The following specific adjustment (up to 10 %) from the ordinance requirements is requested: We are requesting a 2.5 foot encroachment into the front 25FT setback for the construction of a car canopy. 2. This adjustment will not be contrary to the public interest by virtue of the following facts: Building setbacks are intended to protect areas of green space and increase aesthetic views from streets. With the heavy vegetation that we have kept on our site the view will not be obstructed due to the addition of a canopy. 3. The granting of the adjustment will not materially or adversely affect adjacent land uses or the physical character of the uses in the immediate vicinity because of the following: Concrete paving for parking is allowed to encroach into the front 25FT setback, which is what we have done on our site plan. All we are asking for is to provide cover parking for the stalls that are already in place. 4. The granting of the adjustment will be consistent with the purpose and intent of the Unified Development Ordinance because of the following: Building setbacks are intended to protect areas of green space and increase aesthetic views from streets. Some districts now have setbacks at 15FT, and others with less to promote the view from the street. With the heavy vegetation that we have kept on our site the view will not be obstructed due to the addition of a canopy. We will not be removing any additional vegetation than what has already been removed for the construction of the parking spaces.
