RE: HEB DETENTION POND RETROFIT DESIGN
Dear Roy:·
We have reviewed your plans for the above referenced project and have the following comments:
1. The aluminum splash panel is unacceptable. This form of protection is not permanent and in our opinion will not
withstand the water forces imposed upon it.
2 . Dimension the height of the addition on top of the existing concrete wall.
3. Show what method you intend to use to get the water from the Redstone Apartments parking lot into the creek.
4 . Show what method you intend to use to get the water from under the ~edstone Apartment pool deck into the creek.
5. Does the detail provided on sheet #4 have rebar throughout or only in the bottom 2-3 sacks of Quickcrete?
6 . The existing outlet ponds water 2-3 feet deep from the v-notched weir to the end of the easement area shown on sheet
# 1. This area must be graded to drain . It currently does not.
7 . The existing site observations of the area illustrate that the velocities of water exiting the pond (from the concrete

The following items, relating to stormwater flow at subject location were reviewed with you,
at your office , last week :
1. Proposed aluminum splash panels .

3 . Redstone Apartment parking lot drainage method .
4 . Redstone Apartment pool deck drainage method .
5. Rip-rap reinforcing details .
6. Standing water within drainage channel.
7 . Water discharge flow channel velocities .
After meeting with you, the items were again discussed with Mr. Les McGehee of H.E .B.
The following are therefore submitted pertaining to the same issues:
1. The splash wall at the end of the discharge ramp will be constructed of concrete ,
as detailed by sheets #2 and #5 , alternate 2, of the drawings submitted to you .
2. The proposed splash wall height extension dimension is defined by sheets #2
and #5 of the attached drawings.
3. T he stormwater discharge from the Redstone property has always been via
the Redstone pool area , beneath the pool deck . No change in drainage is
proposed . While work proposed hereby is being done, however, positive drainage
from the deck area will be provided at the end of the rip-rap retainer. The
established drainage routing will be observed for poss ible routing damage , etc.,
created by wash-out eros ion .
4 . (See item #3)
5. Reinforcing of the Quickrete rip-rap wall is to be according to manufacturers
recommendation and will generally be as shown by drawing sheets #3 and #4.
(Manufacturers recommendation sheet is attached hereto).
6 . Silt will be removed from the flow channel, from the discharge weirs to the end
of the L.U .L.A.C . easement. After silt removal the existing stone rip-rap liner will be
restored to function as originally planned . Routine maintenance will then be
performed on an intermittent basis to prevent excessive future silting.
7 . During the "clean-up" provided by item 6 , above , the stone rip-rap channel
bottom profile will be checked and adjusted to provide a discharge flow velocity of
6 feet per second at the discharge end of the L.U .L.A.C. easement. Not sharp
drops will be created at the discharge end due to work being performed .

RE: HEB Detention Pond "Retrofit"
l had a long discussion with Roy Hammons on December 11, 1995. He brought in his revisions to the
plans based on my redline comments several weeks ago . I reviewed these revisions and commented
during our 2 1/2 hour meeting . My original comments consisted of 7 items . They were as follows :
1. Proposed aluminum splash panels not permitted
2 . Splash wall height dimensions
3. Redstone Apartment parking lot drainage method
4 . Redstone Apartment pool deck drainage method
5. Rip-rap reinforcing
6 . Standing water within drainage channel
7 . Water discharge flow channel velocities
Several of these comments have not been addressed to my satisfaction . They are :
1.) Roy is still proposing the aluminum splash panel. He has provided on his drawing a "concrete
extension" to the height of the wall but he feels that this is the city's alternative and not really the one
HEB wants to do . I explained my position regarding aesthetics, durability , maintain ability and that
HEB won't be looking at it, the adjacent residents will and said that my answer to the aluminum is still
NO .
2.) Answered .
3 & 4 .) Still not addressed in my opinion . Although Roy thinks I am trying to get HEB to solve
Redstone's drainage problem, which Roy says existed prior to the construction of HEB , I disagreed .
explained that I am trying to get HEB to look beyond their property line to areas that were damaged
as a result of the "breach" and can no longer function the way they originally did prior to the breach
of the wall. Roy said HEB doesn't want to do anything beyond their property lines as (the following is
my words) it would then imply liability . I told Roy he would have to go back to HEB and tell them
they need to look beyond their property lines because I believe (and I was there in knee deep water
watching) there is damage under the pool deck caused by the HEB detention pond design.

