required to rema in is strictly prohibited . The disposal of any waste material such as , but not limited to, paint, oil, solvents,
asphalt, concrete , mortar, or other harmful liquids or materials within the drip line of any tree required to remain is also

All construction to be in compliance with TPDES .
The Contractor shall take all necessary precautions to prevent silt and debris from leaving the immediate construction site
in accordance with the approved erosion control plan as well as the City of College Station Drainage Policy and Design
Criteria. If it is determined the prescribed erosion control measures are ineffective to retain all sediment onsite , it is the
contractors responsibility to implement measures that will meet City, State and Federal requirements . The Owner and/or
Contractor shall assure that all disturbed areas are sodden and establishment of vegetation occurs prior to removal of any
silt fencing or hay bales used for temporary erosion control. The Owner and/or Contractor shall also insure that any
disturbed vegetation be returned to its original condition , placement and state . The Owner and/or Contractor shall be
responsible for any damage to adjacent properties, city streets or infrastructure due to heavy machinery and/or equipment
as well as erosion, siltation or sedimentation resulting from the permitted work .
In accordance with Chapter 13 of the Code of Ordinances of the City of College Station, measures shall be taken to insure
that debris from construction, erosion, and sedimentation shall not be deposited in city streets, or existing drainage
facilities .
I hereby grant this permit for development of an area inside the special flood hazard area. All development shall be in
accordance with the plans and specifications submitted to and approved by the City Engineer in the development permit
application for the above named project and all of the codes and ordinances of the City of College Station that apply.

To provide some background, you and I have met a few times both alone and with other
staff members and discussed the floodplain and floodway locations that affect the vacant
property just north of the current Varsity Ford Dealership.
The desire of the property owner, Tony Majors, is to create a buildable commercial lot
fronting SH6 that does not have any floodplain within its limits . The stated desire of the
City 's Greenways Coordinator is to obtain unimproved floodplain in support of the
Greenways Program, preferably at low or no cost. It is your stated desire to assure that
any improvements to the property comply with the Flood Hazard Protection Ordinance,
specifically that no fill be placed within the floodway of Carters Creek.
To meet these multiple objectives, Bleyl & Associates has prepared a design that
produces a reasonable sized, floodplain free commercial lot, as well as a large greenways
dedication. This is achieved through minor filling of a portion of the flood fr ii!ge to
physically relocate the floodplain , replatting the lot to dedicate the greenway area to the
City, and a LOMA-F permit application to relocate the floodplain limit on the FIRM.
Near the middle of the property in question, the distance from the centerline of the creek,
to the location where the BFE contacts the actual surveyed topography is approximately
325 feet. The fill proposed would move the floodplain approximately 130 feet closer to
the creek. Because the entire width of the floodway at this location per the FIRM is over
1900 feet , and because the maximum depth of fill proposed is only 4 feet , it is our
opinion that this fill is minor in nature and will not affect the flood capacity of the creek.

Any time encroachment is made into the floodplain , it is incumbent on both the designer
and the floodplain administrator to verify that the encroachment does not extend into the
floodway. At this time, the regulatory floodway is shown very close to the western high
bank of Carters Creek at this location. While the FIS does not provide a distance from
the creek centerline to the edge of the floodway , the FIRM indicates a distance that scales
to approximately 60 feet.
Because the topography of the site supports this floodway location, we do not believe it is
necessary to prepare a complete recalculation of the Carters Creek Flood Data, to state
definitively that the grading proposed at this time does not approach the location of the
floodway.
Therefore we first ask that you accept our determination that the current actual floodway
limit is located very close to that shown on the FIRM, and thus is over 100 feet from the
maximum encroachment proposed. This would mean that our proposal meets the
requirement of avoiding fill in the flood way.
Second, we ask that you accept our determination that the amount of fill proposed is very
minor, and fits within the stated purposes of the LOMA-F encroachment process .
In summary, we believe that we have provided a proposal that is both beneficial to the
public, in that all remaining floodplain within the original lot will be dedicated to the City
as public greenway, as well as meets the interests of public safety in meeting the
requirements of the Flood Hazard Protection Ordinance.
Once you have reviewed this letter and the supporting documents, I ask that we be able to
meet to discuss your observations and reactions, and so better understand our mutual

Some weeks back, we submitted both Development Permit and Platting application
packages for review. On June 14th , we discussed comments relating to both the
grading/drainage and platting proposals. What follows is my understanding of the
comments raised, and our responses to each issue.

The primary concern raised was that the floodway limits for Carters Creek was not
defined on the drawings , so Staff was unable to verify that the grading was outside of the
floodway. Since this meeting, we have physically surveyed the location of the we stern
high bank of Carters Creek near the site , and have indicated its location on the grading
plans . We have also applied the floodway section information from the FIS to this field
determined high bank location, and have indicated what we believe to be the most
reasonable location for the floodway line.
A secondary concern was raised that the grading appeared to cross over the centerline of
the drainage along the northern property line. We have attempted to clarify the drawings
to indicate that the centerline is not crossed, and in fact very little fill is being placed
within the drainage at all.
High Ridge Subdivision Plat
The first comment made questioned why we had designated the proposed greenway s
dedication as a numbered lot. This was an error on our part, and will be changed to
remove the lot numbering in our next submittal.
A comment was made that the plat would be processed as a replat instead of as a minor
plat as submitted. As submitted, the plat would have qualified as a replat. However once
the greenways dedication area is no longer denoted as a lot per the comment above , it
would no longer fit the City 's definition of a replat, and thus should be defined and
processed as a minor plat.
A comment was made to include the extents of the existing parking on the eastern comer
of the site to clarify the relation of the proposed lot line and the parking area. We agreed
to provide a separate document which shows the physical relationship between the
existing parking, fencing and the proposed property lines .
A comment was made that the width of the panhandle of the dedication area might be too
small to provide for future needs. This was discussed in greater detail with the City 's
Greenways Coordinator after our facilitation meeting, and it was agreed that a 20 foot
public drainage easement would be included on the plat to provide for these future needs .
During the facilitation meeting, a comment was made requesting that a note be added to
the plat describing how the existing floodplain location was established. We will add a
note to the plat that explains how the FIS flood elevation was applied to the physical
ground surveyed topography on the site.
Also during the facilitation meeting, a comment was made that we would not be allowed
to show the floodplain as proposed by the grading modifications until a Letter of Map
Revision was issued by FEMA to indicate the modified location. This comment caused a
significant level of concern as it contradicted our tentative agreement reached as a result
of meetings earlier in the year. To meet this requirement, as well as the objectives of the
property owner, this project must now be re-ordered as follows.
•
First, the proposed Drainage Development Permit must be reviewed and approved.
Second, the grading and fill must be completed in the field and verified. Third, we must
prepare and submit a post-construction LOMA-F application through the City to FEMA
to effect the relocation of the regulatory floodplain line. Once the LOMA-Fis issued, we
understand that we could then proceed with resubmitting the plat with the floodplain in
the new location.
To this end, we are re-submitting the grading plans after incorporating these comments as
the first step in this revised process. Once you have reviewed this letter and the
supporting documents, I ask that we be able to meet to discuss your observations and
reactions, and so better understand our mutual positions with regards to this development.
