The Contractor shall take all necessary precautions to prevent silt and debris from leaving the immediate construction site in accordance with the approved erosion control plan as well as the City of College Station Drainage Policy and Design Criteria. The Owner and/or Contractor shall assure that all disturbed areas are sodden and establishment of vegetation occurs prior to removal of any silt fencing or hay bales used for temporary erosion control. The Owner and/or Contractor shall also insure that any disturbed vegetation be returned to its original condition, placement and state. The Owner and/or Contractor shall be responsible for any damage to adjacent properties, city streets or infrastructure due to heavy machinery and/or equipment as well as erosion, siltation or sedimentation resulting from the permitted work. Any trees required to be protected by ordinance or as part of the landscape plan must be completely fenced before any operations of this permit can begin. This permit, being temporary, is valid only within sixty (60) days of the date shown below, and is not intended to allow the complete development of the site as proposed. Any work performed after the expiration of this permit is not covered, and is considered unauthorized. In accordance with Chapter 13 of the Code of Ordinances of the City of College Station, measures shall be taken to insure that debris from construction, erosion, and sedimentation shall not be deposited in city streets, or existing drainage facilities . He said that we should have a grading plan for this area that MDG prepared & submitted about a year ago. There's an area on the site that holds water and is difficult to mow. He worked with MDG on a drainage plan to fill some areas of the site so that it's easier to maintain. Anyway, please see if we have this plan. (It doesn't ring a bell with me.) And , please call him back. I told him that we would need to review the plan before issuing the permit and that someone would call him back on Monday. I informed you in April of this year that unauthoriz.ed fill had been placed on Lot Al of Ponderosa Place, Section 2 and that you would either have to remove the fill or provide us with a drairuige report and grading plans showing the impact of the fill placed on the property. You expressed that it was your' intention to contract with an Engineer to provide us the necessary information to issue you a development permit. To my knowledge the city has not received any such information on this site. To make the situation worse, it appears that additional fill has been placed on the site since our conversation in April. There are some clarifications requested on the redlines as well as a couple of statements by a professional engineer to address existing and potential concerns from adjacent property owners. A signed and sealed statement by a Professional Engineer is requested indicating that there will be no increase in stormwater runoff to adjacent sites as a result of this site reclamation . There have been concerns raised by adjacent property owners regarding the deteriorating retaining walls located on the above property. A statement will also be required to address that there is no negative impact to the retaining walls from the additional fill . Both issues can be addressed in one letter or as separate letters .