5.) I as ked him to provide me a copy of the mfg . recommended reinforcement schedule so that I can
provide it to my inspector. He said he would forward that information .
6 .) He did not answer the standing water issue except to say that if the silt is cleaned out, the water
wouldn't stand . To that I asked is that what HEB was go ing to do and he said he couldn't commit
HEB to this . I said I needed that commitment. Roy said he would get that in writing from them.
7.) I asked what the velocities were in the channel. He responded with calculations knowing that the
velocity in the creek to Anderson would be 7+ fps . Our dra i nage ord inance calls for this velocity to
be contained in a channel that is lined in some fashion . To this comment, Roy said he would try to
"slow" the water down so that when it leaves HEB's prop erty it would be no more than 6 fps . Our
drainage ordinance states this is the max velocit y for a "sodd ed" chann el. Again my impression is
that Roy has been directed to do everything on HEB's property and not extend any improvements off
th at property because it would imply liability . (again -my words, not Roy 's)
Roy we nt back to talk to HEB. I am disappointed to say the l east in this project. I feel that the repairs
are being "short-sighted" and "cheap" and I am afra id that the results will be poor at best.

Dear Mr. Mehringer:
I sent you a letter dated October 23 , 1995 in which a deadline was set for HEB to prepare and submit
plans that addressed drainage problems at the dete ntion pond adjacent to the Enclave Apartments. The
date of that deadline was November 3 . Plans were submitted by Roy Hammons prior to that date and were
quickly returned with comments by my staff. The comments pointed out various shortcomings of the
plans and made specific statements about materi als that were not allowabl e. Mr. Hammons was asked to
resubmit these plans with revisions to address the concerns of my staff.
Following a long period of inactivity, a second set of plans were resubmi tted by Mr. Hammons on
December 11. The second set of plans failed to address most of the comme nts from the first submittal and
are unacceptable to the City of College Station .
I am beginning to believe that there is not the commitment of behalf of HEB and Roy Hammons to
address the flooding problems in the area of the detention pond as we were led to believe in earlier
meetings. Therefore, I must set another deadline for submittal of acceptable plans for work on the
detention pond and its outfall. That deadline is January 5, 1996 . Ifwe have not received an acceptable set
of plans that address the comments made on the first submittal, we will assume HEB is not making a good
faith effort in this matter and turn it over to our legal department for subsequent action.

concerns and intends to fulfill its responsibilities regarding the detention pond . As you know,
HEB is in an arrangement of shared use and responsibility for the detention pond with the other
Owners, and cannot unilaterally speak for all the Owners, but in response to your letter we
propose the following work and pledge to use our best efforts to obtain the participation of the
other Owners, whom we know to be conscientious in matters of this nature.
1. Regarding your item "a. the end wall of the outlet structure is too low and not long
enough" .............. PROPOSAL: We propose to add to the height of the concrete retaining wall
of the outlet structure in accordance with plans prepared by Roy Hanunons, upon City acceptance
of the plans.
2. Regarding your item "b . a berm outside of the outlet structure has been breached and
is in need of repair'' .............. PROPOSAL : We propose to reinforce and fill gaps in the berm
with concrete rip-rap . Work would be in accordance with plans prepared by Mr. Hammons, upon
City acceptance of the plans .
3. Regarding your item "c . the downstream ditch is in need of cleaning and
modification" ............... PROPOSAL: We propose to clean and clear the downstream ditch from

