Hey Molly,
I just wanted to give you a head's up re: a new open record's request that I'm submitting today.
Were asking for all information that the P &Z received regarding the CUP for the proposed tower
on Southwest Parkway. I'm requesting all of the information that the Commission used in
determining compliance with Article 6.3.T.11 "Conditional Use Permits ".
Based on what we've received so far, we don't believe that the P &Z had enough information to
determine the additional factors listed in 6.3.T.11. This is especially true if they were not provided
with the search ring.
I look forward to hearing from you soon. (I'm sure you're probably hating me about now!)

Normally, I would advise that any information provided to Council during an open meeting is public information.
However, in this instance, Council would possibly be viewing proprietary information.
I wasn't 100% sure, so I contacted the attorney general's office. I spoke with Jesse Harvey. He advised that Council
could review information that is proprietary without having the information subject to public disclosure.
I've already sent Natalie's request to the attorney general, so they will rule on the request and let us know if the
information can be released.
So, yes, Molly, the answer to your question is yes.
Mr. Harvey did advise that Council should be advised to be careful with their discussion of proprietary information. I
would suggest that you inform Council of the proprietary information, the pending request and that the information has
not been disclosed to the public.
City Staff should also be very careful in presenting this information to Council, as well. For example, please don't quote
information off this map. If you have any questions, please let me know.

I believe Natalie and I have a difference of opinion on the information submitted. They turned in a propagation map with
a search ring, but it was not laid over GIS (not an ordinance requirement and the application says it "should" be laid over
GIS). I looked at our GIS compared to their map when it was submitted and determined that it was not necessary for
them to turn it in in such a format. Though, an aerial of the area is something that is easily enough copied off for
Council.
Angela, isn't it correct that I can have the propoagation map information available for Council at their meeting and let
them evaluate it without disclosing it to the public?

Good morning Molly,
I just wanted to follow -up on all of the voice -mail messages I left you on Friday. I've attached a
copy of the cell tower application and highlighted the areas that were missing. (This is the
provision that I asked Reeves to add after working on the Krenek Tap Road CUP with legal.)
In talking to Angela on Friday, Cingular does not want the propagation map released. However,
we cannot determine (much less the P &Z and Council) what alternatives are available if the
search ring is proprietary information. For major WTF's, the P &Z and Council must consider the
"availability of suitable alternatives and /or existing structures ". It may well show that there are no
other alternatives; but, that is impossible to know without studying the area within the search
ring. I understand that there may not be existing towers that can be utilized; however, there could
definitely be many other locations where a stand alone cell tower facility may be more appropriate
and less visible from an arterial roadway.
Our request is simply to postpone the public hearing before City Council until we can resolve this
issue. I think it was a big mistake that the P &Z didn't have this basic information that's required
with all major WTF's. Angela believes this is not a legal issue and suggested that I work with the
folks who schedule the public hearings (Dev'I Services & Connie Hooks). We don't have much
time since the meeting is scheduled for this Thursday. Could you please discuss this issue with
Joey, Connie, legal or whoever as soon as possible?

I wanted to let you know I got a copy of the updated site plan and the sketch of the light pole.
These are being forwarded to the City Council for their consideration, but the only photo
simulations I have are for the flag pole with a wooden fence. At this time my report reflects that
your plans are for a flag pole with a wooden screening fence, but that you have expressed a
willingness to provide a Tight pole alternative and a masonry fence. You might want to have
updated simulations ready for the meeting on January 12.

I will have a file at the meeting that contains the documents that your company has submitted to
us, in case they request any of it (inventory of sites, letter of intent to colocate, etc.). The P&Z
has already been given copies of the site and landscape plans, search ring, and visual quality
pics. You will have the opportunity to address the commission when they open the public
hearing. Though not necessary, if you have a powerpoint, jpegs, or anything else computer -
driven that you would like to use, that should be sent to us ahead of time so we can Toad it onto
the computer and test it before the meeting. We also have an overhead for hard copies of items.

design alternatives, such as the use of microcell, cannot be utilized to accomplish the provision of

Not a problem. It would probably be beneficial to do this in person.
I would have preferred to have made the July 5th meeting, however, if you look at the
attachments, I was not informed of this meeting until Tuesday morning, July 5th seeing that by
the time it was faxed at 5:36 PM on Friday, I was not in the office, and the following Monday
was a holiday. On top of that, the information on your memorandum wasn't faxed to me until
11:36 AM on July 5th. That just wasn't enough time to get the "missing information" together
and drive to College Station. Hopefully we can meet all your requirements the next go around.

I apologize if there has been a breakdown in communication on our side. I'm trying to figure out
where our miscommunications have happened to see if there is a way to improve it in the
future. Our records show that we received packets from from you on May 2 (initial submittal),
June 7, and June 27. In response we sent out comments on May 9, June 17, and July 5. We
met before your submittal and you attended a facilitation meeting after the first set of comments,
but not the second or third. As you chose not to attend the 2nd and 3rd facilitation meetings
(these aren't mandatory) and we have not heard from you regarding any of the comments, we
were not aware any of them were unclear or being disputed. Perhaps it would be beneficial to
reschedule the facilitation meeting from the 3rd set of comments so you can show us how the
staff review comments had been addressed and we can discuss the items that were unclear.
Please let me know if you would like to be put on next Tuesday afternoon's schedule, or if you
would like to try to work this out via e-mail.

