HomeMy WebLinkAbout55 Development Permit 345 Edelweiss Estates Ph 5Access Driveway Regulations The State Highway and Public Transportation Commission, in recognition of its responsbility for the safety and utlility of public highways under its jurisdiction, has directed the adoption of rules and regulations to accomplish a coordinated develop- ment ·between highways and abutting property. For this purpose, the booklet entitled "Regulations for Access Driveways to State Highways" was published and adopted, setting out departmental policies to regulate construction and maintenance of acce ss driveway facilities. The grantee is responsible for all costs associated with the construction of this access driveway. 2. Design of facilities shall be as follows and/or as shown on sketch : See Attached Plan Sheet No. 2 All construction and materials shall be subject to inspection and approval by the State. 3 . Maintenance of facilities constructed hereunder shall be the responsibility of the grantee, and the State reserves the right to require any changes, maintenance or repairs as may be necessary to provide protection of life <;>r property on or adja- cent to the highway. Changes in design will be made only with approval of the State. 4. The Grantee shall hold harmless the State and its duly appointed agents and employees against any action for personal injury or property damage sustained by reason of the exercise of this permit. 5. The Grantee shall not erect any sign on or extending over any portion of the highway right of way, and vehicle service fixtures such as service pumps, vender stands , or tanks shall be located at least twelve (12) feet from the right-of-wa y line to ensure that any vehicle services from these fixtures will be off the highway. 6. This permit will become null and void if the above-referenced driveway facilities are not constructed within six (6) months from the issuance date of this permit. 7 . The Grantee will contact the State's representative telephone ( ) at least twenty-four (24) hours prior to beginning the work authorized by this permit. The rules which regulate the design, installation and testing of domestic wast e water projects are found in 30 TAC, Chapter 317, of the TNRCC's rules titled, Design Criteria for Sewerage Systems. All plans and specifications submitted for TNRCC approval must comply with these rules. Beginning on September 1, 1994, severe budget reductions· required the TNRCC to eliminate most reviews of domestic wastewater project plans and specifications. At most, only a cursory review of the proposed project was performed. A technical review to determine conformity with 30 TAC Chapter 317 has not been performed. The proposed project is approved with the following comments and conditions: 1. An engineering r eport must be prepared and sealed by a Professional Engineer regi st ered in the State of Texas. Th is engineering report must include all constants, graphs, equations, and calculations, which are needed to both justify the design and show full compliance with Section 317.l(c) of the TNRCC's rules requiring a final engineering report. Copies of this report shall be made available to the TNRCC, upon request. 2. The final version of the project plans and specifications shall include any and all information necessary to show full compliance with the applicable requirements detailed in Chapter 317 of the TNRCC's rules. Any test results necessary to show compliance with the testing requirements of Chapter 317 shall be made available to the TNRCC, upon request. 4. The TNRCC still maint ains its review authority and may utilize this authority at any time in the future. If plans are to undergo review, the TNRCC wi l l notify you upon our receipt of the project. Also, please be aware of Section 317.l(a) (2) (A) of the rules which states, "Approval given by the commission is not intended to relieve the sewerage system owner or the design engineer of any liabilities or responsibilities with respect to the design, construction, or operation of the project." 5. Within 60 days of the completion of construction, an appointed engineer must notify both the Permitting Section of the TNRCC's Watershed Management Division and the appropriate Region Office of the date of completion. The engineer must also provide written certification that all construction, materials and equipment, and test results were substantially in accordance with the approved plans and specifications, the rules of the TNRCC and any change orders filed with the TNRCC. All notifications, certifications and change orders must include the signed and dated seal of a Professional Engineer registered in the State of Texas. 6 . All plans and specifications shall conform with any other waste discharge requirements and water quality standards established by the TNRCC, as the requirements pertain to a regulated discharge.
