(Horizon) has performed an investigation of existing state records and a preliminary site reconnaissance for the subject site on 23 November 1999, with respect to the possible occurrence of federally or state - listed threatened or endangered species, the potential for cultural resource deposits, and jurisdictional waters of the US. The subject site is located in the central portion of Brazos County, Texas, within the City of College Station. More specifically, the site lies along Luther Street, north of SH 2818 (Figure 1). The subject site currently consists of partially wooded and previously cleared oak woodlands, which have historically been utilized for rural residential, as well as swine and cattle production activities. The subject site is bound to the west by West Luther Street; to the north and east by rural residential; and to the south by FM 2818. Current use of the subject site is rural residential and agricultural. The "take" of a federally listed, threatened or endangered species is prohibited by Section 9 of the Endangered Species Act of 1973. A "take" is defined as the killing, harassment, or alteration of essential habitats used by a protected species. The only threatened or endangered species listed for Brazos County is the Navasota Ladies' Tresses (NLT) (Spiranthes parksii). Records at the Texas Parks and Wildlife Department Biological Conservation Data Systems were investigated for the occurrence of previously recorded threatened or endangered species on or within 1.0 miles of the subject site which occur within Brazos County. No previously recorded occurrences were discovered. Mr. Shannon Dorsey, a biologist with Horizon, conducted a habitat assessment survey of the subject site to determine if soils and habitat suitable for utilization by the NLT was present. No NLTs were observed on the subject site although this is the time of the year in which Spiranthes species are blooming. Archival research conducted via the Internet at the Texas Historical Commission's Texas Archeological Sites At /as web site showed 7 archaeological sites within a 2 -mile radius of the subject site. Differentiated by type, the sites are classified as follows: 2 prehistoric lithic scatters; 2 prehistoric lithic procurement areas; 1 multicomponent site containing both prehistoric and historic material; 1 historic cemetery; and 1 site for which there were no records on file. No recorded sites were located within the subject site, and no properties listed on the National Register of Historic Places (NRHP) or the list of State Archaeological Landmarks occur on or adjacent to the subject site. Archeological sites are commonly found on upland areas and alluvial terraces along stream channels. An unnamed tributary runs through the eastern portion of the subject site suggesting a possibility of locating cultural resources within the site's perimeters. Therefore, if any federal agency permits (including nationwide permits), federal loans, or loan guarantees are required for development of the subject site, additional efforts to identify and assess potential impacts to cultural resources may be required by the permitting agencies under Section 106, 36 CFR § 800, and the implementing regulations for compliance with the National Historic Preservation Act. Areas subject to jurisdiction under Section 404 of the Clean Water Act are commonly referred to as "wetlands "; however, "wetlands" are actually subsets of areas subject to jurisdiction and potential permitting constraints. The overall term used in the regulations is "waters of the US ", which includes wetlands; all surface tributary streams with a defined channel; all major streams and rivers, lakes, and most ponds; and occasionally artificial features such as ditches or abandoned borrow pits. Jurisdictional wetlands are defined by federal regulations as areas inundated or saturated by surface or groundwater at a frequency and duration sufficient to support and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions (EPA, 40 CFR 230.3). Field reconnaissance of the subject site confirmed the presence of an unnamed tributary traversing the central portion of the subject site. Any impacts to the defined areas of this natural drainage feature would be subject to jurisdiction by the COE. The total acreage of jurisdictional areas does not exceed 3 acres and could be permitted under existing Nationwide Permits. The requirements of the proposed NWPs are more restrictive than the existing permit and will most likely require additional permitting action and agency correspondence as well as mitigation efforts. However, assuming an average jurisdictional width of 5 feet to the ordinary high water mark (OHWM), and a total length of approximately 1000 feet, the total acreage of impact would be approximately 0.12 acres and would not require pre - construction notification or mitigation efforts in coordination with the COE. A post - construction report would be required to satisfy the requirements of the NWP. If significant portions of the defined drainage area are to be disturbed during the proposed project, a detailed site plan identifying these areas should be provided to assist in the exact calculation of acreage of impact so that permitting actions may be pursued through the COE. No other areas subject to regulation by the COE were identified on the subject site. SUMMARY It is our opinion that the subject site does not exhibit habitat characteristics suitable for utilization by any threatened or endangered species which occur in Brazos County and also presents a low probability for the occurrence of significant cultural resource deposits. Impacts to the jurisdictional drainage area would be authorized by NWP 26 and may not require pre- construction notification to the COE or mitigation for impacts under 1/3 acre if initiated prior to the replacement of the current NWP 26. The COE does require post construction within 30 days of completion of work as described on the attached NWP notification. Also, please note, NWP "general conditions" must be met to be in compliance. Fairfield will complete payment on and furnish to the City the easement necessary to construct the lift station and force main (per your proposal of January 23). Fairfield will be responsible for the cost of constructing a public gravity wastewater line from the development to the lift station. The City of College Station will construct the lift station and force main through its standard bidding and purchasing procedures. In the event the lift station and force main are not in service at the time Fairfield requests certificates of occupancy for the development, the City will provide alternate wastewater service as necessary to serve the development.
