According to the Unified Development Ordinance Section 3.15, the Administrator has the authority to authorize adjustment of up to 10 percent from any numerical zoning standard set forth in Articles 5, 6, or 7 of the Unified Development Ordinance. To approve the application for an administrative adjustment, the Administrator shall make an affirmative finding that specific criteria, as outlined in Section 3.15.E of the Unified Development Ordinance, have been met. The Administrator has found that: Granting the adjustment will ensure the same general level of land use compatibility as the otherwise applicable standards because amount of the adjustment is negligible and will not significantly alter the intensity of the land use; Granting the adjustment will not materially or adversely affect adjacent land uses or the physical character of uses in the immediate vicinity of the proposed development because the number of parking spaces have significantly been • Page 2 September 9, 2005 increase on this site with this redevelopment plan and historically, this parking lot has never been fully utilized; and Granting the adjustment will be generally consistent with the purposes and intent of this UDO as the reduction of the number of parking spaces for this property will have improved intemal circulation, and the ability to fulfill all landscape requirements that would otherwise not be able to be met. They have changed the location of their dumpsters since their last submittal, and I wanted you to get a look at them before I send back comments. Not shown on the copies I'm sending are their entrances on Valley View and FM 2818. There is an entrance from Longmire which is shown. Please let me know if these locations will work for you guys. Additionally, I've told them that all approaches would have to be paved to fire lane standards, with their current layout, that's going to be pretty much the entire site behind the building, correct? I have not been out to the CS Shopping Center site in awhile. Currently, some of the structures have temporary Certificates of Occupancy pending the completion of the landscaping, and the removal of any outdoor sales materials on the property that are not located behind a screening fence. The last time I was at the site (about a month ago) the wood fencing by the Tractor Supply had not been constructed, nor had any landscaping been put in, and most of the beds were filled with construction debris of which the removal should have been placed as a condition on the temporary certificates of occupancy.. I believe I have seen Prince Irrigation out at the site, so the landscaping may have been placed since my last inspection, so please disregard that condition if the landscaping plan has been met. Please feel free to contact me or Chris Haver, our Building Official, about any of these outstanding issues on the Temporary Certificates. I will be available most of the day tomorrow before 1 pm. Many of these islands will are scheduled to have plantings. The islands should have soil that a plant could actually survive in, not construction debris. For islands that will be compacted and paved with decorative stone or paving, this would not apply. • No access easement or parking agreement with Mr. Perry has been provided to this office, and a CO should not be issued until this is resolved.
