Hear Citizens At this time, the Chairman will open the floor to citizens wishing to address the
Commission on planning and zoning issues not already scheduled on tonight's agenda. The citizen
presentations will be limited to three minutes in order to accommodate everyone who wishes to
address the Commission and to allow adequate time for completion of the agenda items. The
Commission will receive the information, ask city staff to look into the matter, or will place the
matter on a future agenda for discussion. (A recording is made of the meeting; please give your name
and address for the record.)
2. Public Comment on the Unified Development Ordinance (UDO). At this time, the Chairman will
open the floor to citizens wishing to address the Commission on the recently adopted Unified
Development Ordinance. The citizen comments will be limited to three minutes in order to
accommodate everyone who wishes to address the Commission and to allow adequate time for
completion of the agenda items. The Commission will receive the information and it will be added to
the public record. (A recording is made of the meeting; please give your name and address for the
record.)
All matters listed under Item 3, Consent Agenda, are considered to be routine by the Planning and Zoning
Commission and will be enacted by one motion. These items include preliminary and final plats, where staff
has found compliance with all minimum subdivision regulations. All items approved by Consent are
approved with any and all staff recommendations. There will not be separate discussion of these items. If
any Commissioner desires to discuss an item on the Consent Agenda it will be moved to the Regular Agenda
for further consideration.

The Planning and Zoning Commission may seek advice from its attorney regarding a pending and contemplated litigation subject
or attorney - client privileged information. After executive session discussion, any final action or vote taken will be in public. if
litigation or attorney - client privileged information issues arise as to the posted subject matter of this Planning and Zoning
Commission meeting, an executive session will be held.

SUBJECT: 2064 Ravenstone -Discussion and possible variance(s) to the
driveway access location and design ordinance limitation located at
2064 Ravenstone Drive (02 -234)
The Project Review Committee (PRC) held a meeting on Wednesday, October
30, 2002 to review the above - mentioned project. Assistant City Engineer Brett
McCully stated that the department received the request for a driveway permit,
which consisted of a pull -in drive to the garage and a circular driveway. Based
on the widths shown on the driveway drawing, the driveways were rejected. The
driveways were above the maximum combined width of residential driveways,
which by code is listed as 28 feet.
Mr. McCully stated that the two driveways combined are 38 feet. The variance
width requested was at 48 feet. Mr. McCully stated that with the lot being
located inside a curve it makes it very difficult to get in and out. Having a circular
drive will be advantageous there. However, having too much width is what the
ordinance is trying to prevent.

There are options of either constructing one drive and /or reconstructing the
current two drives so the width determined by the ordinance could be attained.
Mr. McCully stated that there is not a necessary hardship for the width the
applicant is proposing. Mr. McCully along with staff recommended denial.
Because of the length of the lot frontage, staff is allowing two openings. Mr.
McCully stated that a normal residential lot is allowed one access; a second one
can be granted based on safety and other considerations. There is a
requirement for single driveways to be no more than 28 feet for a straight pull in.
In a circular drive, the combined widths of the two sides are limited to 28 feet.
Commissioner White asked what the width of the circle drive would be. Mr.
McCully said each side of the circle could be a combination of 28 feet.
Commissioner Trapani asked Mr. McCully if it would be safer with the circle drive
or the straight drive. Mr. McCully stated it would be safer with the circle drive.
Commissioner Hall asked about the space on the right side of the garage for
backing maneuvers. Mr. Wallace Phillips stated that that area is a City
easement.
Commissioner White asked Mr. McCully if it would increase safety to grant the
applicant the variance. Mr. McCully stated if they could minimize the widths of
the driveways, the safety does justify granting a variance. Mr. Phillips stated that
the widths have been minimized.
Commissioner Trapani asked if the applicant would make any adjustments to
come into total compliance. Mr. Phillips stated no, saying that is why they are
before the committee.
Commissioner White moved to grant the requested variance based on the
dimensions of 22.8 feet on the right and 15.8 feet on the left at the curb.
Commissioner Hall seconded and the motioned passed 3 -0.
