Box 9960 College Station , Texas 77842 RE: Property at 1417 and 1419 Bermuda Court Dear Mr. McCulley : STEVEN HOMEYER 4008 Woodbriar Drive Bryan, Texas 77802 Phone: (409) 774-7620 November 14 , 1994 As per our conversation of November 11 , 1994 , I am submitting this layout of proposed channel excavations to improve drainage conditions at the above stated address. This property is located at the bottom of the drainage area and I am proposing the diversion of water to Bermuda Court by way of a small grass lined channel. The enclosed sketch details these proposed improvements. In a letter from Mr. Mark Smith , P.E. dated October 21 , 1994 , he made reference to City assistance if the improvements were located within an easement. There is a 10 foot utility easement along the north property line as indicated on the enclosed sketch. Would this type of easement fall under that condition? By looking at the lay of the land at your duplex on Bermuda it is apparent that you have a flooding problem. Water from the area up hill from your property drains downhill toward the duplex . The structure's slab is not elevated above the ground and the water seeps inside. I'm sorry to say that the City cannot assist yi:m in making improvements to your property to alleviate the problem . The City is prohibited from using public funds for the improvement of private property unless one of three conditions is met: L The action requested is for the direct accomplishment of a legitimate public purpose, and the benefit to a private interest is merely incidental; 2 . The problem to be addressed is.a direct result of some act for which the City is liable; or 3 . The action requested entails some improvement to a public property interest (i.e., an easement). There are landscape firms in the Bryan/College Station area that can help you to correct the problem . They provide expert landscape design and construction services. I think that the berm idea that you mentioned is a possible solution . Also a small grass lined channel that would intercept the water and direct it to the street would help . Actually, a combination of the two concepts could be the best solution. I'd also suggest that you look into a flood insurance policy . The City participates with the Federal Emergency Management Agency to make flood insurance available to all properties in College Station. I hope that you are able to find a solution to your drainage problems. All grading necessary to construct the two swales will be wholly contained on the above prope rty. Maximum slopes and depth of the swales are as shown on the attached approved sketch. Contractor shall prohibit all debris from construction including dirt and silt, from entering public streets and drainage facilities. Contractor shall be responsible for any damage to existing streets, curbs, or public infrastructure due to the construction activities. Contractor shall prevent construction vehicles from tracking dirt, mud, and debris from all exit points of the project, onto any public street. Contractor shall use appropriate erosion control measures such as silt fencing and hay bales, (f necessary, to prevent silt and debris from exiting the project site. In accordance with Chapter 13 of the Code of Ordinances of the City of College Station, measures shall be taken to insure that debris from construction, erosion , and sedimentation shall not be deposited in city streets , or existing drainage facilities. Contractor shall be responsible for damage to any existing street, curb or other public infrastructure. I hereby grant this permit for development of an area outside the special flood hazard area.
