TYPE OF DEVELOPMENT:
This permit is valid for the proper grading and the establishment of vegetation on the
referenced tract to correct erosion that occurred as a result of off-site stockpiling during
construction of the Jefferson Ridge Apartments. Contractor shall prevent silt and debris from
leaving the site in accordance with the City of College Station Drainage Policy and Design Criteria.
Owner and/or contractor shall be responsible for any damage to existing city streets or
infrastructure due to heavy machinery and/or equipment.
This permit, being temporary, is valid for ninety (90) days of the date shown below, and is
not intended to allow for the development of any additional site . Any work performed after the
expiration of this permit is not covered, and will be considered unauthoriz.ed .
In accordance with Chapter 13 of the Code of Ordinances of the City of College Station,
measures shall be taken to insure that debris from construction, erosion, and sedimentation shall
not be deposited in city streets, or existing drainage facilities .
I hereby grant this permit for development of an area outside the special flood hazard area.
All development shall be in accordance with the plans and specifications submitted to and
approved by the City Engineer in the development permit application for the above named project
and al of the cod sand ordinances of the City of College Station that apply .

JPI Development has recently completed construction of the apartment complex adjoining
your tract in College Station. As you know, during the course of construction a dirt stockpile was
inadvertently placed on a portion of your property, which led to an erosion problem after it was
removed . JPI has discussed this situation with the City of College Station, and has asked our help
in arriving at a remedy. JPI, under the direction of their landscape architect, plans to regrade and
revegetate the disturbed area to eliminate the erosion problem and the unsightly result. In
~djtjon , it is their intent to ~e the construction debris, even though it was not dumped by
them, including the siding anO"C'Oncrete spoil which was dumped during the construction of the
mini warehouses, and also the abandoned couch which has been noted by everyone who has
looked at the site . JPI is ready to begin the cleanup and regrading in the next week or so .
Yesterday, I spoke with Mrs. Mary Kirkpatrick to inform her of what was planned, and
she asked us to contact you and your sister. As you know, JPI will need permission from at least
one of the co-owners to legally proceed with any physical site work. If you will grant JPI
permission to enter your property for the purpose of limitQ! regrading, erosion control and
revegetation as described above, they can proceed to deal with this situation rapidly . If you agree,
please sign on the space provided below and return one copy of this letter. I have included a self-
addressed stamped envelope for your convenience. Please feel free to call me if you have any
questions about this matter.

Per our conversation today, due to contlicts between original topos and existing we will
attempt to re-grade to properly drain the disturbed area behind our site_ We will re-
establish grass, via seed and temporary irrigation. Silt fences will be used to contto1
erosion. After vegetation has been established the flume within our detention pond will be
cleaned and the temporary irrigation removed.
Greg Taggert with MDG will be the party signing the permit for JPT . I would think that if
given the permit, work will start within five (5) business days _
I am sorry for the delay but as we dug deeper and deeper more information came available.
We will get started as soon as possible _

Re: Detention Facility at Jefferson Ridge Apartments (DDP #233)
Dear Steve :
Per our conversation today, it is our intent to perform the following activities in an effort to
rectify the erosion problem on the adjacent site (northwest comer of Jefferson Ridge). Based
on certain information which JPI will receive from l\.1DG Engineers, the following will take
place:
1. l\.1DG will provide JPI with existing grades on the property located to the west
of Jefferson Ridge;
2 . If the grades do not reflect site conditions (contours) that existed prior to work
commencing on Jefferson Ridge, :MDG will provide us the information needed
to restore the site to its original grades;
3. JPI will submit the information to the City of College Station for a permit;
4. JPI will regrade the area in question, restore vegetation by applying winter rye
hydro mulch, temporary irrigation, and staking hay bales. If the hay bales do not
control the erosion while re-establishing the vegetation, silt fences will be added
and;
5. Once the area has been re-established, JPI will clean out the flume within the
detention pond at Jefferson Ridge .
We anticipate that l\.1DG will start verifying grades within a few days and based on the
information we receive, we will start the permitting process and the work immediately
thereafter. Based on the above information we believe all work can be completed by the end
of February.· As we both know weather will effect our time schedule but it is our desire to
complete the work as soon as possible.
With reference to your memo dated December 19, 1995 to the Property Manager at Jefferson
Ridge concerning possible fines being levied on Jefferson Ridge, it is my understanding that no
further action will be taken unless JPI fails to follow through with the contents of this letter.
