This permit is valid for the construction of the box culvert per the approved plans . A
TexDOT permit must be obtained prior to construction in the SH 6 right-of-way. As-built
plans must be provided upon completion along with easements necessary to cover the
culvert structure .
Contractor shall prevent silt and debris from leaving the site in accordance with the City of
College Station Drainage Policy and Design Criteria. Owner and/or contractor shall be
responsible for any damage to existing city streets or infrastructure due to heavy
machinery and/or equipment.
This permit is valid for 1 year after which time it will expire . The applicant may request an
extension in writing to the City Engineer.
In accordance with Chapter 13 of the Code of Ordinances of the City of College
Station, measures shall be taken to insure that debris from construction, erosion, and
sedimentation shall not be deposited in city streets, or existing drainage facilities.
I hereby grant this permit for development of an area inside the special flood
hazard area. All development shall be in accordance with the plans and specifications
submitted to a approved by the City Engineer in the development permit application for
the ab ve na d project and all of the codes and ordinances of the City of College Station
tha ply.

I am sending you the attached drainage study report of 1.546 Acres, NE. Corner
of Highway 6 Bypass and Highway 30 (Harvey Road) College Station, Texas for
your comments . This report was submitted to us by Civil Design Services, Inc.
and was prepared for the owner of the tract, Mr. K. D. Timmons . This proposal is
to enclose the existing ditch in box culvert. The proposed box culvert
improvements are designed to mitigate the site flooding while improving
drainage conditions both upstream and downstream of the property .

RESPONSIBILITY FOR PACKAGING ANO COMPLETING A/RB/LL
You are responsible for adequately packaging your goods and
for properly filling out . ths Airbill. Omission of the number of
packages and weight per package from this Airbill will result in a
billing based on our best estimate of the number of packages
received from you and an estimated "default" weight per package ,
_as determir:1ed and perlqdic~lly adjusted by us.
AIR TRANSPORTATION TAX INCLUDED
Our basic rate ip.cludes a federal tax required by Internal
Revenuj3 Code_ Se¢tiqn . 4271 on the air transportation portion of
this service. LIMITATIONS ON OUR LIABILITY
ANO LIABILITIES NOT ASSUMED
Our liability for loss or damage to your package is limited to your
actual damages or $100, whichever is less, unless you pay for and
declare a higher authorized value. We do not provide cargo
liability insurance, but you may pay an additional charge for each
additional $100 of declared value. If you declare a higher value
and pay the additional charge, our liability will be the lesser of
your declared value or the actual value of your package.
In any event we will not be liable for any damages, whether
direct, incidental, special or consequential in excess of the
declared value of a shipment, whether or not Federal Express had
knowledge that such damages might be incurred including, but not
limi ted to, loss of income or profits.
We won't be liable for your acts or omissions, including but not
limited to improper or insufficient packing , securing, marking or
addressing, or for the acts or omissions of the recipient or anyone
else with an interest in the package. Also , we won't be liable , if
you or the recipient violates any of the terms of our agreement.
We won 't be liable for loss of or damage to shipments of
prohibited items.
We won't be liable for loss, damage or delay caused by events
we cannot control , including but not limited to acts of God, perils
of the air, weather conditions, acts of public enemies, war, strikes,
civil commotions, or acts or omissions of public authorities
(in cluding customs and quarantine officials) with actual or
apparent authority.
DECLARED VALUE LIMITS
The highest declared value we allow for FedEx Letter and FedEx
Pak shipments is $500 . For other shipments , the highest declared
value we allow is $50,000 unless your package contains items of
"extraordinary value," in which case the highest declared value we
allow is $500. Items of "extraordinary value," include artwork,
jeweJry, furs, precious metal$, negotiable instruments , and other
items listed.in our current Service Guide.
' If' you Send more than one package on this Airbill , you may fill in
the total declared value for all packages, not to exceed the $100,
$500 or $50,000 per package limit described above. (Example: 5
packages can have a total decla red value of up to $250,000.)
· It more than one package is shipped on this airbill , our liability
for ·loss or damage will be limited to the actual value of the
package(s) lost or damaged (not to exceed the lesser of the total
declared value or the per package limits described above). You
have the responsibility of proving the actual loss or. damage.
FILING A CLAIM
ALL CLAIMS MUST BE MADE BY YOU IN WRITING . You must
notify us of your claim within strict time limits. See current Service
Guide .
We'll consider your claim filed if you call and notify our
Customer Service Department at 800-238-5355 and notify us in
writing as soon as possible.
Within 90 days after you notify us of your claim, you must send
us all relevant information about it. We are not obligated to act o n
any claim until you have paid all transportation charges, and you
may not deduct the amount of your claim from those charges.
If the recipient accepts your package without noting any damage
on .the d~livery recor~ •. we will assume t~a.t the package was
delrvered in good cond1t1on . In order for us to process your claim,
you must, to the extent possible , make the original shipping
cartons and packing available for inspection.
RIGHT TO INSPECT
We may, at our option , open and inspect your packages prior to
or after you give them to us to deliver.
NO C.O.D. SERVICES
NO C.O.D. SERVICES ON THIS AIRBILL. If C.O.D Service is
required, please use a Federal Express C.0.D. airbill for this
purpose.
RESPONSIBILITY FOR PAYMENT
Even if you give us different payment instructions, you will
always be primarily responsible for all delivery costs, as well as
any cost we may incur 1n either returning your package to you or
warehousing it pending disposition.
RIGHT OF REJECTION
We reserve the right to reject a sh ipment at any time, when
such shipment would be likely to cause damage or delay to other
shipments, equipment or personnel , or it the transportation of