its designed level. To maintain the pond at its designed level of capacity, we propose for the
Owners to establish an effective maintenance program of grass/weed control and silt removal at
regu lar clean-up intervals (and as needed between periodic clean-ups), for both the detention
pond and the LULAC easement area below the pond . We would volunteer the maintenance
program for regular inspections by the City, with the request that the City notify a designated
Owners' representative to attend inspections in order to streamline communications .
Upon the City's acceptance of the above work proposals , and City approval of Mr. Hammons'
design plans for proposals #1 and #2 above, HEB will promptly contract for and proceed with the
proposed work, in good faith that the other Owners will reimburse HEB for their respective
shares of the cost. We estimate that we would be able to complete all work within 3 weeks after
City approval of plans .
Regarding your suggestion that the drainage ditch below the LULAC easement needs to be
improved, and that the Owners utilizing the detention pond need to undertake such
improvements , we agree only that the downstream ditch needs to be improved; but we disagree
that the Owners should have responsibility for such improvements . When the propo·sed work on
the detention pond and the LULAC easement is complete, stormwater from the parcels of the
Owners will be properly handled and discharged from the pond, then onto and across the LULAC
easement. Stormwater drainage below the LULAC easement will include not only water which
has come from the properties of the Ovvners but also the drainage from other properties besides
those of the Owners. It is our position that below the LULAC easement, the drainage ditch is a
part of the City's overall municipal drainage, commonly serving abutting properties, and within th e
responsibility of the City to control the gathering surface drainage . HEB respectfully declines to
perform any work on the drainage ditch below the LULAC easement, and we look to the City of
College Station to perfonn work as necessary to meet the City 's responsibility on areas
downstream from the detention pond and the LULAC easement.
We want our discussions to be clear and directed toward a constructive resolution of the problem .
Please let us know if there is any portion of your letter to which we have failed to respond clearly ,
and we will look forward to hearing back from you regard ing our proposal .

Various items have been reviewed relating to stormwater flow at subject location . Your
latest letter addresses these issues: 1·

We submit the following information and comments pertaining to the same issues :
1. While no material is considered truly "permanent", aluminum does not rust and
according to manufacturers of aluminum products, aluminum in fact has a very long
life span . If allowed, placement and attachment can , and will, be done with
structural integrity far in excess of water pressure potent ial at the top of the wall.
Aluminum panel and concrete topping wall details are provided by sheet #5 of the
attached drawings .
a) We know that the flooding that has been experienced at this location
indicates wate,r flow above the existing wall height. Grass/debris collection at
the chain link fence on the wall shows a high water line approximately 8" to 1 O"
above the wall. The potential force of a 1 O" liquid head is not great. I also point
out that the levels we have experienced does not accurately reflect an
adequately maintained flow channel. Attachment #1 (Flow calculation print-out
from Haestad Methods Software) calculates the flow depth along a properly
maintained 1 O' wide concrete discharge channel leading to the subject wall at
a depth of 1.06' during the 100 year event (producing 90 CFS discharge
volume). We, however, recognize a change of direction and channel condition
at the wall that results in a calculated flow depth of 1.57' (Attachment #2) which
would result in an effective flow depth of 1.57' at the wall. The 1.57' flow depth
impacting the concrete wall will create some degree of splash . We anticipate
the splash to result in minimal, or no , water flow over the existing 3' concrete
wall even without the height increase. . The ditch condition at the time of
previous flooding, however, is more closely simulated by the calculations of
Attachment #3. It indicates an imposed flow depth of 2 .65' at the 3' concrete
wall due to the rip-rap section of the ditch being approximately 50% blocked .
Flow depth at 2 .65' in a 3' containment wall will definitely result in over-spill at
a point of direction change . The constant flow created by such conditions in this
case has resulted in a continuous flow over the wall and the eventual failure of
the natural ground barrier between the rip-rap flow channel and the adjacent
Redstone land tract. Remediation of the flow constriction condition will, in my
opinion, substantially reduce, if not completely eliminate , the "wall spill" that has
been experienced .
2 . The proposed splash wall height extension dimension is clarified by sheets #2
and #5 of the attached drawings .
3. The method of discharge for transfer of Redstone property stormwater run-off to
the original flow line has never been modified . Attachment #4 is a representation
of the original topo that shows a natural flow line along the Redstone land adjacent
and parallel to the Enclave/Lulac south properly line . The rip-rap flow ditch that was
constructed for detention pond discharge flow is wholly within the Enclave/Lulac
tracts and was excavated from natural ground that was the north bank of the orig i nal
flow . A portion of the natural barrier was left in place, as is attested to by the
growth of mature trees on the Redstone tract north property line . It may , in fact, be
the breach in this barrier that has caused the flooding that has been experienced .
4 . (Same as item #3)
5 . Reinforcing of the Quickrete rip-rap wall is to be according to manufacturers
recommendation and will generally be as shown by drawing sheets #3 and #4 .
6 . Standing water in the discharge channels of the existing easement has been
measured at approximately 1' and is so standing due to silting that has not been
removed from the flow channel. Since the channels have not been cleaned since
the stormwater collection area has been fully developed , it seems reasonable that
most of the silting was deposited before a nd during construction activ it ies . After
clean ing and restoration to original configurat ion , there may be very little additional
silt ing . If so , the channel should require a minimum of ma intenance after the in it ial
clean-out .
7. Water disch~rge velocities in the flow channels do not calculate as excessive for
lined channels. ; The concrete section calculates at 8+ feet per second and the rip-
rap section calculates at 7+ feet per second .
If we can be of assistance in solving the flooding problem we are happy to do so . We
believe, however, that the problem stems from restricted flow throughout the drainage
channels .
The drawings presented herewith are to solve specific physical problems. Where more than
one solution method is shown we propose that either is a suitable solution. Selection of the
method to be used is a City of College Station -H.E.B . issue .

