H.B . No . 1147 AN ACT relating to notice by a governmental entity regarding certain geospatial data products. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS : SECTION 1. Chapter 2051 , Government Code , is amended by adding Subchapter D to read as follows : SUBCHAPTER D. GEOSPATIAL DATA PRODUCTS Sec . 2051 .101 . DEFINITIONS . In this subchapter : (1) "Geospatial data product " means a document , computer file , or Internet website that contains : (A) geospatial data ; (B) a map ; or (C) information about a service involving geospatia l data or a map . ( 2) "Governmental entity " has the meaning assigned by Section 2051 .041 . ( 3) "Registered professional land surveyor " has the meaning assigned by Section 1071 .002 , Occupations Code . Sec . 2051 .102 . NOTICE REQUIRED . (a) A governmental entity shall include a notice as provided by this subchapter on each geospatial data product that : (1) is created or hosted by the governmental entity ; Page -1 - H .B . No . 114 7 (2) appears to represent property boundaries ; and (3) was not produced using information from an on -the- ground survey conducted by or under the supervision of a registered professional land surveyor or land surveyor authorized to perform surveys under laws in effect when the survey was conducted . (b) The notice required under Subsection (a) must be in substantially the following form: This product is for informational purposes and may not have been prepared for or be suitable for legal , engineering , or surveying purposes. It does not represent an on -the-ground survey and represents only the approximate relative location of property boundaries. (c) The notice required under Subsection (a) may : ( 1) include language further defining the limits of liabi l it y of a geospatial data product producer ; ( 2) apply to a geospatial data product that contains more than one map ; or ( 3) for a notice that applies to a geospatial data product that is or is on an Internet website , be included on a separate page that requires the person accessing the website to agree to the terms of the notice before accessing the geospatial data product . Sec. 2051 .1 03. EXEMPTION . A governmental entity is not required to include the notice required under Section 2051 .102 on a geospatial data product that : Page -2 - ' ./ ' > H .B . No . 1147 (1) does not contain a legal description , a property boundary monument , or the distance and direction of a property line ; (2) is prepared only for use as evidence in a legal proceeding ; (3) is filed with the clerk of any court ; or ( 4) is filed with the county clerk . SECTION 2 . For geospatial data products that are printed documents , Section 2051 .1 02 , Government Code , as added by this Act , applies only to a document printed on or after the effective date of this Act . A document printed before the effective date of this Act is governed by the law in effect on the date the document was printed , and the former law is continued in effect for that purpose . A portion of this BPO is used for citizen requested pedestrian mobility improvements, i.e . ramps, but the bulk of the BPO is used to repair concrete curb and gutter and sidewalks . This BPO m ight be used for sidewalk extension projects, if no surveying and engineering are required, but pedestrian signals and push buttons are outside the scope of this allocation. Gary may be able to assist, on a case by case basis, with concrete work if it would help to leverage grant funds . He is the program manager and would have to approve any expenditure . You may want to set up a meeting with Gary, Troy, and Lee to discuss. The project we are looking at is for pedestrian improvements to an intersection but are having a hard time not go ing over budget and are looking for ways fund the remainder. I just wanted to follow -up with my notes from the meeting to make sure I didn't miss anything or mis-state anything . Sidewalks • Project ideas are originated from the Bike, Ped Greenways Plan, Neighborhood Plans, ADA Transition Plan, Safe Routes to School projects, maintenance and operations staff, citizen requests, etc. • Once project ideas are orig inated they will be forwarded to Venessa who will prepare CIP project sheets for each -note this will include new CIP projects and also projects to be funded through the "mother fund". • Venessa will (in the development of the project sheets) take the first stab at prioritizing projects and then the CIP review process/committee will finalize the prioritization on an annual basis. Criteria for ranking these projects w ill need to be tweaked a bit to recognize the uniqueness of these types of projects (such as requests affecting a citizen with a disability getting a higher priority). • Projects will be delivered through two methods: o CIP will generally deliver projects that involve "eng ineering" such as SR2S projects, major new sidewalks, etc. o PW will generally de li ver projects (through its standing flatwork contract) that are more "fill in the gaps" or repair/replace projects not involving "engineering" • PW will be leading the effort on compiling our current ADA efforts into the development of a transition plan. Once complete this will include a series of projects to be considered (along with the neighborhood plans, Bike, Ped, Greenways plan, etc). • Venessa will provide a sidewalk inventory map at some point in the near future (much of this was completed as part of BPG plan)-this inventory will identify the location of existing sidewalks and at some point the condition of those sidewalks (this will also be tweaked as we do neighborhood plans). • In general, funds have been committed for FYll (Lincoln Street sidewalk and "mother fund "). Howeve r, --;·_. a pri oritized project list will still need to be developed by Venessa (using a version of the above process) for the expenditure of the "mother fund" in FY l l. Bike Lanes/Routes \~ • Bike lanes and routes are striped and signed with CIP projects in accordance with the Bike , Ped , Greenways Plan . • Bike lanes and routes are striped and signed with street rehab/repair where existing and in accordance with the Bike, Ped, Greenways Plan . • We need to verify that developers are delivering streets (striping and signage) in accordance with the Bike , Ped, Greenways Plan and if not required by Ordinance to do so then amend the Ordinance/practices. • Generally, there is no funding identified to provide new bike lanes/routes outside of the above identified file://C:\Documents and Settings\vgarza\Local Settings\Temp\XPgrp wise\4BD2BAEBCity ... 5/3/2010 Page 2 of2 methods.
