TEMPORARY CONSTRUCTION EASEMENTS
Two (2) Temporary Construction Easements:
lst Easement being fifteen feet (15') in width and located Parallel,
contiguous and immediately adjacent to-the West boundary line of the
thirty foot (30 wide permanent easement and right-of-way described
above in the Exhibit "A" and beginning on the Northernmost property
line of said 120 acre tract of land; THENCE Southwesterl�.yal6ng
the West boundary of the abova described thirty foot (30 wide
permanent easement and right --of -way.
2nd Easement being five feet (5') in width and located parallel,
contiguous and immediately adjacent to.the East boundary line of the
thirty foot (30') wide permanent easement and right -of -way described
above in this Exhibit "A" and beginning on the.Northernmo'st Property
line of said 120 acre tract of land; THENCE. Southwesterly along the
East boundary line of the abovo described thirty foot (30') wide
permanent easement and right- of•way, being in all a total distance,
of 2246.5 feet or 136.15 rods in length, more or less, and both

severance damages and payment 1981 crops, the receipt and
sufficiency of which is hereby acknowledged by Grantor. xt
is agreed and understood that Grantee has not paid to Grantor,
and Grantee hereby agrees to pay to i;rantor, within sixty (60)
days after said pipeline has been constructed, or the occurence
of t}ze following items of damage, agreed payments, and to do
and to perform the following things:
(1) Grantee agrees to reasonably level said Easement
in such manner that surface or rain Crater may pass, and flow
undisturbed and unimpeded from Grantor's field or pasture on
one side of said Lasement to the other side of said Easement;
and Grantee agrees to restore all drains, levees and laterals,
field roads and fences to their original condition, and where
said pipeline crosses major drains, ditches or creeks, to
reasonably level the surface so that drain water or rain water
may flow unimpeded alone or across ::aid Easement and into said
major drain ditches or creeks, and to use and continue to use
such reasonable measures thereafter to prevent erosion and
washing in the areas on e ither side of said major drain.ditches

(2) Grantee shall also compensate Grantor for
damages to any other property of Grantor, outside of the Easement,
caused by Grantee, its agents, servants, employees or sub-
contractors.
(3) Grantee agrees to bury its pipeline so that
the top thereof is at least three feet (3') below the surface
of the ground, and at least the same depth below drainage
ditches, creeks and roads. After completion of construction
operations, the surface over the pipeline will be filled,
graded and restored as near as reasonably practicable to its
original level.
{4) Grantee agrees there will be no above ground
structures within the'boundaries of the Easement, except for
pipeline markers at fence lines (or exterior property lines)
and cathodic protection test leads which shall be placed
within the boundaries of the Easement only at the points of

TO HAVE AND TO HOLD, unto Grantee, its successors
and assigns, so long as the rights and Easement herein granted
shall be used by Grantee, its successors or assigns, for the
purposes herein granted.
The Easement herein granted is without the right
on the part of the Grantee to construct and maintain any
fences separating the lands covered by such Easement from
other lands of the Grantor, and that none of the valves,
pipe or appurtenances to said pipeline shall be located on
the surface of said land, except as hereinafter permitted,
and such Easement is granted upon the condition that upon
any abandonment of the use of said Easement for the purposes
herein.granted, or complete cessation of such use thereof
and maintenance or operation of said pipeline for a continuous
pe -riod of eighteen (18) months, after initial construction,
said Casement shall terminate and all rights herein granted
shall thereupon revert to the Grantor, its.heirs or assigns;
but in the event of the termination of this grant, in any
manner., Grantee shall remove all pipe and appurtenances in
the Easement herein granted and shall be liable for all damages
occasioned thereby to Grantor or persons holding under Grantor,
and shall fill up thoroughly the trench or ditch left on
Grantor's property after removal of said pipeline, and shall
restore the Casement to its former condition as near as
reasonably practicable.
In the event that it becomes necessary in the
construction or operation of the pipeline to cut any fences,
Grantee, before cutting such fence, shall first set brace
posts on each side of the Casement or Temporary Construction
Easement, and attach all existing wires to such brace posts
before: cutting any such fence or fences, the purpose of
which is to prevent the wire fence from slackening or sagging
due to Grantee's operations or activities in or upon the
Easement. In this connection, Grantee shall use temporary gaps
during original construction activities or operations sufficient to

