staff review comments detailing items that need to be addressed. Please address the

1. Before a building permit is approved, this item must be addressed and approved by staff for
the provision of color samples and indicate placement of materials on facades according to
the UDO, Section 7.9 by providing the following dimensions in a note or table:
• Total vertical square footage minus openings (for each facade separately).
• Total vertical square footage of each building material (for each fagade separately).
• Total vertical square footage of each color (for each fagade separately).
2. Each phase of this two -phase project shall comply with Sec. 7.5 Landscaping and Tree
Protection.
3. With regard to screening along Nunn Jones, dwarf species are not permitted in required
screening areas or in required buffer areas; and the screening may be accomplished using
plantings, berms, structural elements, or combinations thereof, and must be a minimum of
three feet above the parking lot pavement elevation.
4. Provisions must be made to accommodate a fire lane through and during Phase 2
construction to access the completed Phase I portion of the project from Harvey Road due
to the fire hydrant location.
5. Documentation, including a graphic, must be furnished to maintain adequate parking and
access during each phase of construction in accordance with Note #9 on Page C1.0.

Roxanne and Harvey,
In a preapplication meeting C &J's was told a joint access easement would be required with their future
Site Plan application. The property is platted so this easement will likely be by separate instrument.
As explained to me by Chuck, another agreement would have to be reached for the adjacent properties to
utilitize the easement. The parameters for the 2nd agreement are acting in good faith and
reasonableness. I would think the parameters should be more limited (for example: to a porportional
impact of traffic use) as good faith and reasonableness seems too open -ended and therefore may not
come to fruition.
In short, is this language adequate for a joint access agreement?

As requested by Alan Gibbs, I have attached for your review a proposed
Private Joint Access Easement that is being required of C &J's Barbeque
before the City will issue C &J's redevelopment permits.
One issue I have raised is that there are no provisions in the City's
ordinance about how the burden of the easement will be allocated between
the private owners. I have prepared this easement granting the joint
access, but allowing Grantor to prohibit use until Grantee enters into
an agreement equitably allocating the burden of the easement, thereby
postponing the allocation until the parties get ready to use the
easement and the facts are clear. I have placed on the Grantor the
obligation to act in good faith and reasonably.
It seems to me that to require the applicant to bear the entire burden
is an exaction that is disproportional to the applicant's impact.
would be happy to discuss this matter with you at your earliest
opportunity as, not surprisingly, the applicant is eager to proceed with
the redevelopment of this property.

Subsequent to your pre - application conference last Monday regarding the redevelopment of CW BBQ, Ken Fogle and
I have taken a closer look at your preliminary site plan. Regrettably, I would like to share some additional comments
regarding the project.
Staff will require the provision of cross access easements to both of the adjacent properties along SH 30 / Harvey Road
per Section 7.3 of the LIDO. Both of the adjacent properties would be able to maintain their existing driveways and
locations but should they redevelop, access to them should be consolidated. Further, staff believes that this notion will
also be supported by comments from TxDOT.
Additionally, staff has been contacted by the property owner to the immediate west of the site regarding drainage and
buffering. She indicated that drainage has been problematic in the past and hopes that the redevelopment of the
restaurant site improve this condition. As was discussed, no buffer requirements will be imposed along this property line
(western) per Section 7.6.B.2 where exceptions to the requirements will be made when the adjacent developed use is
non - conforming (single - family residence in a C -1 district). However, I don't believe the property owner understood this
to be the case, and would like a fence to be installed. Such a fence would not be required by the UDO.
