AN ORDINANCE REZONING A TRACT OF LAND TOTALLING 7.2 ACRES, LOCATED
IN THE J.E. SCOTT SURVEY ABSTRACT NO. 50, BEING 3775 F&B ROAD, IN COLLEGE
STATION, BRAZOS COUNTY, TEXAS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
PART 1: That the City of College Station Zoning Ordinance #1638, more specifically the
Official Zoning Map, be amended as set out in exhibits "A ", `B ", and "C" attached
hereto and made a part of this ordinance for all purposes.
PART 2: That if any provisions of any section of this ordinance shall be held to be void or
unconstitutional, such holding shall in no way affect the validity of the remaining
provisions or sections of this ordinance, which shall remain in full force and effect.
PART 3: That any person, firm or corporation violating any of the provisions of this chapter
shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be
punishable by a fine of not less than Twenty -five dollars ($25.00) nor more than Two
Thousand dollars ($2000.00). Each day such violation shall continue or be permitted
to continue, shall be deemed a separate offense. Said Ordinance, being a penal
ordinance, becomes effective ten (10) days after its passage by the City Council, as
provided by Section 35 of the Charter of the City of College Station. ,

That the Official Zoning Map of the City of College Station, and part of Zoning Ordinance #1638,
is hereby amended as follows:
The following property is rezoned from R -1 Single Family Residential to C-1 General
Commercial:
A 7.2 acre tract described by metes and bounds in the attached Exhibit `B" and shown
graphically in Exhibit "C ", out of the J.E. Scott Survey Abstract No. 50, being 3775
F&B Road in College Station, Brazos County, Texas
Rezoned with the conditions that access be taken from FM2818 or that F&B Road road
be improved from the western property line of the subject tract to FM2818, providing
adequate capacity for the development proposed Utility concerns will have to be
addressed at the time of development through providing adequate facilities and/or
obtaining variances before permits can be issued

FIRST TRACT:
Being a part of the Joseph E. Scott Survey, Abstract No. 50, and being more fully described by metes and bounds as
follows:
BEGINNING at the most westerly comer of the 1.38 acre tract of land sold Norris S. Burt by W. B. Hill and wife,
Lucille Hill, by decd dated February 3, 1953, and recorded in Volume 158, Page 149 of the Deed Records of Brazos
County, Texas;
THENCE S 45° E approximately 1041- 66/100 feet to a point in the South or Southeast line of the 5 acre tract of land
sold W. B. Hill by John H. Stockton and wife, Inez M. Stockton, by deed dated December 1, 1952, and recorded in
Volume 157, Page 88 of Deed Records of Brazos County, Texas, said point being the most southerly corner of the
Norris S. Burt tract;
THENCE S 45° at 150.73 feet pass the most southerly corner of the above mentioned five (5) acre tract of land sold
to W. B. Hill and continuing 57.6 feet to the most southerly comer of the 1.38 acre tract of land sold W. B. Hill by John
H. Stockton and wife, Inez M. Stockton, by deed dated February 6, 1953, and recorded in Volume 158, Page 150 of
the Deed Records of Brazos County, Texas;
THENCE N 45° W a distance of 104 1 - 66/100 feet to a stake for corner in the boundary lint of the Jones Bridge, Brazos
County Public Road, said point being the most westerly corner of the 1.38 acre tract sold to W. B. Hill;
THENCE N 45° E with said boundary line of said road 208.33 feet, passing at 57.6 feet the most northerly corner of
the 1.38 acre tract of land sold to W. B. Hill to the PLACE OF BEGINNING and containing approximately five (5)
acres of land, more or less, and being all of the 1.38 acre tract of land sold W. B. Hill by John H. Stockton and wife by
deed recorded in Volume 158, Page 150, Deed Records of Brazos County, Texas, and all of the five (5) acre tract of
land sold W. B. Hill by John H. Stockton and wife by deed recorded in Volume 157, Page 88 of the Deed Records of
Brazos County, Texas; SAVE AND EXCEPT that part of the said five (5) acre tract heretofore sold to Norris S. Burt
and being the same land described in a correction decd from W. B. Hill and wife, Lucille Hill to Elmer A. Cox and wife,
Patsy Ruth Cox, dated June 26, 1957.
SECOND TRACT:
Being a part of the Joseph E. Scott Survey, Abstract No. 50, and more particularly described by metes and bounds as
follows:
BEGINNING at the most southerly corner of a 1.38 acre tract of land conveyed to W. B. Hill by deed dated February
6, 1953, and recorded in Volume 158, Page 150 of the Deed Records of Brazos County, Texas;
THENCE N 45° E along the boundary line of said 1.38 acre tract and along the boundary line of the five (5) acre tract
of land conveyed to W. B. Hill by deed recorded in Volume 157, Page 88 ofthe Deed RecordsofBrazos County, Texas,
75 varas to a stake;
THENCE S 45° E 168.8 varas to a stake for corner in the line of a 20 -foot lane reserved by John H. Stockton;
THENCE S 45° W along the line of said lane, a distance of 75 varas to a stake for comer;
THENCE N 45 W 168.8 varas to the PLACE OF BEGINNING and containing approximately2 -1 /4 acres of land and
being a part of the 26 acre tract described in deed from Martha Suber Harkey et al to John H. Stockton, dated June 4,
1938, and duly recorded in Volume 96, Page 373 of the Deed Records of Brazos County, Texas, to which deeu
reference is here made; and being the same land described in a correction deed from John H. Stockton and wife, Inez
M. Stockton to Elmer A. Cox and wife, Patsy Ruth Cox, dated June 26, 1957.
