1. A 15-ft Public Utility Easement (PUE) is needed along the northern and western lot lines
for existing infrastructure.
2 . There is an existing sanitary sewer service along the south side of the Hawthorne St.
right-of-way that will need to be within a 15-ft PUE .
3. A 6-ft sidewalk within a Public Access Easement (PAE) is required on Holleman Dr .
Please submit construction plans and an engineer's cost estimate for the sidewalk .
FYI ... This sidewalk will need to be constructed or surety provided for it prior to the plat
being scheduled for P&Z.

on the Bike , Pedestrian and Greenways Master Plan. The
applicant is requesting to pay into the sidewalk fund (Sidewalk
Zone 3) in lieu of construction of the sidewalk.

Compliance w ith Subdivision Regulations:
The applicant has requested that the Commission approve a request to pay into the sidewalk
fund in lieu of construction of the requ ired sidewalk . The Commission may authorize a fee in
lieu of sidewalk construction when it is determined a condition exists as stated in the
Subdivision Regulations. The subject property is located in Sidewalk Zone 3 and the fee in lieu
amount is $1 ,870 (62 linear feet x 6-foot wide sidewalk x $5 per square foot). The Thoroughfare
Plan designates Holleman Drive as a two-lane Major Collector which requires a standard right -
of-way width of 77 feet and there is currently only 50 feet of right-of-way . Addit ionally, the Bike ,
Pedestrian and Greenways Master Plan proposes a sidewalk on the north side of Holleman
Drive , from the existing sidewalk at HEB , on the corner of Holleman Drive and Texas Avenue ,
to Wellborn Road as a long-term priority given that there is insufficient right-of-way . The
proposed Final Plat otherwise complies w ith the Subdivision Requirements contained in the
Unified Development Ordinance .
STAFF RECOMMENDATIONS
Staff recommends approval of the applicant's request to pay $1 ,870 into the sidewalk fund in
lieu of construction of the sidewalks . If use of the sidewalk fund is approved , staff recommends
approval of the Final Plat. ,

212.005 Approval by Municipality Required
The municipal authority responsible for approving plats must approve a plat or
replat that is required to be prepared under this subchapter and that satisfies all
applicable regulations.
212.014 Replatting Without Vacating Preceding Plat
A replat of a subdivision or part of a subdivision may be recorded and is controlling
over preceding plat without vacation of that plat if the replat:
(1) i s signed and acknowledged by only the owners of the property being
replatted.
(2) is approved, after a public hearing on the matter at which parties in interest
and citizens have an opportunity to be heard, by the municipal authority
responsibility for approving plats; and
(3) does not attempt to amend or remove any covenants or restrictions.
212.015 Additional Requirements for Certain Replats
( c) If the proposed rep lat requires a variance and is protested in accordance with
this subsection, the proposed replat must receive, in order to be approved, the
affirmative vote of at least three-fourths of the members present of the municipal
plann i ng commission or governing body, or both. For a legal protest, written
instruments signed by the owners of at least 20 percent of the area of the lots or
land immediately adjoining the area covered by the proposed replat and extending
200 feet from that area, but within the ori ginal subdivision, must be filed with the
munici pal planning commission or governing body, or both, prior to the close of the
publ i c hearing .
