TYPE OF DEVELOPMENT: This permit is valid for SUBDIVISION CONSTRUCTION PER
APPROVED PLANS
The Contractor shall take all necessary precautions to prevent silt and debris from leaving the immediate
construction site in accordance with the approved erosion control plan as well as the City of College
Station Drainage Policy and Design Criteria. The Owner and/or Contractor shall assure that all disturbed
areas are sodden and establishment of vegetation occurs prior to removal of any silt fencing or hay bales
used for temporary erosion control. The Owner and/or Contractor shall also insure that any disturbed
vegetation be returned to its original condition, placement and state. The Owner and/or Contractor shall be
responsible for any damage to adjacent properties, city streets or infrastructure due to heavy machinery
and/or equipment as well as erosion, siltation or sedimentation resulting from the permitted work.
Any trees required to be protected by ordinance or as part of the landscape plan must be completely fenced
before any operations of this permit can begin.
In accordance with Chapter 13 of the Code of Ordinances of the City of College Station, measures shall be
taken to insure that debris from construction, erosion, and sedimentation shall not be deposited in city
streets, or existing drainage facilities.
I hereby grant this permit for development of an area inside the special flood hazard area. All
development shall be in accordance with the plans and specifications submitted to and approved by the
City Engineer in the development permit application for the above named project and all of the codes and
ordinances of the City of College Station that apply.

Subject: Easements on the Business Park Property requested by Pebble Creek
On Monday, July 12, 1999, Veronica Morgan met with Harvey, Kim Foutz and me
to inquire about offsite easements for Pebble Creek to be located on the CS
Business Park Property for drainage and utilities to serve their new phase in the
subdivision .
Pebble Creek needs these offsite easements solely for their use.
Both Harvey and I told Veronica that we could not give these easements to
Pebble Creek as it would constitute a gift of public property for a private purpose.
Generally, the conveyance of city property must be by public bid unless it is
excepted from the bidding requirement. See, TEXAS LOCAL GOVERNMENT CODE
SECTION 272 .001. In this circumstance the land in question appears to fit under
an exception to the bidding requirement. Specifically. No 1. In this event, the
sale of the land would be exempt from bidding but the city would be required to
obtain an appraisal to determine the value of the land for conveyance as an
easement before it could be sold. Additionally, Kim Foutz stated that she did not
want to bear any costs in the conveyance of the easement. Consequently , the
real estate sales contract must provide that the buyer would reimburse the city
for all costs (appraisal, fil ing fees, closing costs , deed preparation, and title
insurance if requested by the buyer).
Veronica will convey this information to Jim Calloway.
There is no action necessary at this time by the Legal Department until further
notice by Development Services .

Dear Veronica:
As you requested, I have revisited our drainage study for Pebble Creek regarding the 100-
year water surface elevation of Stream AC-1 adjacent to Phase 8B. Please refer to our
Report while reading this letter so that you can follow my explanations .
Using "post-developed" flow conditions, we calculated that the 100-year water surface
elev ations increased from between 0-44 feet and 0 .55 feet. Stream AC-1 increased 0 .55
feet immediately upstream of the confluence with Alum Creek. Therefore, we
conservatively added 0 .5 feet to FEMA's 100-year profile for Stream AC-1 from Alum
Creek to the terminus of the study .
Next, we field surveyed Phase 8B 's rear property line ii1 order to establish the drainage
easement when we discovered that none of the floodplain was on the subject
development. Therefore , we did not dedicate an easement.
With regards to the Master Plan showing a slight floodplain encroachment on Phase 8B ,
please remember that the floodplain was merely digitized and interpolated on aerial
topography and is not intended to be the actual representation of the floodplain .

In reviewing the plans for this project there was a concern about the drainage discharges
and where they will enter the Business Center. The concerns revolved around two items:
1. the affect of the discharge on the developability ofBlock I and
2 . the affect on the Navasota Lady Tres s Reserve area
In answer to number I :
Pebble Creek 6 was approved with a large discharge onto Block 1 and additional drainage
easement was granted on Block 1 to all ow for this. The discharge from Pebble Creek 8 is
minor in comparison. Also when looking at the Business Center Detention/Retention pond
layout there appears to be planned in this area a small creek that will discharge into some
of the ponds. (i.e. the discharge point was planned to occur where Phase 6 and 8 will be
discharging)
In answer to number 2 :
The Reserve area is not located adjacent or in near proximity to these point discharges. It
does not appear that this discharge and the velocity related to it will disturb this protected
area .
As a result,, Pebble Creek 8 will be allowed to discharge in two locations into the Business
Center property to the creek.

Per our last conversation, the City of College Station is processing the request for offsite
easements for Pebble Creek 8B , which are proposed to be located on the Business Center
property. The legal department bas stated that we w ill need to have an appraisal performed for
the easement area being requested . State statute prohibits a governmental entity from conveying
public lands for private purpose without due compensation. Albeit, the storm sewer and sanitary
will be dedicated to the public, it is being constructed to service a private development We will
need to have a contract executed with Pebble Creek Development Corporation allowing the c ity
to order an appraisal at Pebble Creek Development's cost. From this appraisal we can then
negotiate the terms for granting the easement. It may be preferable to both parties to negotiate
drainage improvements in lieu of cash payment.
In addition to the appraisal, there will be several items we need prior to granting the easements.
One, we will need to see the easement locations staked in the field for verification of alignment
and to see the vegetation within the Business Center that will be affected. We will want to
minimize the number of specimen trees that are removed due to this construction and assure the
construction is in harmony with the Business Center Master Plan. In addition, we will need to
verify the location of the outlet of the storm sewer to assure that it is located at the creek bank and
is properly stabilized.

the contract for the appraisal as well as the locations and impact to the Business Center.

improvements be approved and accepted as being constructed under city
inspection and completed according to plans and specifications as
approved and required by the City of College Station, Texas. This
approval and acceptance by the City is requested in order that we may
finalize any sub-contracts and to affirm their warranty on the work . This
approval and acceptance by the City of the improvements listed below
does hereby void the letter of guarantee for the listed improvements on
