Veronica,
As we discussed briefly on Wednesday, the project in question is resulting in the creation of a new lot and thus
requires compliance with the subdivision provisions of the UDO, among others, this includes right of way
dedication and construction of sidewalks. In response to the concerns /issues you raised regarding the ROW
dedication (TxDOT requirement for environmental clearance, etc), we are comfortable with the plat simply
dedicating the ROW to the public, not specifying dedication to TxDOT, then when it comes time for TxDOT to
use the ROW, we can deal with the clearance issue at that time. Regarding the sidewalk issue (applicant not
prepared to construct sidewalks at this time), I am suggesting that he seek a partial waiver where the
construction of the sidewalks remains a requirement but where the actual construction is deferred until further
platting or site plan/building permit application for new construction (more than just a tenant finish -out). We are
prepared to support such a partial waiver request. Obviously, this will be dependent upon P &Z approval, but I
am confident that we can arrive at something that works for everyone in this case.

RE: Waiver Request for Sidewalk Construction on Randall's University Park Replat
Dear Morgan,
As you are aware, my client desires to sell off the outbuilding on the Randall's property. We do
not plan to construct anything with this replat. It truly is simply creating a new property line on
the ground. As such, we would like to request a waiver to the construction of the sidewalk at
this time. We would expect the sidewalk requirement if we had construction equipment on site.
The sidewalk cost will be approximately $48,000, including design costs, simply to sell off the
existing outparcel building. Our waiver request is to the timing of this sidewalk construction.
We respectfully request that this construction be delayed until such time as the existing
buildings are expanded to their exterior or any new buildings are added to the site.