In which case the fences shall be restored to their
condition. Lessee agrees to promptly close a12 gates ,which
Lessee, its agents, servants and /or employees may use in
Lessee's operations on the leased.premises.
(k) In the conduct of exploratory operations under this
lease, Lessee agrees that all shot holes will be kept a
sufficient distance away from water wells, tanks and
Improvements or: the leased premises so as not to cause any
damage to seme. In the event any such wells, tanks, or other
property shall be damaged or such as a result of such
exploratory operations. Lessee shall be fully liable for the
damage occasioned thereby. Lessee agrees to promptly plug all
shot holes in accordance with good field practices and to
restore as it was before the commencement of such operations.
(1). No hunting, fishing or other use of the property
covered by this lease by Lessee, its officers, directors,
agents, representatives, employees, successors or assigns is or
shall be authorized by Lessee ever.'
20. Lessee's right to lay pipelines or 'install other
appurtenances shall be limited to such lines and other
appurtenances as are necessary to transport oil and gas from
wells located on Lessor's property (or property pooled
therewith). Lessee's pipelines are to be located on a
reasonable direct route which is approved by Lessors. such
approval shall not be unduly or arbitrarily withheld. All
Pipelines are to be buried at lease three (3) feet measured from
the surface of the ground to the top of the pipe as laid.
21.' Lessors hereby warrant and agrees to defend title to said
land by, through or under Lessors but not otherwise.
22. All provisions of this Lease and the Agreement between
Lessors and Lessee dated shall inure to the
benefit of and be binding upon the parties hereto, their heirs,
successors and /or assigns.

17. Lessors'.royalty herein shall be a free royalty. Lessors
shall not be required to pay and Leonora royalty shall not be
reduced on account of or charged with any costs of making the
Products produced hereunder ready and available for market
Including, but not limited to, the costs of transporting,
compressing, dehydrating, operating, storing, treating, or
Processing oil, gas or other gaseous or liquid hydrocarbons..
Lessors shall, however, bear Lessor's proportionate part of al:t
taxes..
18. Lessee shall not use any water from stock tanks, surface
reservoirs existing water wells or .streams situated on the
Property covered by this Lease. It Lessee should drill any
water wells on the leased premises, then after Lessee has
completed Sts use of such water wells, it shall turn such water
wells, including all casing connected therewith, over to Lessore
(if Lessors so 'desire) free of any costs or charges.
19. (a) All slush pits or excavatlona of any nature made by
Lessee on the leaned premises.shall be fenced by Lessee at it
cost and expense with temporary fencing to protect livestock
from slush Pita or excavations during drilling operations.
(b) Lessee agrees to vacuum all pits and fill sai8 pits

(90) days after cessation of use of such Pita. Lessee further
agrees to remove all equipment, refuse, ga ;bags,. and