I received, from Roy Hammons on December 27 , 1995, a letter outlining the plans and
procedures which HEB would like to have approved for the repair work to the detention
pond . Mr. Hammon's letter and the items outlined therein appear to meet the City of
College Station ordinances and our concerns in the damaged areas . As I stated to Mr.
Hammons, item #3 and #7, as written are not well defined . Please be aware that the City
inspector assigned to this job will be assuring that these items are completed to the City's
satisfaction. I understand why you desired to have them so loosely worded, but by doing
so we are all in a position of delving into . an "unknown", without the problem and
solutions being well-defined before we begin . I certainly am not opposed to working
things out in the field, however, I've found that people are sometimes surprised when they
realize what is expected, once the problem is defined . My understanding from Mr.
Hammons is that, this is exactly why you desire to work these items out in the field . You
would prefer to get a contractor in the field , see what they uncover as problems, have
them possibly take grade shots and then find an acceptable solution, rather than
performing hours of survey work now, defining the problem and working out a solution.
I have prepared a development permit for this work. Once you have selected a contractor
for the job please have them stop by our office to sign and date the permit and pay the
appropriate fees . The fee for' this permit will be $100 .00, payable to the City of College
Station. When the contractor stops in I will have attached to the permit, the inspector's
card for his/her information . It is imperative that prior to commencing work that he/she
notify the inspector that they will be beginning work .

several property owners in the immediate vicinity who will be thankful to see work is

Update Regarding HEB Shopping Center and Pine Ridge Duplex
Flooding
I wanted to give you a brief status report on the flooding situation caused by the storm
water detention basin that serves the HEB/Target/Enclave development. This detention
basin is upstream from duplexes on Pine Ridge that have experienced flooding staff
believes is the result of this detention basin's inadequate design and performance .
Following Council's direction to pursue appropriate remedy (and if necessary, legal
action), the civil engineer who designed this detention basin submitted a design for
modifications to it. After staff reviewed his submittals , we found them to be totally
deficient in addressing the problem and so advised him . After a lengthy delay, he made
some modifications to these plans and resubmitted them. However, in staffs view ,
these most recent proposed modifications are still entirely inadequate in terms of
remedying the problem .
For that reason , we recently sent letters via certified mail to this engineer as well as
representatives for HEB giving them a deadline of January 5, 1996 to submit acceptable
plans to us for remedying the basin and its outfall or we plan to turn this over to the City
Attorney's office for further legal action.

We have reviewed your plans for the above referenced project and have the following comments:
1. The aluminum splash panel is unacceptable . This form of protection is not permanent and in our opinion will not
withstand the water forces imposed upon it.
2. Dimension the height of the addition on top of the existing concrete wall.
3. Show what method you intend to use to get the water from the Redstone Apartments parking lot into the creek.
4 . Show what method you intend to use to get the water fi:om under the Redstone Apartment pool deck into the creek.
5. Does the detail provided on sheet #4 have rebar throughout or only in the bottom 2-3 sacks of Quickcrete?
6. The existing outlet ponds water 2-3 feet deep from the v-notched weir to the end of the easement area shown on sheet
# 1. This area must be graded to drain . It currently does not.
7. The existing site observations of the area illustrate that the velocities of water exiting the pond (from the concrete
wall with the v-notch to the end of the easement area) are well in excess of the velocities allowable in the drainage
ordinance for a vegetative bottom or one with loose rip-rap (as was originally designed). Please correct this problem
in your retrofit design solution.

