Regrettably, I would like to share some additional comments regarding the project. Staff will require the provision of cross access easements to both of the adjacent properties along SH 30 / Harvey Road per Section 7.3 of the UDO. Both of the adjacent properties would be able to maintain their existing driveways and locations but should they redevelop, access to them should be consolidated. Further, staff believes that this notion will also be supported by comments from TxDOT. Additionally, staff has been contacted by the property owner to the immediate west of the site regarding drainage and buffering. She indicated that drainage has been problematic in the past and hopes that the redevelopment of the restaurant site improve this condition. As was discussed, no buffer requirements will be imposed along this property line (western) per Section 7.6.B.2 where exceptions to the requirements will be made when the adjacent developed use is non - conforming (single - family residence in a C -1 district). However, I don't believe the property owner understood this to be the case, and would like a fence to be installed. Such a fence would not be required by the UDO.
