The subject property and all surrounding properties

west are developed as sorority houses . There is a
day care to the east and apartments to the south.

Sorority houses are required to have one parking
space for every person (bed) and one space for every
30 sq.ft. of meeting room. Thirty-seven residents are
in the house and a conditional use permit granted in
May 2000 allows for a 1440 sq.ft. chapter room. The
project requires a total of 85 parking spaces (37 for
residents and 48 for the chapter room).
The applicant is proposing to provide 79 parking
spaces . The applicant is seeking a variance to the
off-street parking regulations of Sorority Houses
by the amount of 6 spaces (approximately 7%).
The applicant has stated that a large tree on the lot
should be considered a special condition . The City of
College Station has approved plans for a building and
parking lot expansion for Kappa Kappa Gamma, but
those plans include the removal of a 40-inch caliper
existing white oak tree for parking . The sorority
wishes to preserve this tree and the surrounding area.
During the public hearing for the conditional use
permit last year, the applicant stated that the Forestry
Service had indicated the tree had approximately 4
years of life left .
The sorority has negotiated with the nearby day care
facility to lease fourteen of the day care's parking
spaces on Monday evenings for the next ten years.
To meet the requirements for off-site parking, parking
spaces in excess of what the day care is required
would have to be within 200 feet of the sorority house
and be dedicated as a perpetual parking easement.
The applicant has identified the loss of the tree as a
hardship.
Staff has identified the following alternatives to the
variance :
1. Possibly provide the parking elsewhere on the
site. The applicant is proposing that all proposed
parking along University Oaks Blvd. be removed.
Perhaps some (if not all) spaces could be
reconfigured in only a portion of the area, allowing
the tree to remain .
According to the city 's development standard,
trees to be protected from construction are
barricaded by a fence placed one foot away from
the trunk for every caliper inch. In this case ,

development could occur up to 40 feet from the
tree trunk .
2 . Reduce the size of the project so less parking
would be required .
The Board may grant the variance, grant a variance
less than the requested amount (0-6 spaces), or deny
the variance .
Ordinance Intent: Parking requ irements help avoid the traffic congestion
and public safety hazards caused by a failure to
provide such parking space. They also exped ite the
movement of traffic on public thoroughfares in a safe
manner , thus increasing the carrying capacity of the
streets and reducing the amount of land required for
streets, thereby lowering the cost to both the property
owner and the City.
Similar Requests: In the past five years , the ZBA has considered six
parking variances . A case involving a nightclub in a
shopping center, one about an apartment community
trying to maximize density , and one involving a
private dormitory were all denied for lack of hardship.
Two requests involving redevelopment projects and
one for a ret irement community were granted. For
the redevelopment projects , it was determined that
the existing sites presented special conditions and
hardships to the new projects. In the case of the
retirement community , it was shown that elderly
people owned and used fewer cars than in other
multi-family communities and that a thirty-year deed
restriction limited residency to the elderly. The
variance was granted for thirty years with the
stipulation that additional parking that would meet
code requirements had to be set aside undeveloped
for construction and use when the variance expired.

Mr. Gale Townstone, Pebble Creek resident , said that he was in favor of this request since it is
residential, however, he in now in opposition to it since there is talk about the access being through
Pebble Creek.
Mr. Jim Keblinger, Pebble Creek Homeowners Association President , said that he was opposed to the
development because of the access issue through Pebble Creek. He also does not want sidewalk access
to the park.
Craig Browne, Co-Developer of the project, handed the Commissioners copies of petitions turned in to
the applicant. He informed the Commission that they sent letters to the same list that the City used , and
asked whether they wanted commercial zoning or R-IB . He said that the property can remain
commercial and be sold , but the proposed residential seemed to be the highest and best use . He said
that they are not interested in PDD, the property will stay either stay commercial or change to
residential .
Commissioner Kaiser asked for comment from Mr. Browne regarding staff's recommendation to table
this item . Mr. Browne felt that most issues can be addressed , although he has concern with addressing
the access issues in conjunction with the future of Green's Prairie Road . The proposed plan allows for a
lesser density than allowed .
Sefa Koseoglu , 801 Hook Court, would rather have residential as opposed to commercial . He said that
the plans for the property make it difficult to decide if this is the right type of development. He felt this
proposal lacked pertinent information regarding access .
Manuel Martin-Rodriguez, 4601 Pro Court, also felt that there was not enough information . He is
concerned with added traffic and safety of the residents residing in Pebble Creek.
Acting Chairman Mooney closed the public hearing .
Commissioner Kaiser asked if staff knew of how many streets would access to Greens Prairie as a long
range plan . Mr. Hard said that the Lakeway extension, Pebble Creek extension, and the Pebble Hills
residential street are the only on the plans .
Commissioner Harlen moved to recommend approval of the rezoning request. Commissioner Floyd
seconded the motion, which passed 5-0 unopposed .
°\7f1'AGENDA ITEM NO. 5: Public hearing and consideration of a Conditional Use Permit, site plan ')<l only, for the Kappa Kappa Gamma Sorority located at 1502 Athens Drive. (OO;ti'.1)
Staff Planner Anderson presented the staff report and stated that the subject property is located on the
comer of Athens Drive and University Oaks Boulevard and is within the Greek Village Subdivision.
The property is zoned R-6 , which allows sorority and fraternity houses as conditional uses . The subject
property is surrounded on all sides , except to the east, by sorority and fraternity homes . The property
to the east , across University Oaks Boulevard, is zoned C-3 Planned Commercial and is currently
developed as a day care facility . On July 3, 1980 , the Planning & Zoning Commission granted a
conditional use permit for the existing sorority house site and use . The applicant now wishes to make
renovations to the structure totaling 4,035 square feet , with the most major addition consisting of

