Item: Public hearing, discussion, and possible action on a Conditional Use
Permit - Use Only for the Victory United Pentecostal Church (CUP). (02-
00500247)
Applicant: Keith Castleberry, Pastor of Victory United Pentecostal Church
Staff Recommendation: Staff recommends approval of the Conditional Use
Permit.
Item Summary: As the Commission is aware, churches are allowed in any
zoning district with a Conditional Use Permit. The applicant is requesting a use
only permit. The subject property is currently zoned C -1 General Commercial
and is developed as a shopping center. The total square footage for the
shopping center is 15,975 sq. ft. The church's lease space will be 1750 sq. ft.
According to the Fire Code, the lease space could have up to 50 seated people.
The parking required for 50 people in a church is 17 parking spaces. The
shopping center currently has 70 parking spaces. The Church's hours of
operation would be Sunday from 2:00 - 5:00 p.m. and Wednesdays from 7:00 -
8:30 p.m.
From July 1995 to January 2002 the Healing Light Church leased this space.
The church use was abandoned when the Avilla Furniture store was in the lease
space from January 2002 to November 2002.
Comprehensive Plan Considerations: The subject property and the property to
the north are shown on the Land use Plan as retail regional and developed as
such. The properties to the south, east and west are shown as Residential
Attached and are developed as such. The subject property fronts on Brothers
Boulevard, which is considered a minor collector on the Thoroughfare Plan.
Item Background: The subject property has been in the city limits since 1974.
Staff Analysis: Section 14 of the Zoning Ordinance authorizes the existence of
conditional uses. The Commission may permit a conditional use subject to
appropriate conditions and safeguards, when after public notice and hearing the
Commission finds that:
1. "The proposed use meets all the minimum standards established in the
ordinance for the type of use proposed." Site plan review was not necessary
in this case since the development is existing.

2. "That the proposed use meets the purpose and intent of the ordinance and is
in harmony with the development policies and goals and objectives as
embodied in the Comprehensive Plan for Development of the City. The
request is in compliance with the Comprehensive Plan.
3. "That the proposed use will not be detrimental to the health, welfare, and
safety of the surrounding neighborhood or its occupants, nor be substantially
or permanently injurious to neighboring property." The public hearing is an
opportunity for the Commission to measure the potential impact on
surrounding land uses.
The Commission may impose additional reasonable restrictions or conditions to
carry out the spirit and intent of the ordinance and to mitigate adverse effects of
the proposed use. These requirements may include, but are not limited to,
increased open space, loading and parking requirements, additional
landscaping, and additional improvements such as curbing, sidewalks and
screening."
Commission Action Options: The Commission acts as a recommending body
on the question of conditional use permits, which will be ultimately decided by
City Council. The Commission options are:
1. Recommend approval as submitted;
2. Recommend approval with conditions relating to specific site characteristics
or with time limitations;
3. Recommend denial with specified reasons for denial;
4. Table; or,
5. Defer action to a specified date.
