i don 't remember if the property we looked at a couple of weeks ago included
a one-acre tract immed iately to the we st of the condos but i think it did
(th e piece with stalli ng s running thru it).
i've been talking to the owner of that one acre, chris rhett, who bought it
from don ganter. there is evidence to sho w that wh e n don bought it, it wa s
an illegal s ubd ivision . so the one acre tract is a part of the entire
parent tract, the rest of which i think is sti ll owned by paul clark . soi
would think we would require the lot to be included in the plat (final plat
even) and rhett will have to be a signator.
there has been s ome discussion between clark and rhett regarding the future
plans for the 1 acre. apparently ganter had s igned some power of attorney ,
which expires in about a year, that gives clark's attorney th e ri ght t o
dictate what can be done with that tract. clark ha s threat ened to use the 1
acre as the detention area for the re s t of th e "d evelopment", whatever that
i s. or perhaps he will use it all for parking or landscaping . at any rate
it sounds as i f our friend ha s sol d off an illegal lot and is reserving th e
power t o render it unbuildable! hey, i 'min the wro ng bu s iness , eh? i 1 d
hav e a lot more fun keepi ng the little people down!
well, i told rhett that in my opinion he would have to be a signator to the
final plat, and if he will not s ign a pl at, that this would have to go as a
variance (like fir s t american did, didn't they?). at any rate he would have
an oportunity before council to get his own attorney involved (he's had
discussions with ...... eeek i can't remember now but his legal eagle anyways
-and it seems as though the power of attorney ha s holes in it). i told him
the city would not let anyon e plat an unbuildable lot. s o the i mportant
question is will we require the one acre to be included in the fina l plat?
i think it s hould but we may have some "hold i ng ho s tage" prec ede nce th a t
gets too comp licat ed for my feeble brain.

Paul told us he ha s power of attorney on that lot. Ye s , it is inc lud ed in
the plat. If I remember correctly and Shirley a nd V were in th e mtg w/me,
Rh e tt does not have to be a signator. Paul says he told Rhett not to but it
but he did anyway. Shirley and Vis this how ya'll remember it?

dent worry, be happy!! all we do is make them include the lot, put s ignat ors
on the plat for whoever own s it, give us a copy of the power of attorney and
that's it. pretty simp le huh?? yea, jus t wait, the s tuff will hit the fan
sooner or later!!!

and therein lies the rub i think ... if rhett i s going to claim ownership
because the pow e r of a ttorney is bogus, then it is hi s responsibility t o get
that reso lved privately. he know s that at th e s taff level we have had some
di sc uss ions regarding this area. he does not ye t know why. we do not have
a file on it yet, but i'm worried that he's gonna come back when the legal
s tuff s tarts rolling and claim that he should have been informed.