I think after looking at the fax I received, we have a breakdown in communication. There are
items being asked for that have been previously submitted. For instance, under the
Planning /Application portion of your fax, #1, 2 and 3 have been submitted. Under
the Planning /Site Plan portion of your fax, #6 (minus the zoning of the parcel on the site plans)
the other items have been provided. Under the Engineering portion #4, we're unclear on what is
needed as it seems to have been previously provided in the site plans or simply is not in the City
Records. #5, don't understand what is needed here.
So, with that said, I think it would benefit our client to get these matters communicated and
taken care of before we pay additional funds. Therefore, I think the #2 option listed below
would be our choice.

I wanted to ask you about the public hearing scheduling for this tower. For this project to go to
the August 4 P&Z meeting, you have until Monday, July 18 10 a.m. to turn in the required fees,
materials, and corrections for this project. We hit a scheduling snag in that notification
requirements for the public hearings dictate that we notify in the newspaper and that is due by
noon tomorrow, June 15.
We have two options:
1. We can go ahead and notify for the August 4 P&Z /August 23 CC meetings, but if all the
needed fees, materials, and corrections and not ready and complete by 10 on Monday morning,
we pull the item from the meeting and L. Ford Clark will have to pay a new application fee to
renotify for a future meeting, or
2. We can go ahead and count on the project going to the August 18 P&Z /Sept. 8 CC.
Please let me know what would you like us to do.

Subject: Follow up to todays facilitation meeting
Brandt,
This is a follow up to todays facilitation meeting, regarding the issues we discussed.
1. Asphalt or Concrete will not be required for the overall site surface material, only the
entrance. Please specify the actual material.
2. Please identify the hydrant that will be used to cover this site. The hydrant must be located
within 300ft from the building and the building must be covered by a 150ft arc measured from
the end of the 300ft. The 300 ft must be a driveway designated as a fire lane.
3. A fire flow analysis must also be submitted for the hydrant which is to cover this site. This
information can be gathered from the City of College Station Public Utilities Department (979-
764 -3690)
4. Please depict the location, material, size, slope, and meter size of the irrigation meter, line
and back flow preventer. This meter will have to be in the land owners name. It may be easier
to share an Irrigation Meter /System with the Williams Lube King ? ??

Not a problem. It would probably be beneficial to do this in person.
I would have preferred to have made the July 5th meeting, however, if you look at the
attachments, I was not informed of this meeting until Tuesday morning, July 5th seeing that by
the time it was faxed at 5:36 PM on Friday, I was not in the office, and the following Monday
was a holiday. On top of that, the information on your memorandum wasn't faxed to me until
11:36 AM on July 5th. That just wasn't enough time to get the "missing information" together
and drive to College Station. Hopefully we can meet all your requirements the next go around.

I apologize if there has been a breakdown in communication on our side. I'm
trying to figure out where our miscommunications have happened to see if there
is a way to improve it in the future. Our records show that we received packets
from from you on May 2 (initial submittal), June 7, and June 27. In response we
sent out comments on May 9, June 17, and July 5. We met before your
submittal and you attended a facilitation meeting after the first set of comments,
but not the second or third. As you chose not to attend the 2nd and 3rd
facilitation meetings (these aren't mandatory) and we have not heard from you
regarding any of the comments, we were not aware any of them were unclear or
being disputed. Perhaps it would be beneficial to reschedule the facilitation
meeting from the 3rd set of comments so you can show us how the staff review
comments had been addressed and we can discuss the items that were unclear.
Please let me know if you would like to be put on next Tuesday afternoon's
schedule, or if you would like to try to work this out via e-mail.

I think after looking at the fax I received, we have a breakdown in communication. There are
items being asked for that have been previously submitted. For instance, under the
Planning /Application portion of your fax, #1, 2 and 3 have been submitted. Under
the Planning /Site Plan portion of your fax, #6 (minus the zoning of the parcel on the site plans)
the other items have been provided. Under the Engineering portion #4, we're unclear on what is
needed as it seems to have been previously provided in the site plans or simply is not in the City
Records. #5, don't understand what is needed here.
So, with that said, I think it would benefit our client to get these matters communicated and
taken care of before we pay additional funds. Therefore, I think the #2 option listed below
would be our choice.

Morning!
I wanted to ask you about the public hearing scheduling for this tower. For this project to go to
the August 4 P&Z meeting, you have until Monday, July 18 10 a.m. to turn in the required fees,
materials, and corrections for this project. We hit a scheduling snag in that notification
requirements for the public hearings dictate that we notify in the newspaper and that is due by
noon tomorrow, June 15.
We have two options:
1. We can go ahead and notify for the August 4 P&Z /August 23 CC meetings, but if all the
needed fees, materials, and corrections and not ready and complete by 10 on Monday morning,
we pull the item from the meeting and L. Ford Clark will have to pay a new application fee to
renotify for a future meeting, or
2. We can go ahead and count on the project going to the August 18 P&Z /Sept. 8 CC.
Please let me know what would you like us to do.
