HomeMy WebLinkAboutStaff Report a1 STAFF REPORT Project Manager: Molly Hitchcock Report Date: November 28, 2005 Email: mhitchcock @cstx.gov Meeting Date: December 8, 2005 Item: Public hearing, presentation, possible action and discussion on a Conditional Use Permit - Use & Site for a StealthTelecommunications Tower consisting of approximatly 0.05 acres at 111 Southwest Parkway East, generally located on the north side of Southwest Parkway east of Texas Avenue. Applicant: Brandt Dozier, L. Ford Clark, Inc. Staff Recommendation: Staff recommends approval of the Conditional Use Permit. Staff does acknowledge that other forms of "stealth" design may also be appropriate. Item Summary: The applicant is requesting a Conditional Use Permit for a stealth telecommunications tower designed as an (80) eighty -foot flag pole, just east of Williams Lube King (on the same lot) and west of Aggieland Credit Union. In accordance with the application requirements for a major facility in the UDO, the applicant has provided: • A site plan meeting minimum standards (attached), • An inventory of existing and future Cingular towers in the area, • The linear separation distance from nearby residential structures, • A visual impact analysis (attached), • Building plans for the tower and antenna, • Letter of compliance with federal regulations, • Graphic representation of the applicable search ring, • Letter of intent to provide collocation opportunities, and • Documentation relating to the need for the proposed tower and the inability to locate at other sites. Comprehensive Plan Considerations: The subject property and those to the east and south (across Southwest Parkway) are shown on the Land Use Plan as Retail Regional. Property to the west and north are shown as Office. They are all zoned for C -1 General Commercial and are developed as banking or retail facilities and an auto service shop. Southwest Parkway is shown as a minor arterial on the Thoroughfare Plan. New towers typically have to meet a setback from such a thoroughfare of three times the tower height; but towers deemed to be stealth are not required to meet this setback. The tower will be approximately 115 feet from Southwest Parkway. 1 Telecommunications Act The Telecommunications Act of 1996 established guidance for local municipalities to regulate telecommunications facilities. While the industry sought to exempt themselves from local regulation, the Act affirms the authority of local municipalities to regulate such uses. There are basically five conditions set forth in the act that affect local zoning authority: 1. "Local zoning requirements may not unreasonably discriminate among wireless telecommunications providers that compete against one another." 2. "Local zoning requirements may not prohibit or have the effect of prohibiting the provision of wireless telecommunications service." 3. "A local government must act within a reasonable period of time on requests for permission to place or construct wireless telecommunications facilities." 4. "Any city or county council or zoning board decision denying a request for permission to install or construct wireless telecommunications facilities must be in writing and must be based on evidence in a written record before the council or board." 5. "If a wireless telecommunications facility meets technical emissions standards set by the FCC, it is presumed safe. A local government may not deny a request to construct a facility on grounds that its radiofrequency emissions would be harmful to the environment or the health of residents if those emissions meet FCC standards." Current Ordinance The City's current ordinance was adopted in December 1997 and amended in September 2004. The Ordinance is designed to comply with the Telecommunications Act and address concerns over the construction of new transmission towers. The approach of this ordinance is to require separation between towers and encourage co- location and alternative designs. The stealth design element is a key component of the ordinance that was designed to provide a creative alternative. The stealth design provisions allow companies a way to provide service in a low impact form where typical transmission towers would not be permitted. WTF Considerations: In addition to the standard CUP guidelines (described below), the Commission shall consider the following additional factors when determining whether to recommend a CUP for a telecommunication facility: • Height of the proposed tower, surrounding topography and tree coverage and foliage as they relate to: a. Skyline impact, examining whether the proportions of the structure appears to dominate or blend in with the surrounding environment and b. Shadow impact, whether or not the proposed tower will cast shadows that would prevent the reasonable use of enjoyment or surrounding properties. • Design of the tower, with particular reference to design characteristics that have the effect of reducing or eliminating visual obtrusiveness. • Proximity of the tower to residential structures and residential district boundaries. • Economic impact on adjacent and nearby properties. • Proposed ingress and egress. • Availability of suitable alternatives and /or existing support structures. 2 Commission Action Options: The Commission is a recommending body to the City Council, which has final authority over the Conditional Use Permit and associated site plan. The options regarding the use permit are: 1. Approval as submitted; 2. Approval with conditions relating to specific site characteristics or with time limitations; 3. Please address the reasons why collocation is not an option on the new 80 -ft. tower being built at 903 Krenek Tap Road and attaching a facility to the new hotel at 2313 Texas Ave. South is not an option. 2. A description of the design plan proposed by the applicant to the City (e.g., 80 -ft. monopole, flagpole stealth design, antennae located on the inside of the pole, collocation available at so many feet, etc.). 3. Please state in writing why technological design alternatives, such as the use of microcell, cannot be utilized to accomplish the provision of the applicant's telecommunications services. Site Plan 4. A vicinity map needs to be shown on the site plan. 5. All plans should be submitted in an engineering scale. 6. The site plan needs to show the ownership and current zoning of the parcel and all abutting parcels. 7. Please show the square footage of the equipment shed. 8. Please show building setbacks (the equipment shed will need to meet setbacks). 9. Show meter location. 10.The equipment shed will have to have fire coverage. Please show hydrant and fire lanes. Landscape Plan 11. Only 6 live oaks are shown on the landscape plan (7 are claimed). 