The following specific adjustment (up to 10%) from the ordinance requirements is requested : We reques t a 2% adjustment to the number of parking spaces required which will result in the reduction of one parking space out of the required 58 spaces. · 2. Th is adjustment will not be contrary to the public interest by virtue of the follow ing facts : The adjustment is not contrary to public interest by virtue of the fact that it is being requested out of concern for the public's safety. We feel that the adjustment is consistent with avoiding public safety hazards. 3. The grant ing of the adjustment will be consistent with the purpose and intent of the Unified Development Ordinance because of the following : The granting of the adjustment will be consistent with the purpose and intent of the UDO because the adjustment is being requested for public safety reasons . The building is being renovated with elevators so handicap parking can be provided under the building. The space being requested to be deleted is currently the handicap space for the building bu t it is constructed on the slope of the drive into the shopping center. It is difficult to pull into and out of this space because of incoming and outgoing traffic . The parking spot is only 19 112 feet from University Drive and does not allo w the drive to meet throat depth . The shortage of one parking space on this site is a much safer situation than keeping this one parking spot. The applicant has prepared this application and certifies tha t the facts stated here in and exhibits attached hereto are true , correct, and complete . The subject property is zoned GC General Commercial and developed as an office , with a gross floor area of 14,452 (after the building renovation) which requires 58 parking spaces . Accord ing to the Unified Development Ordinance Section 12-3.17, the Administrator has the authority to authorize adjustment of up to ten percent (10%) from any numerical zoning standard set forth in the Unified Development Ord inance . To approve the application for an administrative adjustment, the Administrator shall make an affinnative finding that specific criteria , as outl ined in Section 12-3.17 .E of the Unified Development Ordinance, have been met. The Administrator has found that: Granting the adjustment will ensure the same general level of land use compatibility as the otherwise applicable standards because the reduction of 1 parking space does not significantly alter the intensity of the land use; Granting the adjustment will not materially or adversely affect adjacent land uses or the physical character of uses in the immediate vicinity of the proposed development because the reduction of 1 parking space does not significantly alter the character of the structure or its density; and Granting the adjustment will be generally consistent with the purposes and intent of this UDO owing to the scale of the reduction .
