Mitchell and Morgan, L.L.P. 511 University Drive, Suite 204 College Station, Texas 77840 Houston, Texas 77 079 (281) 589-0898 fax : (281) 589-0007 RE : Wetland Determination and Classification Survey Letter Report 376 (±)Acres of Land Proposed as a 250-acre Class "A" Business Park Located Southeast of College Station, Brazos County, Texas BOA Job No: 3283WP01 Dear Ms. Morgan: At your request, Berg•Oliver Associates, Inc. performed a wetland determination and classification survey for potential jurisdictional wetlands loc ated for a 376 (±) acre tract proposed as a 250-acre class "A" business park. The site has frontage on State Highway 6 and Greens Prairie Road and is located southeast of College Station, Texas. The purpose of the study is to determine the approximate sizes and locations of wetlands that could potentially be classified · as "Jurisdictional Waters of the United States ." Preliminary survey methods include the following: 1) review of U.S. Geological Survey topographic maps and Natural Resource Conservation Service, local county Soil Survey maps ; 2) review of historical color, black and white, and infrared aerial photographs; 3) review of the U.S . Federal Emergency Management Agency (FEMA) flood plain maps ; and 4) site reconnaissance of potential jurisdictional wetlands. Due to the methods employed in a preliminary study, small marginal areas may not have been observed and a moderate margin of error can be expected . A wetland delineation according to the 1987 U.S . Army Corps of Engineers (USACE) Manual was not conducted. The site reconnaissance survey was conducted on June 8, 2001, by Katie Hall, Kristi McMullen, and Sarah Timmer of Berg•Oliver Associates , Incorporated. The site was assessed for the presence of "potentially isolated" and "potentially adjacent" wetlands and "Waters of the United States." Several areas were observed which have the potential to meet all criterion for the USACE's definition of a Jurisdictional Water of the United States (ie. "adjacent wetland"). The total area encom pass ed by the potential wetland areas follows : July 17, 2001 Page 2 of2 Potential Adjacent Wetland Potential Isolated Wetland Waters of the United States Stock Ponds 2 .00 (±) acres 1.36 (±)acres 1.07 (±) acres (known as Spring Creek, Lick Creek and an unnamed tributary to Lick Creek) 0.83 (±)acres (non-jurisdictional waters) The locations and sizes of these areas are depicted on the attached Wetland Determination and Classification Map. These values were derived from aerial photograph interpretation, interpretation of historical topography, soil, and flood plain data, and general field observations and measurements . This should not be considered as precise, as would data derived from a wetland delineation. This determination and classification is based upon Berg+Oliver Associates, Incorporated's assessment of the jurisdictional designation of potential jurisdictional areas identified within the subject property. Jurisdictional Waters of the United States, specifically wetlands, are regulated by the Clean Water Act (CWA) under the authority of the USACE. Based upon a January 9, 2001 Supreme Court Ruling (SW ANCC vs. USACE), isolated wetlands may not be considered jurisdictional by the USACE; however, adjacent wetlands , headwaters, tributaries, and other Waters of the U .S . remain jurisdictional. Prior to performing activities which could impact any potentially jurisdictional area, Berg+ Oliver's wetland classification and determination findings should be confirmed by the USACE. In the event project activities are proposed within jurisdictional areas, a wetland delineation and permit could be required by the USACE. Also enclosed is a Texas Atlas & Gazetteer map, USGS quadrangle map (Wellborn, TX), Brazos County Soil Survey map, and Wetland Determination and Classification Map.
