Just talked to him again, and he wanted to explain that Sonny at Garrett had provided some information
with the fill permit application, and because Garrett hasn't had time to do the LOMR within the time
constraints and he talked to Jim Callaway who told him MDG had probably done more LOMR's here than
anyone, so he talked to Greg Taggart who agreed to do his LOMR , but then found that the information
MDG compiled differs from that turned in by Sonny at Garrett and actually indicates some fill was placed
in the floodway. That fill in the floodway was supposed to be the subject of the phone call Paul was
supposed to have had with the FEMA people who said that little bit wouldn't hurt anything! Paul doesn't
remember the conversation and there is no documentation in the file that it ever took place anywhere ,

I received a phone message from Burt Hermann (AHHHHHHHH!!!!!) I did my duty
and actually called him back! He was wanting me to look in the file and see
if I wrote down a name of someone that I talked to regarding the Floodway
discrepancy and some Environmental study and that it was no big deal since
it was such a small piece of property .
Now that I have repeated what he told me I said ; I don't remember ever
saying anything like that. (what a surprise) He didn't sound too coherent
on the phone -so I am not sure if he is getting a conversation with someone
else confused with one he had with me.
Oh, this is in regards to his horse haven estates and the commercial tract
up front that he has filled . He was supposed to have the FEMA LOMR-F
submitted by Oct. 15th (if my memory is correct) -that is the 6 mo. rule .
He has spoken to someone at FEMA who said it was OK to get it in late .
I told him I would email you all so that you could look in the DP file to
see if there was any such correspondence on my part with someone????
He wanted me to look and I clarified for him that I no longer work for CS
and that I would pass on by email the info to you .
Maybe you can have Deborah G. call him back, she has a good rep. with him .
Hate to pass the buck -I sure do miss Burt!! (tongue in cheek!!!!)

This letter is concerning fill that has been placed within the regulatory 100 year floodplain during
the later months of 1997 on the property across from the Golf Driving Range. In accordance with ·
the Federal Emergency Management Administration's (FEMA's) rules concerning fill within the
floodplain, a letter of map revision based on fill (LOMR-F) application will need to be submitted to
the City of College Station for review and submittal to FEMA. FEMA requires a LOMR-F to be
processed anytime fill is placed in the floodplain so they can update their flood insurance maps.
The. LOMR-F must be reviewed by the City of College Station and all comments must be
addressed prior to the City sending it to FEMA for approval. FEMA requires that the application
be sent to them within 6 months of completing final grading of the fill. It appears that the final
grading of this fill has taken place, in which case the 6 month clock has already begun. Please
inform me of the date on which the final grading was finished. Remember to allow at least l 0
working days for the City to review your application and if needed, additional time for addressing
any comments noted during the City's review.

from Donald Garrett, P. E. This permit is conditioned upon a letter written by Mr. Burt Hermann
in which it is stated that the existing unauthorized fill located within the 100 year floodplain must be
moved outside the 100 year floodplain by October 6, 1997. H such fill is not moved as stated, then
this permit becomes invalid on October 7, 1997.
The Contractor shall take all necessary precautions to prevent silt and debris from leaving the immediate
construction site in accordance with the approved erosion control plan as well as the City of College
Station Drainage Policy and Design Criteria. The Owner and/or Contractor shall assure that all disturbed
areas are sodden and establishment of vegetation occurs prior to removal of any silt fencing or hay bales
used for temporary erosion control. The Owner and/or Contractor shall also insure that any disturbed
vegetation be returned to its original condition, placement and state. The Owner and/or Contractor shall
be responsible for any damage to adjacent properties, city streets or infrastructure due to heavy machinery
and/or equipment as well as erosion, siltation or sedimentation resulting from the permitted work.
Any trees required to be protected by ordinance or as part of the landscape plan must be completely fenced
before any operations of this permit can begin .
This permit, being temporary, is valid only within sixty (60) days of the date shown below, and is not
intended to allow the complete development of the site as proposed. Any work performed after the
expiration of this permit is not covered. and is considered unauthorized.
In accordance with Chapter 13 of the Code of Ordinances of the City of College Station, measures shall be
taken to insure that debris from construction, erosion, and sedimentation shall not be deposited in city
streets, or existing drainage facilities .
I hereby grant this permit for development of an area outside the special flood hazard area . All
development shall be in accordance with the plans and specifications submitted to and approved by the
City Engineer in the development permit application for the above named project and all of the codes and

We have reviewed your development pennit application to store fill outside the floodplain on the
property opposite from the Golf Driving Range as shown on a drawing submitted by your engineer,
Don Garrett. It is also our understanding that there is substantial fill located within the 100 year
floodplain as delineated by FEMA on this same property. This fill has been placed without the
benefit of a development pennit from the city and therefore must be removed . The City of College
Station does not have a problem with your application in itself, however, the unauthorized fill
within the floodplain must be moved to an area outside the 100 year floodplain prior to our
issuance of a temporary fill pennit for this site.
If Y<?U choose to seek an appeal to this decision you may make written notice of appeal to the
Floodplain Administrator, Veronica Morgan, within 10 working days of receiving this letter. This
appeal would be heard by the Municipal Court. The Municipal Court shall be finally binding upon
all parties involved.

Re: Grading Permit for Mr. Burton Ray Hermann for fill in flood plain
adjacent to Wolf Pen Creek for a tract of land along S. H. No. 6 south of
Switch Station Road.
To whom it may concern:
Please be informed that the proposed fill (approximately 5890 cu. yds., in
place) in the flood plain area adjacent to Wolf Pen Creek and as shown in
FEMA map No. 48041C0144C, 7 /2/92 would not dramatically or adversely
impact or affect the overall watershed area for this drainageway.
Please note that the floodway for this watershed is approximately the existing
fenceline of the subject tract and that Mr. Hermann has been informed of this.
He has also been made aware that no fill must be proposed or will be allowed
within this area or beyond this f enceline and that the flood way should be
located as best possible and fill should begin beyond this point and be sloped
at a maximum of 3: 1 slopes away from this line to reach the desired elevation
(approx. 252.50 elev.). The proposed compacted fill should then be sloped at a
1-1 .5% slope away from this point and toward the north-northwest to match
the approximate existing slope til it matches the existing ground elevation
which should occur at approximately 350-400 feet back from this point.
