If no such represent at ive is a member of the commission , o ne such represe nt at ive mu st be appo int ed as an ad hoc voting member of the commission w hen acting as an adv isory committee . If the impact fee is applied to the ETJ , the membership must include a representative fro m that area. One (1) or more ad hoc m embers may be appointed as needed or desired t o review impact fee land use ass umpti ons a nd capital imp rovements plans and to perform s uch other duties in accordance with C hapter 395 of th e Texas Local Government Code. Members se rves a 3 -year term as stated in the U DO. B-7. Joint Relief Funding Review Committee (3-year terms -term limited) Auth ority • Per City Council Resolution No . 5-26-88 -1 2. Summ ary • The City of Co ll ege Statio n and the Ci ty of Bryan annu a ll y receive Co mmunity Development Block Grant (CDBG) funds from the U.S. Department of Housing and Urban D eve lopment. The two c iti es es t a bli sh ed the Joint R eli ef Fu ndin g R ev iew Co mmittee to rev iew all fund in g requests from charitable or any other assistance type agenc ies , public or private , to the two cities. T h e committee makes recommendations to the city counc il s of the two cities. Membership & Term s • T he JRFRC is made up of three Counci l-appo int ed volunteers from each city. Each m ember serves for a three-year term w ith a two-term maximum. B-8. Parks and Recreation Advisory Board (3-year terms) Auth orit y • Per City Ord in anc e No. 1137 , ad opted Nov. 9 , 1978 , as amended . S ummary • The Parks and Recreation Board ex ists to adv ise the Council on a ll matters concerning the estab li shment , maintenance, a nd operations of a ll parks within the C ity of Col lege Stat io n . T hi s board a lso gives advice regarding the estab li shment and operation of recreation programs co nduct ed by the c it y for it s citizens. T he board cani es out a ll other d uti es and responsibilities as may be assig ned by the Counci l. The board is a uth orized to estab li sh its own rules , regulations , and bylaws s ubj ect to ratificati on by the Co un cil. Membership & Term s • The Parks and Recreation Board is composed of nin e members. T he term of office for the board is three years. 5 C. Decision-Making Boards and Commissions Defined. Planning and Zoning Commission (3-year terms -term limited) Authority • Per Texas Local Governme nt Code 211.007 , and C it y Ordinance No. 682 , adopted March 23 , 1989 , as amended. Summary • The Planning and Zoning Commission serves as a review body to recommend changes in development codes and the zoning ordinance to the Council. The commission prepares, adopts , and modifies a comprehensive plan for the City for subsequent approval and adoption by the Council. • The commission prep are s subdivision regulations and zoning ordinances , and amendments thereto for recommendation to the Counci l. The commission also makes studi es and recommendations with regard to proposed annexations. The commission has final authority over all plats s ubmitted to th e City . In addition , the commission performs other duties as assigned by statute and the Council. Membership & Terms • The Planning and Zoning Commission consists of seven members appo inted by the Council. Members must be resid ents and qualified voter s of the City Terms of office are limited to two consecuti ve thre e -year terms or s ix consecutive years. C-4. Zoning Board of Adjustments (2-year terms) Authority • Per Texas Loca l Gov ernment Code 211.008 and City Ordinance No. 850 , adopted March 13 , 1972 , as amended. Summary • The Zoning Board of A djustm ent hears and decides appeals for int erpretations , special exceptions, and varianc es to the term s of the zo ning ordinance as well as use permits, and other duties as outlined in the ord in ances and statutes from whic h it is created. Membership & Terms • The Zoning Board of Adj ustm e nt s consists of five members who must be residents and qualifi ed voters of th e city. The Council may appoint up to four alternate members. Members and alternate s se rve two-yea r terms. 7 D. External Boards with Council-Appointed Representatives . (Citizen Members) These Boards are advert isab le for externa l boards with Co uncil-Appo int ed Representatives that h ave citize n member s se rv e on: Aggi eland Humane Soc i ety Board of Directors Arts Cou nc il of the Brazos Valley Board of Directors Brazos Valley Eco nomic Development Corpora tion Board of Directors Brazos Valley Sol id Waste Management Age ncy Board of Directors Regional Mobility Authorit y Board of Directors Spring Creek Local Government Corporation D-1. Aggie/and Humane Society Board of Directors (2-year terms) The Board of Directors consists of fifteen (15) voting members , two of whom are appointed by the College Station City Council and who may be a citizen, e mpl oyee, officer, or elected offic ial of the City of College Station. These appointments are auto maticall y removed from the board with the position suspended and left vacant if the City do es not contract with the Aggieland Humane Society, Inc. for animal housing services. Members may serve no more than three consecutive two-year terms. Traditionally, the Council has appointed one PD Officer who supervises the City 's animal contro l function and is in close communication with she lt er operations on a regular basis. D-2. Arts Council of the Brazos Valley Board of Directors (3-year terms) The Board of Directors consists of no less than twelve , nor more than seventeen, members three of whom are appointed by the Co ll ege Station City Counci l. Member may serve no more than two consecutive three-year term s. Traditionally, Counc il has appo inted one council member, and the Arts Council recommends two citizens for the Council to consider. D-3. Brazos Valley Economic Development Corporation Board of Directors (3- year terms) The number of board members is amended periodically depending on the by laws and membership changes; however, Co ll ege Station appo int s three members of th e board to represent the city. o more than two of the three can be an elected member of City Council. Traditionally, the Council has hand-picked a local bus in ess leader to represent the City of College Station on this regional board, along with one council member and the Mayor (who serves on the both th e Board and the Executive Committee.) D-4. Brazos Valley Solid Waste Management Agency Board of Directors (3-year terms) The Board of Directors consists of seven members , three of whom are appointed by the Co ll ege Station City Council. At least one of three members mu st be a council member. Traditionally, the Mayor serves on the board with one council member. The two then recommend a citizen to the Council for appointment to the third position. 