This letter is to confirm that the Zoning Board of Adjustment, at their
September 6, 2005 meeting, approved the requested variances at 316
Pershing Street, also known as, Lots 19 & 20, Block 5, Oakwood Addition
Subdivision.
Approved:
20 -feet to the front setback
3- inches to the sidesetback

SUBJECT: 316 Pershing variance request
The application for a variance request has been reviewed. The following is a list
of staff review comments detailing items that need to be addressed. Please
address the comments and submit the following information by Monday, August
15, 10 a.m. to be placed on the next available Zoning Board of Adjustment
meeting scheduled for September 6, 2005, 6:00 p.m. in the City Hall Council
Chambers, 1101 Texas Avenue.
1. Please state the exact variance needed.
2. The survey needs to show the actual front setback line of the neighboring
property so the ZBA can graphically see the encroachment.
3. A variance will also be needed for the 7.5 -ft. side setback. This needs to be
addressed on the application.
4. The "Applicable Ordinance Section" for the front setback will be the UDO
Section 7.1.D.1.e (contextual setback) and Section 5.2 Residential
Dimensional Standards for the side setback.
5. FYI: While the City does not enforce deed restrictions, whoever will be
representing the applicant at the public hearing should probably be prepared
to address why this property is not meeting deed - restricted setbacks if the
question arises.
