Chapter 10 of the Drainage Policy and Design Standards, as adopted through Chapter 13, Section
3.B of the City of College Station Code of Ordinances, requires the implementation of measures
necessary to prevent the movement of sediment, by erosion or action of man from areas
undergoing development, onto adjacent properties or any part of a drainage system.
This Chapter is enforced by ensuring that construction sites implement standard Best
Management Practices (BMP). Typical BMP appropriate for this site includes, but is not limited
to, daily removal of sediment transported from the site, properly installed silt fencing, and
installation of rock berms in locations of concentrated flow.
Similar requirements are necessary under the Federal Clean Water Act to be eligible for
coverage under the NPDES General Construction Stormwater Permit. This nation wide permit
requires that a log of inspections, maintenance, and spills must be kept on site. This log should
be made available to city staff upon request.
City of College Station staff visited the site on the morning of March 10, 2000, and found that no
erosion controls in place on the north end of the project between the current construction site and
Lick Creek. A significant amount of silt was washing off the site and entering Lick Creek. The
silt fence along the eastern property line is not being maintained in a functioning manner as a
result of daily construction activities near the fencing . Staff attempted tO contact the site
superintendent, however he was unavailable. Mr. Kent Laza, P .E., with McClure Engineering
was informed of these deficiencies and has indicated that he would inform the site
superintendent. The approved construction plans for this subdivision includes an erosion control
plan, which is to be followed.
Appropriate action must be taken immediately to bring the site into compliance to ensure the
health, safety and welfare of the community. If this action can not reasonably be taken
immediately, please provide written documentation of the item not implemented, a reason for the

delay, and expected time frame for implementation. Failure to comply will result in enforcement
in accordance to Chapter 13, Section 7 of the Code of Ordinances.

The Contractor shall take all necessary precautions to prevent silt and debris from leaving the immediate
construction site in accordance with the approved erosion control plan as well as the City of College Station
Drainage Policy and Design Criteria. The Owner and/or Contractor shall assure that all disturbed areas are sodden
and establishment of vegetation occurs prior to removal of any silt fencing or hay bales used for temporary erosion
control. The Owner and/or Contractor shall also insure that any disturbed vegetation be returned to its original
condition, placement and state. The Owner and/or Contractor shall be responsible for any damage to adjacent
properties, city streets or infrastructure due to heavy machinery and/or equipment as well as eros ion, siltation or
sedimentation resulting from the permitted work.
Any trees required to be protected by ordinance or as part of the landscape plan must be completely fenced before
any operations of this permit can begin .
In accordance with Chapter 13 of the Code of Ordinances of the City of College Station, measures shall be taken to
insure that debris from construction, erosion, and sedimentation shall not be deposited in city streets, or existing
drainage facilities.
I hereby grant this permit for development of an area OUTSIDE the special flood hazard area. All development
shall be in accordance with the plans and specifications submitted to and approved by the City Engineer in the
development permit application for the above named project and all of the codes and ordinances of the City of
