may include some commercial industrial tenants. Comprehensive Plan Considerations: This property was included in the 30/60 Small Area Plan, which recommended that all properties to the west of Carter's Creek remain as the Land Use Plan shows, which is retail regional. Staff supports this request because of the location, the access, and the natural buffering from neighboring uses. Associates Avenue is located near the intersection of Highway 30 and the East Bypass, and is not classified on the Thoroughfare Plan. Carter Creek and the Gulf State Utility Easement separate this property from Veterans Memorial Park. The Greenways Master Plan shows the property to the east as a priority two rural greenway. Item Background: The property was annexed into the City in 1958, and was rezoned to C -1 in 1984. The property is not yet platted. A Master Development Plan was approved by the Planning and Zoning Commission in 2001. A preliminary plat and final plat for most of the property were approved last year, but the final plat was never filed. A new preliminary plat and final plat will come before you prior to development of the property. The property is surrounded by C -1 property to the west developed as a movie theater and Sam's Club, the former Furrow's site that is zoned C -2, and vacant land to the north, south and east that is zoned C -1 and R -1. In general, C -2 type businesses usually generate Tess traffic than C -1 General Commercial uses. Commission Action Options: The Commission acts as a recommending body on the question of rezoning, which will be ultimately decided by City Council. The Commission options are: 1. The water line is required to be extended to any separate platted properties. Sewer: Sewer is to the rear of the subject property. Sewer line extensions may be required to any separate platted properties. Streets: Associates Avenue is not classified on the Thoroughfare Plan. Off -site Easements: An off -site easement was obtained for the water line extension. Drainage: Drainage is to Carter's Creek, to the rear. Flood Plain: A portion of the property was located within the 100 -year flood plain. A Fill Permit and subsequent LOMR removed the property from the Flood Hazard Area.
