1. There are no overhead electric lines on the interior of the development, there are no utilities located in this area...we
are constructing a granite gravel trail. These easements are not exclusive to BTU. It is common occurrence for any
encroachments constructed in easements to have potential damage should said easement be utilized in the future by
a utility provider and we are fine with that....we just loose a little gravel.
2. Fencing is dealt with in the deed restrictions and any fencing request is subject to Architectural Control Committee
review and approved on a case by case basis. I'm not sure why we have to detail the purpose of an HOA easement
since such use is discretionary on behalf of the HOA, just like the HOA easements on all the plats at Indian Lakes.

We have two concerns regarding your request at this time:
1) The PUE is mainly utilized for overhead electric. You need to make sure BTU is okay with additional incumbrance and
provide documentation from BTU to this regard.
2) Fencing - Should a note be added to the plat addressing placement of fencing in this area? Note should also be added to plat
defining the HOA Easement and its purpose.
Otherwise, we're okay with the change happening before the filing of the plat.

We are starting construction on Duck Haven Phase 4 on Monday. We need to adjust the approved Final Plat as shown on the

attached drawing. The plan is to overlay a HOA easement on top of the PUEs as shown for the purposes of trail connectivity to
our park. Can we just adjust the easement labeling from "20' PUE" to "20' PUE & HOA Esmt" prior to filing the plat since no
increases to the encumbrances will occur on the Tots? I'd hate to have to go through the whole submittal and review process
again just for this minor alterations.
Let me know if this is possible.

I reviewed the above - mentioned final plat application and determined it to be incomplete. The
following is a preliminary list of items needed to complete the submittal so that staff may
conduct a thorough review. Please submit the following information by any Monday at 10 a.m.
for review that week:
A completed current Final Plat application. Current applications may be found at
http: / /www.cstx.gov /home /index.asp ?page =401 or in the Planning &
Development Services office.
Proof of signature authority (ie: power of attorney) for Duck Haven, Ltd.
