GENERAL INFORMATION Status of Applicant: Applicable Ordinance Section: Property owner Section 7 : District Use Schedule -Table A PHYSICAL CHARACTERISTICS Zoning and Land Use: The subject property and property to the north , west, and south are zoned and developed as R-1A Single Family Residential. They are part of the Emerald Forest Ph . 10 Subdivision . Property to the east is A-0 Agricultural -Open and is undeveloped . Frontage: 52.80 ft . along the arc of the Walnut Grove Court cu I- de-sac . Access: The main structure is provided access via a drive on Walnut Grove . Topography & Vegetation: The property is relatively flat and heavily landscaped. There are several mature trees on the lot. Flood Plain: Not located within a floodplain . VARIANCE INFORMATION Setback Required: Setback Requested: Case Overview: ANALYSIS Special Conditions: Hardships: Alternatives: According to the City of College Station Zoning Ordinance , the minimum rear building setback is 20 ft . 10 ft. rear setback . The applicants wish to add an approximately 1100 sq.ft. addition to the back of the garage to be used as living quarters for their parents. The structure will be located 10 feet from the rear property line at its closest point. Thus , the applicants are requesting a variance of 10 feet to the rear setback to allow for the addition of the living quarters. Accessory structures may not be more than 25% of the size of the principal structure. At the present time, the size of this proposed building combined with the size of the detached garage exceeds the 25% allowed. There are plans to build an office area on the house , which would increase the size of the principal structure, therefor allowing for more square footage of accessory structure . The subject property is a five-sided lot. In this situation , property lines that are shared with abutting rear property lines are interpreted as being rear property lines themselves . The addition is proposed for the portion of the lot that is flanked by two rear lot lines. Mr. Abouelkheir has stated that a former planning staff member had told him that the line in question would be a side property line with a reduced setback requirement. The addition is proposed for this area of the rear yard so a stand of trees to the north can be preserved . Because of the shape of the lot , building a structure in the middle of the back yard would destroy the effective usage of the yard. If the structure was to be moved to the northern portion of the back yard , existing trees would have to be removed. An architect was hired to design the structure for its current proposed location with a smaller setback. The following alternatives to the variance have been identified: 1. Redesign the structure to fit within the required setbacks . 2 . Build the house on a different lot. SPECIAL INFORMATION The Board may grant the variance, grant a variance less than the requested amount , or deny the variance. Ordinance Intent: Building setback requirements usually allow for some degree of control over population density, access to light and air , and fire protection . These standards are typically justified on the basis of the protection of property values . Similar Requests: In the last few years , several rear setback variances have been granted . The special conditions on these lots have included age (structures built to previous setback standards), unusual lot size (primarily small and/or narrow lots), and backing onto rights-of-way . The Board has denied cases where expansions or accessory buildings could be built elsewhere on the property . There has been one request for a variance in the subject property 's subdivision . A 13 .35-ft. side street setback was granted because of a curve in the road and the site being built with site plan and construction approval from the city .