THAT, DOLLY DYMPLE CREAGOR OLDEN and her husband, ARTHUR D.
OLDEN, GRANTORS, of the County of Brazos, State of Texas, for and
in consideration of the payment of TEN and N01100 DOLLARS, cash,
and other good and valuable consideration, in hand paid to
GRANTORS by the CITY OF COLLEGE STATION, TEXAS, the receipt of
which is hereby acknowledged, have GRANTED, SOLD and CONVEYED and
by these presents do GRANT, SELL, and CONVEY unto the said CITY
OF COLLEGE STATION, a Texas Municipal Corporation, certain rights
and interests in the nature of a perpetual EASEMENT on and
through the following described property=
Being a strip of land in the Thomas Caruthers League in
Brazos County, Texas, fifty (50 feet in width through
that 120 acre tract conveyed to Dolly C. Olden by deed
recorded in Volume 168, Page 339, of the Deed Records
of Brazos County, Texas.
Provided, however, that this conveyance shall grant the rights
herein specified only as to that portion of the above described
property more particularly described by course, width, and
centerline on the attached Exhibit "A ", known as the "Easement
Area ", and any additional area outside the easement area neces-
sary to install and attach equipment, guy wires, and anchors
necessary and incident to the uses of the Easement Area.
To erect, construct, install, and thereafter use, operate,
inspect, repair, maintain, reconstruct, modify, and remove the
following;
Electric transmission and distribution lines;
Water distribution lines;
upon, over, and across said property as herein described and any
ways, streets, roads, or alleys abutting same; and to cut, trim
and control the growth of trees and other vegetation on and in
the easement area or on ad property of GRANTORS, which
might interfere with 6V� 'ANaton the operation and maintenance of
any public utility equipment, accessories, or operations. It is
understood and agreed 'that any and all equipment and facilities
placed upon said property shall remain the property of GRANTEE.
GRANTORS expressly subordinate all rights of surface use incident
to the mineral estate to the above described uses of said surface
by GRANTEE, and agrees to sublonder's subordinations on behalf of
GRANTEE upon request.
It is expressly understood that the GRANTORS or future owners of
this property reserve the right to use this EASEMENT for all
purposes which do not interfere with or prevent its use by the
GRANTEE.
TO HAVE AND TO HOLD the rights and interests herein described
unto the CITY OF COLLEGE STATION, TEXAS, and its successors and
assigns, forever, and GRANTEES do hereby bind themselves, their
heirs and assigns, to warrant and forever defend, all and
singular, these rights and interests unto the CITY OF COLLEGE
STATION, TEXAS, and its successors and assigns, against every
person whomsoever lawfully claiming, or to claim same, or any
part thereof.

BEGINNING: At a fence corner at the intersection of tho northwest line of
Croons Prairie Road with the southwest lino of Rock Prairie Road,

part. Agency shall have no right to fence or enclose such aerial easement or
to use it for any purposes other than as set out above. The right of the Grantor
to use the above described land, including the portion within the aerial
easement, for all other purposes that will not interfere with the exercise of
the rights of Agency is reserved to the Grantor, including the right to use the
same for general agricultural and grazing purposes, to erect or maintain fences
not more than 8 feet high across such easement, provided that gates or openings
12 feet wide or more are installed therein, to provide Agency reasonable access

to all part of such aerial easement; and to lay out, dedicate, construct,
maintain and use such roads, streets, alleys, railroad tracts, underground
telephone cables and conduits, and oil, gas, water and sewer pipelines as will
not interfere with the rights of Agency; provided that all such facilities shall
be properly grounded, and shall be so constructed as to provide with respect to
Agency's lines and other facilities the minimum clearances provided by law, and
recognized as standard in the electrical industry.
In addition to the consideration above recited for the aerial easement and
right of way hereby granted, Agency will repair or pay the owner of the land,
or•if lease, the tenant, as they may respectively be entitled, for actual damages
done to terraces, fences and growing crops by reason of the construction,
maintenance or removal of said lines within the aerial easement; provided
however, that no such payment will be made for trimming or removal of trees
hereafter permitted to be grown within the easement, nor for the removal of
buildings, structures or obstructions erected within the easement.
TO HAVE AND TO HOLD the above aerial easement and right of way unto Agency,
its successors and assigns, until all of such lines and supporting structures
shall have been completely abandoned and no future use of the same contemplated
by Agency,and in that event such aerial easement and right of way shall cease
and all rights herein granted shall terminate and revert to Grantor, his heirs,
successors and assigns; and Grantor hereby binds himself, his heirs and legal
representatives, to warrant and forever defend the above described aerial
easement and right of way unto Agency, its successors and assigns, against every
person whomsoever lawfully claiming or to claim the same or any part thereof.