8 D-5. Regional Mobility Authority Board of Directors (4-year terms) The Board of the Authority is composed of five directors. The Brazos County Commissioners Court appoints four directors with Texas A&M University , the City of Bryan and the City of College Station each recommending one director to the Commissioners Court. Representatives may not be elected officials , non-residents , TxDOT emp loyees, government employees (city , county , TAMU), or a property owner whose land may be acquired. The directors serve four-year terms. D-6. Spring Creek Local Government Corporation (2-year terms) The Board of Directors consists of five persons appointed by the Council. Each director must be a resident and qualified voter of the city. The Mayor serves as a director and as president of the board . Th e remaining directors may be members of the Council , City officers or emp loyees , or residents of the city whom the Co uncil determines have a special knowledge or expertise that wou ld be beneficial to the corporation , such as a banker or realtor. If a director ceases to be an e lec t ed official, officer or employee of the City , or a r es ident of the C ity, he or she sh all be disqualified from serv in g as a director. Otherwise , each director serves a two-year term of office. No director may serve lon ger than six years consecutively. 9 CHAPTER II BOARD, COMMISSION, AND COMMITTEE APPOINTMENT PROCESS Application Process. Citizens interested in serving on a Board , Commission, or Committee can obtain an applicat ion through a link from the City of Co ll ege Station 's website , https ://c stx.gov/departments city hall/committees. You wi ll submit the completed application through the website. Applications are va lid for one (1) y ear, after which a new application must be submitted Appointment Process. The C it y of Co ll ege Stat io n C it y Co uncil makes appointments to the City Co ll ege Stati o n Boards , Commissions, o r Committees. The Ci ty Counci l considers app licati ons to these boards during the regular City Counci l meetings at the beginning of eac h ca lendar year, unless there are vacancies that arise. Notice of Appointment. After the City Council appo int s a person to serve as a member of a Board , Co mmi ssio n , and Committee, the C it y Secretary will notify the appointee by ema il or othe r formal correspondence of the appointment. Generally , the City Co uncil will appoi nt members to no more than two (2) or three (3) consecutive terms of serv ic e o n a si ng le board. Some excepts may accrue if the board has a longer-term limit. Eligibility and Qualifications. The Co ll ege Station City Council seeks qualified persons to serve on Boards, Commissions, and Committees. Qualified app licant s must be residents of Coll ege Station for one (1) year and must be registered voters of the City , unless otherwise provided by ordinance. Certain Boards, Commission s , and Comm ittees have additional e li gibi lity requirements. Nepotism. Article XII General Provisions, Section 118 , of th e City of Coll ege Station C h arter provides that no person related within the second degree of affinity , or within the third degree of consanguinity , to members of the City Council or the City Manager shall be appointed or emplo yed to any office, position , or servic e in the City. Oath of Office . Upon appoi ntm ent, an oath of office is administered to a ll newly and/or reappointed m embers of Boards, Commissions, and Com mittees. The oath of office can be adm ini stered by the C ity Secretary or designee. Open Meetings Act Training. It is an honor to be selected as a City Board , Committee, or Commission member, and it provides an unusua l opportunity for genuine public service. Although specific duties of each body vary widely , there are certain responsibilities that are common to a ll m embers. The fo llo wing is a summary of those respon s ibilitie s: 1. Members shou ld understand the role and scope of their responsibiliti es and should be in fo rm ed of the individual Board , Committee, or Commission 's purpo se and of its operating procedures . 2. Members should be carefu l to represent the majority views of th eir individual Board , Commission, or Committee , or Commission. Individual "opinions" to the public and press should be identified as s uch . 3 . Members shou ld represent the public interest and not special interest groups. 4. Good communication is essential. Members are in a position to serve as li aison between the city and its citize n s and can help to reconcile opposing viewpoints and to build a consensus around common goa ls and objectives. Members serve as a communication link between the community , staff, and city , presenting recommendations and providing a channel for citizen express ion . 5. Members are enco ura ged to review their agenda packets, contact city staff with questions , and be thorough in their recomm e ndations ; if po ss ible , members may, unless otherwise prohibited , personally view s itu ations under cons id eration prior to the meeting in order to be fully prepared to discuss , evalu ate, and act on a ll matters schedul ed for consideration. Conclusions based on preparedness will strengthen the value of the group's recommendations. 