HomeMy WebLinkAboutStaff Report STAFF REPORT Project Manager: JENNIFER FLANERY Date: December 5, 2002 Email: jflanery@ci.college- station.tx.us Item: Public hearing, discussion, and possible action on a Conditional Use Permit (Use Only) for the COCS Fire Station No. 5 (CUP) located at 601 Greens Prairie Road. (02 -238) Applicant: Bart Humphreys, City of College Station Staff Recommendation: Staff recommends approval of the Conditional Use Permit. Item Summary: The applicant is requesting a Conditional Use Permit (use only) to allow for the College Station Fire Department Fire Station No.5 to be located on 4.1 acres along Greens Prairie Road. Comprehensive Plan Considerations: The Land Use Plan designates this area and the surrounding properties as Single Family Residential. A portion of the subject property is located in the floodplain. The property takes access from and faces onto Greens Prairie Road, which the Thoroughfare Plan shows to be a major arterial in this area. The surrounding property is largely undeveloped. The property to the west was recently rezoned and platted for a single - family residential subdivision. The Conditional Use Permit for the site will be required to go before the Planning and Zoning Commission and the City Council (as per a recent ordinance amendment requiring Council to take final action on all Conditional Use Permits) prior to development. Item Background: The property was brought into the City's ETJ in 1977. A portion of this property was annexed in 1983 and the remainder in 1995. The property is zoned A -O Agricultural Open and is not yet platted. Five conditional use requests for fire stations have gone before the Commission. All passed with the exception of one that was tabled. In 1986, the citizens along Sebesta Road opposed a fire station being located on their street because of the anticipated noise it would create. Staff Analysis: Section 14 of the Zoning Ordinance authorizes the existence of conditional uses. The Commission may recommend approval for a conditional use subject to appropriate conditions and safeguards, when after public notice and hearing the Commission finds that: (Staff comments are in italics) Created on 11/06/02 9:19 AM 1 R: IHTLTRIPZLTRIPRODIPZ20021P0007160. DOC 1. "The proposed use meets, all the minimum standards established in the ordinance for the type of use proposed." A Conditional Use permit request for site plan approval will come before the Commission and the Council at a later date. 2. "That the proposed use meets the purpose and intent of the ordinance and is in harmony with the development policies and goals and objectives as embodied in the Comprehensive Plan for Development of the City." The request is in compliance with the Comprehensive Plan and the Strategic Plan. 3. "That the proposed use will not be detrimental to the health, welfare, and safety of the surrounding neighborhood or its occupants, nor be substantially or permanently injurious to neighboring property." The public hearing is an opportunity for the Commission to measure the potential impact on surrounding land uses. The Commission may impose additional reasonable restrictions or conditions to carry out the spirit and intent of the ordinance and to mitigate adverse effects of the proposed use. These requirements may include, but are not limited to, increased open space, loading and parking requirements, additional landscaping, and additional improvements such as curbing, sidewalks and screening." Unless the public hearing bring to light any new information indicating potential negative impacts, Staff recommends approval. Commission Action Options: The Commission acts as a recommending body on the question of Conditional Use Permits, which will be ultimately decided by City Council. The Commission options are: 1. Recommend approval as submitted; 2. Recommend denial with specified reasons; 3. Table; or, 4. Defer action to a specified date. Supporting Materials: 1. Location Map 2. Application 3. DOC INFRASTRUCTURE AND FACILITIES Water: There is an 18 -inch water line along the south side of Greens Prairie Road. This line can be accessed for this subdivision. Sewer: 27 -inch sewer line is located along the west and south property lines. Streets: Greens Prairie Road is classified as a major arterial on the Thoroughfare Plan. Greens Prairie is planned to be upgraded in the near future. Plans include a possible median and limited median crossing points. Off -site Easements: None required Drainage: Development on this property is required to comply with the City's drainage ordinance. Flood Plain: A portion of the property lies within the 100 -year flood plain. The development of this property must comply with FEMA regulations. Oversize request: None Impact Fees: The subject property is located within the 97 -01 Sewer Impact Fee Area. This fee is currently $349.55 per living until equivalent. This fee is due at the time the plat is filed.
