Public hearing, consideration, discussion, and possible action on a variance request to Section 8.12 of the Subdivision Regulations and consideration of a Preliminary Plat for Spring Creek Gardens consisting of 52 residential lots on 14.024 acres at 4300 SH-6 South, approximately V2 mile north of Greens Prairie Road, west of SH-6. (04-210) Staff Planner Molly Hitchcock presented the staff report and stated that staff is recommending approval of variance and Preliminary Plat. The property was rezoned to PDD earlier this year for single-family and for C-1 General Commercial. The Commercial property is shown as a reserve tract on this preliminary plat. The plat conforms to the PDD concept plan approved by the Design Review Board. The 3.7 dwelling units per acre, is within the limits of the Land Use Plan. Parkland has been dedicated and the development fee will be due upon Final Plat. The blocks extend approximately 13-feet beyond the minimum 1200-feet allowed by the Subdivision Regulations. The developer has proposed access ways that encourage pedestrian movement, but a variance to the actual block length is necessary for the plat to proceed. Chairman Shafer opened the public hearing. Wallace Phillips, the developer, stepped before the Commission. Mr. Phillips spoke in favor of the variance and Preliminary Plat. Chairman Shafer closed the public hearing. Commissioner White made the motion to approve the block length variance. Commissioner Fedora seconded the motion, which passed (6-0). FOR: White, Fedora, Shafer, Reynolds, Hooton & Nichols AGAINST: None ABSENT: Davis Commissioner Fedora made the motion to approve the Preliminary Plat.
