MEMORANDUM January 8, 2003 TO: Design Review Board FROM: Jennifer Flanery, Staff Planner Email: jflanery@ci.college- station.tx.us SUBJECT: SIGN /FACADE for SONIC DRIVE -IN (SNFC) This item was tabled at the January 2, 2003 Design Review Board meeting. Zoning District: WPC, Wolf Pen Creek Location: 512 Harvey Road Applicant: Greg Lee, Sonic Operations Item Summary: The applicant is requesting to modify the existing Sonic elements to reflect standard Sonic colors. The following changes are proposed: • Replace existing sign face in freestanding sign with new Sonic logo and standard colors, • Reduce height of berm at front property line and replace with landscaping, • Replace current green picture board frames with red picture board frames, • Replace green neon with red and yellow neon, • Replace green neon window signs with standard Sonic colors, • Add two red cones with fiber optics at front of building, • Replace green picnic tables with red tabletops, • Replace directional and drive -thru sign faces Staff Recommendation: The reduction of the berm may be acceptable if the existing screening wall remains or sufficient plantings are used as screening. Staff recommends denial of the proposal to replace the previously approved green elements and signs with the standard Sonic yellow and red. Staff also recommends denial of the proposal to place large red cones at the front of the building. Item Background: The Sonic restaurant was originally reviewed and approved by the DRB and P &Z in 1998. The first proposal to the DRB utilized the standard Sonic colors and the large red cones, and was rejected by the DRB because the Board did not feel that the proposal met the purpose and guidelines for the Wolf Pen Creek Overlay District. Following that decision, the Board was presented with images from a Sonic restaurant in Missouri City that utilized green instead of the standard red and yellow. This green was approved for many building details and signs, and is currently used at this Sonic location. At that time, the Board also requested that all yellow be removed from the signs and replaced with a white or cream color. The Planning and Zoning Commission specifically forbid the red cone elements seen in front of many Sonic restaurants and specified that the picnic furniture needed to match the green color of the building. The Board has also denied yellow as a background color on several past proposals, such as the Office Max sign. Issues /Items for Review: 1. Landscaping 2. Building design • Colors 3. This item was tabled at the January 2, 2003 meeting. Wolf Pen Creek Design Review Board meeting was held on January 16, 2003 to review the above - mentioned project. Staff Planner Flanery stated that Sonic is requesting to change some of the building colors from the green that was approved several years ago to the Sonic colors of red and yellow. Sonic is also requesting to add the two red large cones similar to other Sonic Restaurants and to take away the berm along Harvey Road. Staff is recommending approval for the reduction of the berm as long as there is still screening for the parking area. Staff is recommending denial for the change in color of the building elements and signs and also for the large red cones. DRB Member King asked if the colors they are proposing now were brought to P &Z and DRB before. Staff Planner Flanery stated that Sonic first proposed the standard red and yellow and were asked to change the colors before the Sonic could be approved. The green had been used on another Sonic and was proposed by the applicant at the time. Commissioner Shafer asked why the applicant feels that he needs to do this. DOC Hugh Lindsay stated that the Sonic at this location is loosing business compared to other Sonic restaurants. Commissioner Floyd asked if Sonic knew the conditions imposed prior to building on that site. Mr. Lee stated that they did know that the Design Review Board and Planning and Zoning imposed these conditions. DRB Member King asked for clarification that if they replace the berms they will have to replace it with landscape of the same height. Commissioner Shafer made the motion to deny. DRB Member Holt seconded. Commissioner Floyd stated that no changes should be made since the current conditions were already approved at the time the restaurant was built. The motion passed 5 -0. A Wolf Pen Creek Design Review Board meeting was held on January 2, 2003 to review the above- mentioned project. Chairman Floyd stated that he spoke with legal counsel regarding the request. He expressed concern whether the actions taken this evening would reverse the conditions that were placed on this property by the Planning and Zoning Commission at a prior meeting. He recommended that the item be tabled until further notice from legal counsel. Development Review Manager Ruiz stated that this body is strictly a recommending body and that the item would go before the Planning and Zoning Commission before any final action is taken. Commissioner McMath motioned to table the item. Commissioner Shafer seconded the motion. The motion carried 5 -0 -1. FOR Floyd, McMath, Shafer, King, and McLean. AGAINST: None. ABSTAINED: Holt. The item will be posted for January 16, 2003. Mr. Alan King motioned to adjourn the meeting, which was seconded by Commissioner McMath.