6. Members are encouraged to establi sh a good work in g relationship within the gro up ; respect individual viewpoi nts; allow other members time to present their views fully before making comments; be ope n and honest ; welcome new members . 7 . Council appointments to Boards, Committees, or Commi ssions are made without regard to political party affi li ation . Members are not restricted from participating in political activiti es; however, members should not u se or involve their membership in th e conduct of political activities. Open Meetings Act. Texas law requires that every meeting of the Ci ty Co un cil be open to the public. In College Station , a ll Boards, Committees, or Commissions follow the procedures for open m ee tin gs as we ll. a. A P osted Notice is required of a m ee tin g . So m e Board , Commi ssion or Committee m embers m ay be s ubject to C h apter 171 of the Texas Local Government Cod e w hi ch prohibits a local public official w ith a s ub stanti al interest in a busi ness e ntity or in real property from participating in a m a tt e r before th e C ity involving th e bu s iness entity o r real property if it is reasonably foreseea bl e that a n act ion o n the matter before th e City w ill have a specia l econom ic effect on th e bu s iness e ntity o r on the valu e of the real property that is di s tinguishable from its effect on the public. Board, Commission and Committee m embers are enco uraged to con s ult w ith th e C ity Attorney concerning a n y potential confli cts. 14 CHAPTERV LEGAL LIABILITY Personal Liability. Board , Commission or Committee members cannot be h e ld personally liable for en-oneous acts whi le hon estly exercising the functions of th eir offices in good faith. The only time a member can be held personally liable i s when they act outside the scope of their office and in bad faith. When members of City Board s, Commissions or Committees are acting in good faith and within the bounds all owed by the City , state and federa l law , the City will provide a defen se for such members to the greatest extent permi ss ible . However, if a Board , Commission or Committee member acts illegally , unlawfully , or willfu ll y , or acts intentionally malicious , negligent or in violation of the policies of the City Council while serving in his/her official capacity , the City may decide not to provide that member a defen se. Board Liability. A City , its officers, and members of boards , commissions, or committees as a governmental entity, must treat all individuals or groups in th e same manner unless there is a compelling governmental interest to treat someone or some group differently. Therefore, the City Attorney should be consulted concerning whether or not an individual or group can be treated differently . If an officer or Board, Commission, or Committee member illegally discriminates against an individual or group , that individual or group can seek damages from the City and from the individual officer for a violation of rights under the state and federa l civil rights statutes. The above discussion is by no means intended to be a comprehensive and complete discussion of legal liabilities to which the City or Board, Commission, or Committee member may be subjected. Board, Commission, or Committee members are strongl y encouraged to consult with the City Attorney anytime they fee l their actions whi le serving on such Board , Commission , or Committee may have some legal consequences . AGENDA ITEM NO. 1: Call to Order and consider absence requests. Chairperson Cunha called the meeting to order at 3:01 p.m. There were no absence requests for consideration. AGENDA ITEM NO. 3.1: Consideration, discussion, and possible action to approve meeting minutes. Board Member Langlotz motioned to approve the minutes from November 15, 2021. The motion was seconded by Board Member Jansen and minutes were approved ( 4-0). AGENDA ITEM NO. 3.2: Presentation and discussion regarding the Bicycle, Pedestrian and Greenways Advisory Board calendar of upcoming meetings. • Monday, February 21, 2022, at 3:00 p.m. • The meeting will be held in person. AGENDA ITEM NO. 3.3: Presentation, discussion, and possible action regarding a recommendation on sidewalk project priorities. Ms. Garza presented an overview of the list of sidewalk projects based on the Board's desire to further prioritize the top list of projects. There was general discussion amongst the Board regarding the level of priority for certain items. The Board suggested to keep items in the same order with the following change: Page 3 of 5 • #11 Foster Avenue 1 -Move up to #2 on the list. Since sidewalk improvements have already been added to the City Hall site and there are a lot of bikers and walkers that use the corridor. AGENDA ITEM NO. 3.4: Presentation, discussion, and possible action regarding National Bike Month and the Cycle with Council event. There was general discussion amongst the Board regarding the date and potential bike route for the event. Some suggestions included: • The preferred event date is May 21st, if possible, based on park availability. Other dates mentioned in priority order -May 7th then May 29th. • Goals: o Raising awareness, safety and education including: • Bicycle safety checks -possibly with local bike shops • Helmet expiration education • Signage along the route • Introducing new locations with varied rides each year • Have about a 5 -mile loop with an inner loop for younger riders • Reach out to the following to increase participation : o Bicycle shops o Schools o College Station Police Department o Food trucks? • Bike routes discussed and considered: o Around Wolf Pen Creek Park and Central Park o Starting at City Hall o Starting at the Scott and White Parking lot to Lick Creek Greenway Trail • The date for the proclamation needs to be determined.