Subject: Flooding Problems on Pine Ri gc Street

In response to a letter addressed to you from Mr. Neal Briers as well as several telephone calls from other property
owners on Pine Ridge Street , my staff met with Mark Smith and members of his staff to develop alternatives to
address a flooding problem that exists on Pine Ridge Street. Pine Ridge is a street which runs between Brentwood
and Anderson approximately 1000 feet west of Texas Avenue. It is a curb and gutter street with a short
underground drainage system . Most of the properties along the street are duplexes . These duplexes are the
buildings which were most effected by the flooding in the October and December rain.fall events . We have been
notified that at least six duplexes received water in the building.
Behind the duplexes to the north are two apartment complexes, both of which have detention ponds that empty into
a privately owned, unimproved drainage channel that also rnns behind the duplexes on the north side of Pine
Ridge . The exact cause of the flooding is difficult to determine at this site. It is likely a combination of several
contributing factors . First, and probably most notably, is the magnitude of the rainfall events themselves'. In both
events, unusually heavy rains fell causing many areas of the city to experience flooding problems that are normally
unaffected . Secondly, several of the affected buildings are constrncted very low in relation to the top-of-curb on the
street. These duplexes have "sunken" living room floors that are a few inches below the remainder of the building
slab thus exasperating the problem . Third , the detention ponds owned by the apartment complexes have been
poorly maintained and are likely not being utilized to their design potential. Fourth, the drainage channel is in
need of maintenance to remove trees and other flow impediments. Fifth, the pipes carrying water across Anderson
may not be adequate for the amount of water coming down the channel. Sixth, in an attempt to keep water off
their individual properties, each property owner has placed varying amounts of dirt in their back yards and have
eliminated any type of natural or designed drainage path for water to leave the site. Consequently, it builds up
until it begins to flow into the buildings .

r meeting with Public Services we developed five alternatives for addressing this flooding problem. They are
a follows :
>-., 1. Require the apartment complexes to clean out and maintain the detention ponds so they perform the
~ function for which they were intended. This can be done through our code enforcement authorities.

Acquire drainage easements for the channel from the adjoining property owners and clean out the
channel. Estimated cost: $5,000, assuming property owners are willing to donate it to the City.
Improve the drainage channel in the appropriate manner (concrete lining, gabions, etc.) to increase its
carrying capacity. Estimated cost: $300,000 *.
Install at least one additional pipe across Anderson to prevent the existing crossing from acting as a
restriction to the drainage channel. Estimat ed cost: $15 ,000 *.
Install an underground drainage system along Pine Ridge to capture water now flowing down the street to
prevent it from rising to a level where it begins flowing into the duplexes . Estimated cost: $75,000 *.
Install a stonn drainage system along Barthel ow to c:ipture water leaving that street before it enters the
area being affected , and in doing so, provide another outfall for the apartment complex owners to use
when solving their internal drainage prohlems . Estimated cost $100 ,000 *
Funds for these projects have not been id entified . Current drainage funds have been allocated toward for
other proj ects throughmit the City .
It is our feeling that despite the measures we arc proposing, flooding may still occur in this area when rainfall
events of the magnitude we have recently experienced happen again. It is virtually impossible to design a system
that will carry the volume of water necessary to prevent flooding during these extreme events, especially in areas
that are prone to flooding , as this one is .
It is difficult to explain to flooded property owners that there is little the City can do to guarantee their problems
will not occur again . All they know is that within a period of about two months, the buildings on their property
flooded twice and they want something done to alleviate the problem . The measures we are proposing will at least
convey that we are attempting to address the flooding issue in their neighborhood .

1 e ore, only the first two items shown above are reasonable to undertake. My staff can begin work on those

departmental budget. Assuming the proposed bond election passes, some or all of the remaining items shown
above can begin as soon as bonds are sold . I believe this project would be an ideal candidate for construction since
multiple properties are being adversely affected by flooding . Since this is a relatively simple engineering project, it
is one I would consider doing in-house with my staff.

We wanted to let you know what is going on with this project.