12. The gravel parking area should be screened from Southwest Parkway. Some of the landscaping from the back of the site could be moved to the front. 13. Please adjust the Landscape Note to indicate that an irrigation system to service all new plantings must be installed by a certified installer before a certification of occupancy will be issued. Site plan drawn to scale clearly indicating the location, height, and design of the proposed tower, equipment cabinets, transmission buildings and other accessory uses, access, parking, fences, and landscaped areas. 3. The following are items required before an application can be considered complete and a full review may be made: • Section 3.1.B.1 of the Unified Development Ordinance mandates a Preapplication Conference with staff before an application may be submitted for any Conditional Use Permit. • If the application is filed by anyone other than the owner of the property, the application must be accompanied by a power of attorney statement from the owner. • The following is a copy of Section 6.3.T.8 — Section 6.3.T.10 of the Unified Development Ordinance that regulates the application procedures for wireless telecommunication facilities. Items in bold need to be addressed before an application can be considered complete. Site Plan Requirements An application for a Conditional Use Permit for a WTF shall include the following items (in addition to the site plan and other information required for a standard CUP application): 1. An inventory of the applicant's existing and future towers that are either within the City, the City's ETJ, or within at least 1 mile of the City's boundary where the ETJ does not extend that far. The inventory shall include specific information about the location, design, and height of each tower. The owner must have on file with the development department a master list of all existing tower structures owned or controlled by the owner. Such list must specify the name, address and telephone number of the owner of record, the tower locations by address and legal description, tower height, the number of antenna arrays on the tower, and the names, addresses, and telephone numbers of all other users of the tower structures. The zoning administrator may share such information with other applicants or organizations seeking to locate antennas within the City. 2. Site plan drawn to scale clearly indicating the location, height, and design of the proposed tower, equipment cabinets, transmission buildings and other accessory uses, access, parking, fences, and landscaped areas. 3. The linear separation distance from other transmission towers within a one - mile radius of the proposed tower site. The linear separation distance from all residentially -zoned properties, residential structures and applicable thoroughfares as outlined in Section 6.3.Q.4.b. Proximity to Major Thoroughfares, within 500 feet of the proposed tower. 4. A visual impact analysis, presented as color photo simulations, showing the proposed site of the WTF. At least four views shall be submitted looking toward the NOTE: Any changes made to the plans, that have not been requested by the City of College Station, must be explained in your next transmittal letter and "bubbled" on your plans. Any additional changes on these plans that have not been pointed out to the City, will constitute a completely new review. Page 2 of 4 site (typically north, south, east and west) including views from the closest residential property and from adjacent roadways. The photo - realistic representation shall depict a "skyline" view showing the entire height of the proposed tower or WTF to scale, and the structures, trees, and any other objects contributing to the skyline profile. 5. Plans for the antenna and the antenna tower shall be prepared and signed by a licensed professional engineer and designed to withstand sustained winds of at least 80 miles per hour. [This will be checked at time of building plan review.] 6. All telecommunication facilities must meet or exceed the current standards and regulations of the FAA, the FCC, and any other agency of the Federal Government with the authority to regulate telecommunication facilities. An applicant for a permit shall submit an affidavit confirming compliance with applicable regulations. 7. Grid plan (propagation map) of the service area for existing and future structures for a period of not less than 5 years. The submission should include a map showing the "search ring" that was required for siting the proposed facility. Collocation Requirements 8. No new tower shall be built, constructed, or erected in the City unless the tower is capable of supporting additional wireless telecommunication facilities. The applicant must submit a letter addressed to the City declaring an intent and willingness to construct a proposed tower that would allow additional service providers to locate on the new tower. Documentation of Need and Alternatives No new communications tower shall be permitted unless the applicant demonstrates to the reasonable satisfaction of the approving authority that no existing tower, building, structure, or alternative technology can accommodate the applicant's proposed antenna. The applicant shall submit information related to the availability of suitable existing towers, other structures or alternative technology that can accommodate the applicant's proposed antenna. The zoning official or approving authority may request information necessary to demonstrate that reasonable alternatives do not exist. The applicant must submit: 9. The names, addresses, and telephone numbers of all owners of other towers or usable antenna support structures within a one -half mile radius of the proposed new tower site, including City -owned property. [Until a search ring laid over the City's GIS aerial is provided, Staff can not adequately determine if all possible accommodations have been explored. Options that still need exploring include a new 80 -ft. tower being built at 903 Krenek Tap Road and a hotel (almost complete) at 2313 Texas Ave. South.] 10.A sworn affidavit attesting to the fact that the applicant made diligent, but unsuccessful, efforts to obtain permission to install or collocate the new facility on existing towers or antenna support structures located within one -half mile radius of the proposed tower site. The affidavit shall spell out the efforts taken by the applicant. [See above.] 11.A description of the design plan proposed by the applicant to the City. The applicant must demonstrate the need for towers and why technological design alternatives, such as the use of microcell, cannot be utilized to accomplish the provision of the applicant's telecommunications services.