In by and between EXXON PIPELINE COMPANY, hereinafter called "EXXON,"
and THE CITY OF COLLEGE STATION, TEXAS, hereinafter called "THE CITY."
WHEREAS, EXXON is the present owner of the rights of way and
easements by instruments listed on Exhibit "A" attached hereto and made
a part hereof; and

WHEREAS, THE CITY has requested permission -to construct 138 KV and
12.5 XV single pole construction electric transmission and distribution
lines and related facilities along and within a portion of EXXON's
rights of way and easements across the lands covered by the instruments
listed on Exhibit "A ";
NOW, THEREFORE, for and in consideration of the premises and of the
covenants and conditions herein contained, EXXON, as Grantee of the
in listed on Exhibit "A ", consents to the construction of said
electric transmission and distribution lines and related facilities
along and within a portion of EXXON'b rights of way and easements, only
insofar as EXXON has the right to grant such consent, and subject to the
following conditions:
11) No rights held by EXXON by virtue of the instruments
listed on Exhibit "A" shall be subordinate, in-
ferior, or subject to any easements acquired by THE
CITY, except as expressly provided herein.
(2) Except in the case of prior written consent of
Exxon, the transmission and distribution lines shall
be constructed so that all poles, structures,
anchors, or guy wires shall be a minimum of ten feet
(10 distance from and on the easterly side of
EXXON'; No. 3 eight -inch crude oil pipeline, said
pipeline being the most easterly pipeline located
within EXXON's easement listed on Exhibit "A ".
(3) It is further agreed that two of the three proposed
I insulator arms will be located on the northeast side
t of the transmission and distribution lines' support
i poles.

(4) it is also understood and agreed that EXXON is now
using and will continue to use said lands as pipe-
t line rights of way and casements in accordance with
the terms and conditions granted to EXXON by the
instruments listed on Exhibit "A ", and in the event
that said transmission and distribution lines and /or
related facilities should ever interfere with
EXXON'S exercise of its sights, including, but not
limited to the right to lay, maintain, operate,

ope'rate Cathodic Protection Unit, consisting of cables, conduits,
pipelines, ground'•beds; poles and guy wires as shown on Exhibit "A" attached
hereto and made'a.part•hereof, upon or under the following described land
situated in Brazos County; Texas, to -wit:

together with the.rights,of'ingress and egress to and from said unit: or device
or any of the apparatus or equipment in connection therewith, for the purposes
aforesaid. Grantors to have the right to fully use and enjoy the above described
premises, except as to the rights hereinbefore granted; and Grantee hereby
agrees to pay a reasonable. sum for any actual damage which may be done to crops, •.
fences, pasture or buildings of said Grantors from the exercise of the rights
herein granted.
All fences of Grantor cut be Grantee during installation of the Cathodic
Protection equipment shall be repaired by Grantee at Grantee's sole expense using
materials of like kind and quality and Grantee agrees to H -brace all fences and
use temporary gaps during installation of the equipment. Grantee shall be re-
stricted to the 30' easement described under Grant of Easement recorded in Vol-
ume-505, Page 576 in the Deed Records of Brazos County, Texas for ingress and
egress during installation of the equipment. Grantee further agrees to restore
easement to its original condition as near as reasonably pratical after installa-
tion of the equipment as shown on Exhibit "A" attached hereto and made a part
hereof. Grantee shall clean up�all.trash and debris from the right of way and
agrees not to bury any trash within the right of way.
Grantee will notify landowner 24 hours prior to installation of the
Cathodic Protection equipment.
The guy wire, power pole, and annode junction box shall be placed in the
fence line.as shown on Exhibit "A" attached.hereto. There shall be no above-
ground structures.on this tract of land other than the service pole, guy wire
and annode junction box.
TO HAVE AND TO HOLD said easement, rights, and privileges unto the said Grantee,
its successors and assigns until said easement be exercised, and so long thereafter
as the same shall be useful for the above named purposes_
This agreement is binding upon the heirs, executors, administrators, successors
and assigns of the parties hereto.

