Regarding the waiver request , explain how :
1. There are special circumstances or conditions affecting the land involved such that strict application of the
subdivision regulations will deprive the applicant of the reasonable use of his land.
2. The wa iver is necessary for the preservation and enjoyment of a substantial property right of the applicant.
3. The granting of the waiver will not be detrimental to the public health , safety , or welfare , or injurious to other
property in the area , or to the City in administering subdivision regulations .

Your Commitment of Title insurance is a legal contract betvve e n you and us . The Comm itment is not an opin ion or report of your title .
It is a contract to issue you a policy subject to the Commitment's tenns and requi1·e ments.
Before issuing a Commitm ent for Title insurance (th e Commitment) or a Title Insurance Policy (the Policy), the Title Insurance
Company (the Company) detern1ines whether the title is insurable. Thi s dete1111ination h as already been made. Part of that
dete1111inati on involves the Compan y's decision to insure th e title except for certai n risks that will not be covered by the P olicy. Some
of these risks are li sted in Schedule B of the attach ed Commitment as Exceptions. Other risks are stated in the Policy as Exclusions.
These ri sks will not be covered by the Policy. The Policy is not an abstract of titl e nor does a Company have an obligation to
detennine the owners hip of any mineral int erest.
---MINERALS AND MINERAL RIGHTS may not be covered by the Policy. The Compan y may be unwilling to insure title
unless there is an exc lu s ion or a n exception as to Minerals a nd Mineral Rights in the Policy. Optional endorsements insuring certain
risks involving minerals, and the use of improvements (excluding lawns, shrubbery and trees) and permanent buildings may be
availabl e for purchase. If the title in surer issues the title policy with an excl u s ion or exception to the minerals and mineral rights,
neither thi s Policy, nor th e optional en dorsements , en sure th at the purchaser has tit le to th e minera l rights r e lated to the surface estate.

Schedu le C of the Commitment li s ts these requirements th at must be satisfied o r the Company will refuse to cover them . You may

When your policy is is su ed, the coverage will be limited by the Policy's Exceptions, Exclusions and Conditions, defined below.

Before the Policy is is sued , you m ay request changes in the P olicy. Some of the c han ges to consid er are :
---Request a mendm ent of the "ru·ea aJ1d boundary" exception (Schedule B, parag raph 2). To get this amen dment, you must
furnish a survey an d comply with other requirements of the Company . On the Owner's Policy, you must pay an additional premium for
the amendm e nt. lf the survey is acceptab le to the Company and if the Company's other requirements are met, your Policy will insu re
you against loss because of discrepancies or conflicts in boundary lines , encroachments or protrusions, or overlapping of
improvements. The Company may then decide not to insure aga in st specific bound ary or s urvey problems by making special
exception s in the Policy . Whether or not you requ est amendment of the "area and boundary" exception , you s hould dete1111ine whether
you want to purchase and review a s urv ey if a s urvey is not b e in g prov id ed to you.
---Allow the Company to add an exception to "rights of parties in possession." If you refuse thi s exception, the Company or the
title in surance agent m ay inspect the property. The Company may except to and not insure you aga in st the rights of specific persons,
such as renters, adve rse owners or easement ho lders who occupy t he land . The Company may c harge you for the inspection. If yo u
WaJ1t to make your own inspection, you must sign a Waiver of 111Spection form and allow the Company to add this exception to your
Policy.

Arbitration is a common form of a lt ernative di s pute reso lution . It can be a quicker a nd
c heap er means to settl e a dispute with yo ur Title In suran ce Company. However, if yo u agr ee
to arbitrate, you g ive up your right to tak e the Title Company to co urt a nd your ri ghts to
discove1y of ev id en ce may be limited in the a rbitration process. Jn addition , you cannot
usually appeal an arbitrator's award.
Your policy contain s an arbitration provmon (shown below). It allows you or the
Company to require arbitration if the amount of insurance is $2,000 ,000 or less. If you
want to retain your right to sue the Company in cas e of a dispute over a claim, you mu st
request deletion of the arbitration provision before the policy is issued. You can do this
by signing this form and returning it to the Company at or b efore the closing of yo ur
real estate transaction or by writing to the Company.
The arbitration provision in the Policy is as follows:
"Either the Company or th e In sured may dema nd th at the claim or co ntroversy s hal l be
su bmitted to arbitration pursuant to the Title Jnsmance Arbitration Rules of the American
La nd Titl e Associa ti on ("Ru les"). Except as provided in the Rules, th ere sha ll be no joinder or

1. This plat fits the definition of a Minor Replat which does not need to be approved by the
Planning & Zoning Commission , but can be approved administratively by Staff. Once we
rece ive a response to these comments and we have received written confirmat ion that you
would like to change to a Minor Replat , we will refund the $232 difference in application fees

separate exhibit. Since we were able to review the existing information with this

2. At the intersection of the Grove St. and Highlands St. right-of-way lines , please provide a
25-ft chamfer.

ELECTRICAL COMMENTS REQUIRING IMMEDIATE ATTENTION
1. SITE PLAN/PLAT: Developer will provide CSU with a digital , AutoCAD dwg format , version
of plat and I or site plan as soon as it is available . Email to : wdavis@cstx .gov
2. LOAD DATA: The developer will provide load data to CSU as soon as it is available . This
information is critical for CSU to accurately determine the size and number of transformers,
and other equipment, required to provide service to the project. Failure to provide load data
will result in construction delays and, due to clearance requirements, could affect the final
building footprint. Delivery time for transformers and other equipment not in stock is
approximate 26 weeks .
3. EASEMENTS: Developer provides descriptive easements for electric infrastructure as
designed by CSU , as shown on plat or site plan.
4 . If easements are existing , the developer will be responsible for locating easements on site to
insure that electrical infrastructure is installed within easement boundaries .
5 . The following easements will be required :
• 5' PUE along Lot 1 and the common line of the 15 ' wide alley
• 1 O' PUE along Highlands Street
• 5' PUE along the common line of Lot 1 and Lot 2
• 5' PUE along the common line of Lot 2 and Lot 3
GENERAL ELECTRICAL COMMENTS
1. Developer installs conduit per CSU specs and design .
2. CSU will provide drawings for electrical installation .
3. Developer provides 30' of rigid or IMC conduit for each riser conduit. CSU installs riser.
4 . Developer will intercept existing conduit at designated transformers or other existing devices
and extend as required .
5. If conduit does not exist at designated transformer or other existing devices , developer will
furn ish and install conduit as shown on CSU electrical layout.
6 . Developer pours electric device pads or footings , i.e. transformers, pull boxes , or other
device, per CSU specs and design.
7 . Developer installs pull boxes and secondary pedestals per CSU specs and design , Pull
boxes and secondary pedestals provided by CSU.
8. Final site plan must show all proposed electrical facilities necessary to provide electrical
service , i.e . transformers , pull boxes , or switchgears , all meter locations , and conduit routing
as designed by CSU.
