Applicant: Alan Hixon, President - Freebird's World Burrito
Item Summary: The applicant is requesting to implement a color scheme for each of
the facades that is not on the approved color palette.
Item Background: Freebirds World Burrito is proposing to construct a new,
freestanding location near the northwest corner of SH 6 and University Drive East,
immediately north of the Chicken Express restaurant. The requested color scheme
would be applied as a texture to simulate EIFS or stucco. As required by the Non -
Residential Architectural Standards, the building's facades will also employ fired brick,
and metal (clear anodized) will be used for the aluminum /glass storefront and canopies.
Although these materials conform to these standards, samples will be available during
the meeting for review in conjunction with the requested color scheme.
Issues /Items for Review:
Section 7.9 of the Unified Development Ordinance requires that "all building facades
and roofs shall consist of only colors from the color palette approved by the City Council
as amended by the DRB ". The applicant is requesting an alternate color scheme that is
consistent with the following parameters:
1. The applicant is a franchised and /or chain restaurant to be developed as a single
detached building (not integrated into a multi- tenant building); and
2. The proposed colors /materials are part of its corporate branding; and
3. The applicant provides all of the alternative color /materials schemes the chain or
franchise has used.
The DRB may grant a variance from the standards contained in Section 7.9 of up to
75% of the total percentage permitted.

Freebirds World Burrito has been in business since 1 990 and now has 12 stores located
• • throughout Texas- As most of you know if you have eaten at a loci! Freebirds restaurant,
that our establishment has long been known for its eclectic look and feel with our
"skyscape ", choppers, Lady Liberty and often recycled brick interior decorations. All of our
stores to date have been located 'within multi - tenant facilities and our design elements
have been limited to the interior of these sites. You will - note in photos 1 -4 that all of our
store interiors have incorporated this Freebirds inherent trade dress of the '`skyscape ", and
although not trademarked, this look has even been successfully defended in trade dress
litigation:

You will note that in photos 5 and 6 this "skyscape" motif has even been used on
attached signage as well as on our new mobile signage.
We are venturing into our first freestanding building in College Station located in the
Gateway Shopping Center on University Drive at the SH6 Bypass. This site is situated to
the north of the Chicken Express restaurant within that center, It is Freebirds desire to
utilize this same trade dress color and motif on this, our FIRST freestanding building, as
seen on the attached elevations. Freebirds is currently working on the design of several •
other freestanding stores in other cities and it is our intent that all of these stores will have
this same exterior look.

will be the talk o•the town. As the Gateway Shopping Center is currently designed there
is no .overwhelming color or architectural scheme like other shopping centers such'as the
Kroger Signature ,Center. The Gateway contains the Exxon Station & Carwash, Chicken:
Express, Olive, Garden, Home Depot, Cheddars, Rockfish, Texas Roadhouse', Wings,`TC
Custom Home Design Center and the Talbots center all of which have used various
themes, materials, and colors. We feel that our store will fit well within this mix of u'ses
and colors and will be asset to the shopping center.
We have always been proud of the fact that College Station is home to the World
t, Headquarters" of Freebirds World Burrito and look forward to contributing one more fun
