Item: Public hearing, discussion, and possible action on a Conditional Use
Permit - Use Only- (CUP) for the Brazos Community Church located at 700
University Drive East, Suites #108 and #110. (02 -266)

Staff Recommendation: Staff recommends approval of the Conditional Use
Permit as submitted.
Item Summary: Brazos Community Church is requesting a Conditional Use
Permit to continue the use of suite # 110, a 4,750 square foot lease space, as a
church facility and to expand the facility into 1,500 square feet of suite # 108 of
the University Village Shopping Center. The Church has approximately 60 -125
members and lists its hours of operation as Sundays from 9 a.m. until 2 p.m.,
Saturday nights from 7 p.m. until 10 p.m., and other evening uses as needed.
There is also limited office use during the weekdays.
Comprehensive Plan Considerations: The University Village Shopping Center
is located on the southeast corner of Tarrow and University Drive. The Land Use
Plan shows this area as regional retail. The Thoroughfare Plan designates
University Drive as a major arterial in this area and Tarrow as a major collector.
Item Background: The property was annexed into the City limits in 1956 and
was rezoned from C -1 to C -B in 1992 in a City initiated rezoning of the University
Drive Corridor. The property was platted as the University Park East Subdivision
in 1977 and replatted in 1983 and in 1989.
The Brazos Community Church was granted a Conditional Use Permit for the
use of suite # 110 of the University Village Shopping Center on February 6, 2000
with a time limit of 3 years as a condition by the Planning and Zoning
Commission. The CUP will expire next month. The membership at the time of
the original CUP was 70 members.
There are approximately 285 parking spaces existing for the shopping center.
With approximately 125 members, 42 parking spaces are required by the parking
regulations. The applicant contends that the church operation hours will be
different than the existing tenants and thus, plenty of parking will be available.
Staff Analysis: The Commission may recommend approval of a conditional use
subject to appropriate conditions and safeguards if it finds that:

1. "The proposed use meets all the minimum standards established in the
ordinance for the type of use proposed."
2. "The proposed use meets the purpose and intent of the ordinance and is
in harmony with the development policies and goals and objectives as
embodied in the Comprehensive Plan for Development of the City."
3. "The proposed use will not be detrimental to the health, welfare, and
safety of the surrounding neighborhood or its occupants, nor be
substantially or permanently injurious to neighboring property."
The Commission may recommend additional reasonable restrictions or
conditions to carry out the spirit and intent of the ordinance and to mitigate
adverse effects of the proposed use.
Commission Action Options: The Commission acts as a recommending body
on the question of Conditional Use Permits.

Brazos Community Church is requesting a Conditional Use Permit