Dear Ms. Morgan:
We have completed our review of the referenced report and offer the following
comments:
1) Review of basic hydraulic data such as drainage areas, Q's, TW, HW,
etc., seems well within eng i neering parameters. However, is the
value of QlOO Ultimate reasonable considering the existing stormwater
management ordinance for the City of College Station?
2) Considering the drainage area for existing TxDOT structure(3-7'x4'x54'
MBC W/FW)is somewhat less than for the existing and proposed downstream
structures, an evaluation of the HW conditions for QlOO on the existing
TxDOT MBC should be performed. Preliminary analysis at this location
indicates that the HWlOO will be increased over existing conditions to
the point where runoff may overflow the roadway. Will further entrance
modifications alleviate this possibility?
3) Since the major drainageway must turn approximately 70° to enter
proposed structure, it is recommended that a grouted, rock-rubble type
riprap be utilitized to protect the proposed structure and new embankment
at this site.
4) Investigate advantages and disadvantages of using a skewed headwall
with parallel wings. This will eliminate encroachment into the
right-of-way with the proposed flared wingwall.

George Ball just spoke to me re: the
Timmons Chevron/Restaurant project at
the NW corner of SH30 and SH6 (by
Furrows). George wanted to confirm
that our position had not changed on
the platted and unplatted parcels. I
confirmed that they could combine the
paltted and unplatted parcels into a
building plot since they were both
legitimate building plots at this time.
I advised that a plat may be best if
there are to be any easements dedicated
and that a plat would be needed if any
boundaries changed.

Recently the land at the intersection of Harvey Road and the East Bypass ~~ / ~ I
Frontage Road was stripped of trees, bushes , and grass. Of immediate concern is the f' ~ j JJI
bare dirt that will contribute to more water runoff as well as to the backing up of water Jr 1
in requiring the owner to erect mud barriers for now . The stripping of the land and ~
potential development impinge directly on the Windwood neighborhood. The
drainage situation along Harvey from the drainage ditch at this site is a problem that ~ ,#~~
has been brought to the city's attention in Zoning Board of Adjustment meetings , r \j
Planning and Zoning Commission meetings , City Council meetings , and in discussions
with city staff and City Council members. qt..1 ·
All water-from sprinkling systems to flooding rains-runs in the ditches and cement ,,/ 'i :~/
culvert over to the south side of Harvey and the east side of our neighborhood. This 'i'rN ¥ L.i
directly affects the property of the homeowners on Woodcliff, Teakwood, and 1 \ '1~)

We do request that drainage from the Harvey Road -East Bypass Frontage JfJ'..iJ 1. ~-•
Road area be taken down the north side of Harvey Road to Carter Creek NOT to our v r
neighborhood . Tf the site is developed with predominantly imprevious cover' the water r·
runoff will intensify the problems that exist.
That land also poses traffic problems in terms of the entrance and exit of
traffic. The homeowners in Windwood already have problems with entrance into and

and movie beginning and ending times . We have to watch for drivers who are going
east and west on Harvey as well as traffic from the access road from Sam's and the
Ho11ywood Theater and traffic into and from the Furrow's access road . Additional
driveways will exacerbate a serious problem. The development of this land with
primarily impervious cover and high traffic usage businesses will be detrimental to the
neighborhood as well as to the existing traffic flow for highway access and existing
business access.
Please consider our concerns, and please notify the Windwood Homeowners'
Association prior to any decisions on this land. We would like to be notified of any
Project Review Committee meetings on this property , so that neighborhood

Just had a call from Bill Morris, the engineer for the K.D.TilTfllons drainage
project at SH30 & SH6. His drainage plans were received and distributed at
noon on 7/13 (last Thursday), and we told them (like we do everyone) that
the review would take 5 days (or there abouts since we've been
short-handed). Of course, they hear a maximun of 5 days (which was the way
it was set up during the last restructuring), and yesterday marked the 5th
working day, so they're calling to see how the review is coming and when it
will be complete.
The best I could tell them was that a copy was sent to the highway dept on
Monday CI thought), so the review is in progress, but I couldn't tell him
when it would be complete. Of course, the owners are calling him (I've had
1 call from Lee J. Ball earlier in the week), and he would like to be able
to tell them when the redlines will be complete.
I told him he would hear from someone this afternoon. I have his number if
anyone is interested in making that call!

Dear Alan,
The landowner of the above referenced residence desires to improve his property by constructing
a 600 square-foot addition on the northeast side of the existing structure. This improvement
would encroach into the existing private variable width drainage easement (hereinafter referred
to as "Easement"). The Easement is located fully on the subject property and is illustrated by the
attached Exhibit # 1.
Based on our past phone conversations, it is believed that the Easement was originally dedicated
with the plat to reserve land necessary for the construction of a detention facility. This facility
would detain increased runoff from the five ( 5) lot development. This information was affirmed
by a phone conversation that I also had with Mr. Earl Havel who worked with the developer of
this subdivision.
On December 15, 1995, Garrett Engineering submitted, to the city, a drainage letter (hereinafter
referred to as "Letter") illustrating that only "minor increases" in peak discharge rates would be
experienced and that "the downstream infrastructure can absorb same impact with little or no
noticeable increase in storm water ~olume or depth". The Letter is attached as Exhibit #2. It is
my conclusion, based on this Letter, that the City never required the detention facility to be
constructed.
Upon review of the site, it is evident that no detention facility was ever constructed nor could an
effective pond, for the original development, be built without signifiCfil\t grading and
underground piping. The proposed addition would increase the total runoff of the 'entire drainage
area, but it would be a negligible amount (<0.10 cfs at 100-year rainfall event). 1'ere appears to
be no evident purpose for the Easement and the proposed addition would not pose any threat to
downstream developments or drainage structures. Therefore, the Easement could be released in
some fashion.