increasing the size of the current meeting room from 706 square feet to 1265 square feet. The off-street
parking requirement for sorority houses is determined . by the size of the meeting room and by the
number of persons living in the house . The applicant is proposing to remove most of the landscaping on
the east side of the property that is adjacent to University oaks Boulevard in order to meet this
increased off-street parking requirement. The proposed additions will increase the structure by
approximately 25 percent. Due to the magnitude of the renovations, including an increase in the
amount of off-street parking, the site plan must come back before the Planning & Zoning Commission
for approval .
Ms . Anderson pointed out that Section 14 of the Zoning Ordinance authorizes the existence of
conditional uses . the Commission may permit a conditional use subject to appropriate conditions and
safeguards, when after public notice and hearing the Commission finds that: (Staff commends are in
italics)
1. "The proposed use meets all the minimum standards established in the ordinance for the type of
use proposed ." Staff conducted a technical review and found general compliance with
development regulations with the exception of the items listed in the staff comments. The
applicant is short one parking space. A parking space will need to be added or 30 square feet of
the proposed meeting will need to be removed
2 . "That the proposed use meets the purposed and intent of the ordinance and is in harmony with the
development policies and goals and objectives as embodied in the Comprehensive Plan for the
Development of the City . The request is in compliance with the Comprehensive Plan .
3. "That the proposed use will not be detrimental to the health, welfare, and safety of the
surrounding neighborhood or its occupants, not be substantially or permanently injurious to
neighboring property." The public hearing is an opportunity for the Commission to measure the
potential impact on surrounding land uses.
The Commission m~y impose additional reasonable restrictions or conditions to carry out the spirit
and intent of the ordinance and to mitigate adverse effects of the proposed use . The requirements
may include, but are limited to, increased open space , loading and parking requirements, additional
landscaping, and additional improvements such as curbing, sidewalks and screening ." Unless the
public hearing brings to light any new information indicating potential negative impacts, Staff
recommends approval with Staff Review Comments #2 (in file).
Commissioner Kaiser asked if staff addressed the issue of the loss of greenspace . Ms . Anderson said
that the applicant has exceeded the required landscape points . Ms . Anderson reminded the Commission
that the Commission may require additional landscaping is desired .

GENDA ITEM NO. 6: Consideration of a site plan for a drive-thru restaurant located i e

Senior P er Kuenzel presented the staff report and stated that this item is the final ep in the site
plan appro process as required of all Wolf Pen Creek projects. The applica is proposing to
construct a 3, 2 square foot Italian restaurant with a drive-thru in the southwest mer of the Office
Max parking lot n Harvey Road . The pad site has remained undeveloped si e the construction of
Office Max. It is t only pad site available in the parking lot , and has high vi · Ility to public rights-of-
way . Fazoli's Resta nt is proposed to be located at the comer of Harv Road and George Bush
Drive . All site plans · hin the Wolf Pen Creek Development Corridor e subject to review by the
Design Review Board ). In compliance with the City's land u and development codes, and
guided by the Wolf Pen Cr k Corridor Study and Master Plan, the evaluates site plans based on
the appearance of the develop ent. The DRB reviewed this item o ay 3 and recommended approval
with the following conditions :
1. Change the color of e lights and roof to green in ad of the proposed red .
2 . Realign the drive, er ating parking spaces an concrete, and add additional landscaping
and designate four par · spaces as employe parking, and place a "pedestrian crossing"

restaurant is not considered ''fast food", b is actua between casual dining and fast food, and is

We here at BRW Architects have been working with Carolyn Hoyle to design
and construct the addition to the Kappa Kappa Gamma Sorority House.
Recently , we submitted a Variance Request dated 3-28-01 . After
discussing with you the range and limitations of the governing body
granting this variance, I would like to modify the portion of the form
labeled "The following specific variation from the ordinance is
requested". This part of the request should now read : "Variance to
lower the required number of off-street parking spaces by six spaces ,
from 85 to 79 ."

I have received your application for the Zoning Board of Adjustments and am aware of your parking
situation at the Kappa Kappa Gamma House . The Zoning Board of Adjustments is not empowered with
the ability to allow the substitution of parking, and therefore can not make a ruling on the request you have
made . You have several options to address the parking requirements set forth in the Zoning Ordinance :
1. You may move forward with the on-site parking as shown on the approved site plan .
2. You may ask the ZBA for a variance to the off-street parking requirement.
When considering variance requests , the ZBA must find special conditions relating to the land and
hardships that arise out of the special conditions.
3. You may use appropriate off-premise spaces to meet your parking requirement.
Off-premise parking space locations are allowed "For any new use , building , or structure where the
required off-street parking cannot be provided on the premises because of size or location of the lot
or building plot, such parking may be provided on other property under the same ownership in fee
simple or under a perpetual easement which commits the land for parking for the use, building , or
structure , not more than two hundred (200) feet distant from the building site provided the proposed
parking area is located in a district where parking lots are permitted for that use ." (Zoning Ordinance
Section 9.2 .B). As shown by highlighting , there are a number of complications involved with this option .
In addition to those explicitly noted in the ordinance , the day care center must have parking in excess of
what they are required to have for their business . The perpetual easement, which would limit future uses
of the day care building , would need to dedicate six spaces to the Kappa Kappa Gamma property.

We recommend that you try to find space for the parking on site . If you can not , your
next step should be a variance request to the off-street parking requirement fr om the
ZBA. You do not need to ask permission for the off-site parking if the day care is less
than 200 feet away , but there are other complications involved with this option (e.g .,
allowed when parking can not be provided on site). I've included the page that describes