As you may know, improvements have been made to the detention structure that serves the HEBffarget
commercial development as well as the Enclave Apartments. The City of College Station is pursuing
improvements to the drainage channel from this detention structure to Anderson Street, as well as
improvements to the culvert under Anderson Street. We have the engineering design underway. Once
this design is finished , we will know the drainage easement size and improvements needed for this
channel. This, in turn , affects easement dedication. We are working on this project with the
understanding that all the property owners along this channel will give this easement to the City so that
construction can begin this summer. With your cooperation, if we can get all necessary easements given
to us in a timely fashion , we plan to bid this project out in July. It should take about 3 months to
complete the construction .
In the meantime, please let me know if you have any questions regarding this project. Unless I hear
otherwise from you , I will assume that you are amenable to giving a dedicated drainage easement on
your property to the City for this project . Your cooperation is greatly appreciated.

I am writing this letter to provide you with formal notice of three drainage probl ems
present at the HEB drainage detention facility.
1. the retrofit wall is acting as a barrier which increases flood hazards to adjacent
property.
2 . the drainage facility is inadequately maintained because the vegetation has not
been cut back which can impair capacity for conveyance of the stormwater flow
in your facility
3 . peak stormwater flows are exceeding those that existed before development
If you will recall there are several duplexes just downstream of the HEB store in College
Station . In [)ecember 1995, HEB designed and constructed a wall extension to its
detention pond in an attempt to fix improper drainage that resulted in the flood ing of
duplexes on the adjacent property in October and December of 1994'.
During the review of the HEB detention pond retrofit, we asked your design engineer to :
• "Show what method you intend to use to get the water from the Redstone
Apartments parking lot into the creek"
• to ushow what method you intend to use to get the water from under the Redstone
Apartment poo l deck into the cre ek.
Your design_~ngineer represented to the City of College Station th~t. uThe stormwater
discharge from the Redstone property has always been via the Redstone pool area,
beneath the pool deck. No change in drainage is proposed. While work proposed
hereby ' is being done, however, positive drainage from the deck area will be provided at
the end of the rip-rap retainer:
On August 11, 1996, the largest rainfall occurred since the retr<;>fit to your detention
facility has been constructed. The City had personnel in the field observing flooding

areas. The duplexes were once again flooded . While observing the stonnwa
location, it appeared that water from the Redstone Apartments parking lot, tha
entered the creek prior to the addition of the sackrete wall, is now partially blo
entering the creek by that wall. Instead, the water takes the path of least resist
and flows into the rear of the duplex lots . While it appears to us that some of thi
water was able to leave the downstream side of the pool deck, a large amount di\
and instead entered the rear of the duplex lots .
This recen t flooding indicates that the problem noted by the City during design re vr
was not adequately addressed by your engineer's design. Roy Hammons, your de~
engineer, was infonned of our findings regarding this most recent flooding on the
morning of August 12th.
The purpose of the City of College Station drainage ordinance is "To restrict or prohio
development which is dangerous to health, safety, or property during flooding
conditions , or causes unacceptable increases in water surface elevation or velocities:"
and "To prevent the construction of barriers which will divert stonnwater flows and
subject other lands to increased flood hazard". See, Chapter 12, Sections 1.8 .7 and
1.8.10. As it exists, it is my opinion that your development fails to meet both of these
conditions . In addition, the facility is out of compliance pursuant to Section 50 (1), (6)
and (12). (Please see attachment)
Non-compliance with Section 50(1)
The City is currently working on downstream drainage to improve maintenance in this
drainage channel. In the course of working on the downstream project our design
engineer assessed the flows coming from your facility and concluded, albeit using a
different methodology, that your facility is not detaining sufficient flows. Even using the
same methodology, the review of the ~lculations show the pond is only detaining
through the 25 year stonn event instead of the 100 year event.
Non-compliance with Section 50(6)
As stated above, it does appear from field observation that you indeed have
constructed a barrier which is increasing flood hazards to other lands.
Non-compliance with Section 50(12)
The maintenance of the pond must be addressed . The pond should have maintenance
scheduled on a regular basis (at a minimum -twice a year). In it's present state, it is a ·· ~
nuisance, health proble01 and has decreased stonnwater capacity: In the past, HEB
and Enclave complained that it is difficult to maintain and that it can only be done in
August b.ecause of the so(t bottom. If you cannot maintain the facility in its current
configuration, perhaps you should e)(plore construction of a bottom that is maintainable.
Your corrections to the above cited problems may affect the City's downstream project.
Consequently, we are requesting that you correct the above-listed problems
immediately and that this correction be submitted, approved and constructed on or
before October 1, 1996.