or any of the apparatus or equipment in connection therewith, for the purposes
aforesaid. Grantors to have the right to fully use and enjoy the above described
premises, except as to the rights hereinbefore granted; and Grantee hereby
agrees to pay a reasonable. sum for any actual damage which may be done to crops, •.
fences, pasture or buildings of said Grantors from the exercise of the rights
herein granted.
All fences of Grantor cut be Grantee during installation of the Cathodic
Protection equipment shall be repaired by Grantee at Grantee's sole expense using
materials of like kind and quality and Grantee agrees to H -brace all fences and
use temporary gaps during installation of the equipment. Grantee shall be re-
stricted to the 30' easement described under Grant of Easement recorded in Vol-
ume-505, Page 576 in the Deed Records of Brazos County, Texas for ingress and
egress during installation of the equipment. Grantee further agrees to restore
easement to its original condition as near as reasonably pratical after installa-
tion of the equipment as shown on Exhibit "A" attached hereto and made a part
hereof. Grantee shall clean up�all.trash and debris from the right of way and
agrees not to bury any trash within the right of way.
Grantee will notify landowner 24 hours prior to installation of the
Cathodic Protection equipment.
The guy wire, power pole, and annode junction box shall be placed in the
fence line.as shown on Exhibit "A" attached.hereto. There shall be no above-
ground structures.on this tract of land other than the service pole, guy wire
and annode junction box.
TO HAVE AND TO HOLD said easement, rights, and privileges unto the said Grantee,
its successors and assigns until said easement be exercised, and so long thereafter
as the same shall be useful for the above named purposes_
This agreement is binding upon the heirs, executors, administrators, successors
and assigns of the parties hereto.

to use existing roads across the adjacent lands of the GRANTORS for the purpose of ingress and egress or con-
structing, inspecting, repairing, replacing, cr removing the property of the GRANTEE located thereon at the will
of GRANTEE.
GRANTORS shall have the right to use the surface of the easement conveyed hereby for agricultural pur-
poses, pasturage, or other purposes (exclusive of the impoundment of water over the pipelines) not inconsistent
With the use of the GRANTEE.
It is further agreed as follows:
1 . That GRAN7EE will bry the
surface of the g ound*,excepl that inches of cover will be sufficient where blasting would be equired
to attain a greater cover;
2. GRANTEE will pay for any damage to GRANTORS' livestock during the construction of any pipeline laid
hereunder and will further pay forany damage to GRANTORS' livestock, crops, grasses, trees, shrubbery,
fences or buildings caused by the operations or activities of the GRANTEE subsequent to the laying and
constructing of any pipeline hereunder,
3. That GRANTEE will, insofar as practicable, smooth and level all of the ground disturbed by the laying,
constructing, repairing, maintaining, replacing, or removing of each pipeline and will construct and
maintain such spreader dams and other soil conservation devices on the above described and adjacent
property of GRANTORS as rr,ay be reasonably required to prevent damage to the property of GRANTORS,
their successors and assigns, from soil erosion resulting from operations of GRANTEE hereunder,
a. This grant is expressly subif:ct to all rights of the owners of the oil and gas and minera estate (including
oil, gas and mineral lessees) in such land and is further subject to all easements and right of ways
now in force and of legal record covering all or any part of said land;
5. if at any time after three years from the date hereof, GRANTEE, should abandon the use of all pipelines and
appurtenances constructed upon said land and if such abandonment of use should continue for as long
as one year, all rights of GRANTEE hereunder ipso facto terminate and revert to GRANTORS, their suc-
cessors and assigns.
S. GRANTEE': shall have the ritjht to assign this easement in whole or in part but shall remain.liable for the
payment of damages as above provided until released in writing from such obIT-gatior,

being the remainder of a called 120 acre tract as described by a Deed to Dolly Dymple Creagor
Olden recorded in Volume 168, page 339, Deed Records of Brazos County, Texas.
Said tract being more particularly described by metes and bounds as follows:
BEGINNING at a 1/2 inch iron rod found at the intersection of the southwest line of Rock Prairie
Road and the northwest line of William D. Fitch Parkway marking the east corner of said 120 acre
tract;
THENCE S 41 52' 08" W along the northwest line of William D. Fitch Parkway for a distance of
2245.72 feet to a 5/8 inch iron rod set marking the south corner of said 120 acre tract and the east
